No. 4700 of 2009 quashing<\/p>\n<p>                    the order bearing Memo No. 988, dated 23.12.2008<\/p>\n<p>                    Annexure-6 issued by the District Programme Officer,<\/p>\n<p>                    Rohtas at Sasaram.\n<\/p>\n<p>                                The grievance of the petitioner-appellant<br \/>\n<span class=\"hidden_text\">                   2<\/span><\/p>\n<p>herein was that her services as Anganwari Sewika was<\/p>\n<p>terminated even after a period of four years at the<\/p>\n<p>behest of the husband of respondent no.8, who was<\/p>\n<p>not selected, on the ground that the appellant has<\/p>\n<p>obtained IIIrd Class marks in Matriculation, where as<\/p>\n<p>respondent no.8 has IInd Class marks. The learned<\/p>\n<p>Single Judge has dismissed the said writ petition.<\/p>\n<p>Aggrieved by the same this L.P.A. has been filed.<\/p>\n<p>            Even though contention was sought to be<\/p>\n<p>raised before us with regard to the fact that the<\/p>\n<p>respondent no.8 was not selected at the time of<\/p>\n<p>appointment hence, the appellant was appointed on<\/p>\n<p>that post even after a period of four years her services<\/p>\n<p>were terminated, but prima facie, we are of the<\/p>\n<p>opinion   that   the   service   of   the   appellant   was<\/p>\n<p>terminated at the behest of a complaint filed by<\/p>\n<p>husband of respondent no.8 even after a period of four<\/p>\n<p>years which according to us is belated one and also<\/p>\n<p>the husband of respondent no.8 can not be termed as<\/p>\n<p>aggrieved person as the complaint has not been<\/p>\n<p>animated from respondent no.8 if at all he is the<\/p>\n<p>aggrieved person by selection of the appellant herein.<\/p>\n<p>            Under the aforesaid circumstances we are<\/p>\n<p>of the opinion that the complaint itself is not<\/p>\n<p>maintainable for the above reasons, we set aside the<br \/>\n<span class=\"hidden_text\">                           3<\/span><\/p>\n<p>       order bearing Memo No. 988, dated 23.12.2008<\/p>\n<p>       contained inAnnexure-6 passed by the learned Single<\/p>\n<p>       Judge and accordingly allowed the L.P.A.<\/p>\n<p>             It is submitted by the leaned counsel for the<\/p>\n<p>       State that the post which has fallen vacant after<\/p>\n<p>       termination of the appellant has to be filled up by<\/p>\n<p>       third party.\n<\/p>\n<p>                      Under the above circumstances, we are<\/p>\n<p>       of the opinion that the appellant and respondent<\/p>\n<p>       no.8 can be granted liberty to apply afresh as and<\/p>\n<p>       when vacancy arose and their cases shall be<\/p>\n<p>       considered in accordance with Rules without being<\/p>\n<p>       influenced by any observation made by the learned<\/p>\n<p>       Single Judge or by this Court.\n<\/p>\n<\/p>\n<p>                                    (T.
