Advocate   for   the State\/respondents 1 to 5\n      Mr. Bharat Rajput, Counsel for respondent No 8\n      None for respondents No 6 &amp; 7\n\n\nHonble Shri Rajeev Gupta,J,Honble Shri Sunil Kumar Sinha \n\n\n\n       Dated:20\/04\/2009\n\n\n\n:       Judgment\n\n\n    (Writ Appeal under Section 2 Sub-Section (1) of the Chhattisgarh High Court(Appeal to Division Bench) Act,2006\n\n\n                           ORDER\n<\/pre>\n<p>                        (20.04.2009)<\/p>\n<p>       Following   order    of     the     Court      was<br \/>\ndelivered by<br \/>\nSunil Kumar Sinha, J.\n<\/p>\n<p>(1)   Being aggrieved with the order dated 2.2.2007  passed<\/p>\n<p>in W.P.(S) No. 645\/2007 by the learned Single Judge of this<\/p>\n<p>Court, the appellant\/petitioner has filed this Writ Appeal.<\/p>\n<p>The  following  questions are raised for  consideration  of<\/p>\n<p>this Court:\n<\/p>\n<blockquote><p>     (i)  Whether the basic qualification, subject to<br \/>\n          certain relaxations, for appointment to the<br \/>\n          post of Anganbadi  Workers contained in the<br \/>\n          scheme are `essential&#8217; or `desirable&#8217; ?\n<\/p><\/blockquote>\n<blockquote><p>     (ii) Whether  the word `desirable&#8217; used  in  the<br \/>\n          scheme  has  to be read as `essential&#8217;  for<br \/>\n          the purpose of scheme ?\n<\/p><\/blockquote>\n<p>(2)  Facts briefly stated are as under:-\n<\/p>\n<p>     The  appellant\/petitioner was appointed  as  Anganbadi<\/p>\n<p>Worker  in  Gram Panchayat Amaldiha, Village  Barejahapara, <\/p>\n<p>Tahsil  Pandariya,  District Kabeerdham on  8.11.2006.  Her<\/p>\n<p>appointment was challenged by respondent No.8 on the ground  <\/p>\n<p>that   the  appellant  had  passed  7th  Class  Certificate<\/p>\n<p>Examination, whereas, respondent No. 8 had passed 8th Class  <\/p>\n<p>Certificate  Examination; both were the  local  candidates,<\/p>\n<p>therefore, the preference had to be given to respondent No.<\/p>\n<p>8.  The Additional Collector, Kabeerdham after due inquiry,<\/p>\n<p>cancelled the appointment of the appellant vide order dated<\/p>\n<p>26.12.2006 (Annexure-P\/5 in the Writ Petition) holding that<\/p>\n<p>respondent  No.8 was 8th passed, therefore,  she  was  more<\/p>\n<p>suitable and she should be appointed as Anganbadi Worker of <\/p>\n<p>the concerned village in Gram Panchayat. The said order was<\/p>\n<p>challenged  by  the  appellant in  Writ  Petition  (S)  No.<\/p>\n<p>645\/2007.  The  learned Single Judge  took  the  view  that<\/p>\n<p>according  to  the  scheme  for  appointment  of  Anganbadi<\/p>\n<p>Worker,   8th   Class   passed  is   an   essential   basic<\/p>\n<p>qualification and the preference comes thereafter. In case,<\/p>\n<p>8th  Class passed candidate is not available, the candidate<\/p>\n<p>having lessor qualification may be considered. Taking  such<\/p>\n<p>view  the Writ Petition was dismissed by the impugned order<\/p>\n<p>dated 2nd February, 2007, which has been challenged in this<\/p>\n<p>appeal.\n<\/p>\n<p>(3)   Mr. Rajeev Shrivastava, learned counsel appearing  on<\/p>\n<p>behalf  of the appellant, would submit that the educational<\/p>\n<p>qualification  is  a  &#8220;desirable&#8221;  qualification  and   not<\/p>\n<p>&#8220;essential   qualification&#8221;,  therefore,   the   Additional<\/p>\n<p>Collector as well as the learned Single Judge erred in  law<\/p>\n<p>in holding that the appointment of the appellant\/petitioner<\/p>\n<p>was bad.\n<\/p>\n<p>(4)   On the other hand, Mr. Praveen Das, learned Dy. Govt.<\/p>\n<p>Advocate appearing on behalf of the State\/respondents 1  to<\/p>\n<p>5  and  Mr.  Bharat  Rajput, learned counsel  appearing  on<\/p>\n<p>behalf  of  respondent No.8, opposed  these  arguments  and<\/p>\n<p>supported the order passed by the learned Single Judge.<\/p>\n<p>(5)   We have heard the learned counsel for the parties  at<\/p>\n<p>length and have also perused the records of the Writ Appeal<\/p>\n<p>as also the Writ Petition.\n<\/p>\n<p>(6)  A copy of Part-A of the scheme, showing qualifications<\/p>\n<p>for  appointment to the post of Anganbadi Workers has  been<\/p>\n<p>filed  as  Annexure P\/1 in the Writ Petition. For<\/p>\n<p>the  other  area, it has been provided that firstly  matric<\/p>\n<p>passed  candidate  should be appointed and  if  it  is  not<\/p>\n<p>possible, then, the middle passed candidate should be given<\/p>\n<p>appointment  and if such candidate is also  not  available,<\/p>\n<p>then,  intelligent  candidate  belonging  to  same  village<\/p>\n<p>having some lessor qualification may be appointed but in no<\/p>\n<p>case, illiterate lady has to be appointed on this post.  In<\/p>\n<p>context  of  the above scheme, the arguments of Mr.  Rajeev<\/p>\n<p>Shrivastava   cannot  be  accepted  that  the   educational<\/p>\n<p>qualification  was  a  &#8220;desirable&#8221; qualification.  Clause-6<\/p>\n<p>clearly  states  that since the Anganbadi Workers  have  to<\/p>\n<p>render  their services in various fields under this  scheme<\/p>\n<p>and for that they have to maintain huge records, therefore,<\/p>\n<p>it has been said that they should be educated ladies having<\/p>\n<p>qualification in the manner indicated above.<\/p>\n<p>(8)   The normal rule of construction is that general words<\/p>\n<p>in  a  statute  must receive a general construction  unless<\/p>\n<p>there  is  something in the Act itself such as the subject-<\/p>\n<p>matter  with  which the Act is dealing or  the  context  in<\/p>\n<p>which the said words are used to show the intention of  the<\/p>\n<p>Legislature that they must be given a restrictive  meaning.<\/p>\n<p>Since general words have ordinarily a general meaning,  the<\/p>\n<p>first  task in construing such words, as in construing  any<\/p>\n<p>word, is to give the words their plain and ordinary meaning<\/p>\n<p>and  then  to see whether the context or some principle  of<\/p>\n<p>construction requires that some qualified meaning should be<\/p>\n<p>placed  on  those  words. It is a recognized  principle  of<\/p>\n<p>construction  that general words and phrases, however  wide<\/p>\n<p>and  comprehensive they may be, in their literal sense must<\/p>\n<p>usually be construed as being limited to the actual  object<\/p>\n<p>of   the   Act   (Please   see  Principles   of   Statutory<\/p>\n<p>Interpretation by Justice G.P. Singh, (Sixth Edition  1996)<\/p>\n<p>pp 294 &amp; 295).\n<\/p>\n<p>(9)  If on the above principles the word used in the scheme<\/p>\n<p>like   &#8220;desirable&#8221;   is   interpreted,   the   8th   passed<\/p>\n<p>qualification  has  to  be  held  as  an  essential   basic<\/p>\n<p>qualification with specified relaxations as are provided in<\/p>\n<p>the  scheme  and it has to be read only in the said  sense,<\/p>\n<p>otherwise,  the entire scheme would render infructuous  and<\/p>\n<p>it  would  not be fulfilling the object for which the  same<\/p>\n<p>has been made. There is further indication in the scheme to<\/p>\n<p>give due importance to the qualification because the scheme<\/p>\n<p>provides  that  in  no  case, illiterate  lady  has  to  be<\/p>\n<p>appointed  on the post of Anganbadi Worker. Therefore,  the<\/p>\n<p>educational   qualifications,  with  certain   relaxations,<\/p>\n<p>prescribed  in  the  scheme are `essential&#8217;  and  the  word<\/p>\n<p>`desirable&#8217;  has to be read as `essential&#8217; for the  purpose<\/p>\n<p>of scheme.\n<\/p>\n<p>(10)  For  the  foregoing  reasons,  we  do  not  find  any<\/p>\n<p>illegality or infirmity in the order passed by the  learned<\/p>\n<p>Single Judge.\n<\/p>\n<p>(11)   The   appeal  deserves  to  be  and  is  accordingly<\/p>\n<p>dismissed.\n<\/p>\n<p>(12) There shall be no orders as to cost.\n<\/p>\n<\/p>\n<pre>     CHIEF JUSTICE                           JUDGE\n\n<\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Chattisgarh High Court Kaushliya Bai vs State Of Chhattisgarh on 20 April, 2009 HIGH COURT OF CHATTISGARH AT BILASPUR Writ Appeal No 104 of 2007 Kaushliya Bai &#8230;Petitioners Versus 1.
