Heard<\/p>\n<p>                       counsel for the State.\n<\/p>\n<p>                                  2. Petitioner at the relevant time served as<\/p>\n<p>                       Nazir of Kiratpur block in Biroul Sub-division of<\/p>\n<p>                       Darbhanga      district.   He    is   found    to    have<\/p>\n<p>                       misappropriated a sum of Rs.2,26,068-67\/- under audit<\/p>\n<p>                       report No.97\/2004-05. He has filed this writ petition<\/p>\n<p>                       for quashing Certificate Case No.15 of 2002-03,<\/p>\n<p>                       Annexure-10 as also for quashing Memo No.636 dated<\/p>\n<p>                       31.03.2003, Annexure-7 whereunder proceeding has<\/p>\n<p>                       been initiated against the petitioner for recovery of a<\/p>\n<p>                       sum of Rs.40,760\/-. Further prayer has been made in<\/p>\n<p>                       the writ petition to quash audit report No.97\/2004-05<\/p>\n<p>                       dated 13.5.2005 submitted in connection with Kiratpur<br \/>\n<span class=\"hidden_text\">                   2<\/span><\/p>\n<p>block for the years 1997-98 till 2002-03 in which<\/p>\n<p>petitioner has been found to have misappropriated a<\/p>\n<p>sum of Rs.2,26,068-67\/- and direction has been made<\/p>\n<p>under letter nos. 5(MU) dated 31.08.2005 Annexure-<\/p>\n<p>14, 219 dated 26.04.2006 Annexure-17 and Memo<\/p>\n<p>No.1785 dated 15.09.2006, Annexure-19 for recovery<\/p>\n<p>of the aforesaid amount which the petitioner deposited<\/p>\n<p>under receipt no.514405 dated 5.9.2006.<\/p>\n<p>           3.   A counter affidavit on behalf of<\/p>\n<p>respondent nos.3 to 7 has been filed in the matter duly<\/p>\n<p>affirmed by the Executive Magistrate, Sadar Sub-<\/p>\n<p>Division, Darbhanga cum Incharge Deputy Collector,<\/p>\n<p>District Legal Cell, Darbhanga. From the said counter<\/p>\n<p>affidavit it, however, does not appear that any finding<\/p>\n<p>either in a departmental or judicial proceeding has been<\/p>\n<p>recorded    against   the   petitioner   that   he   has<\/p>\n<p>misappropriated the amount of Rs.40,760\/-, 2,26,068-<\/p>\n<p>67\/-, as such, until any finding is recorded that<\/p>\n<p>petitioner has misappropriated the aforesaid amount,<\/p>\n<p>such amount could not be recovered from him.<\/p>\n<p>Petitioner in compliance of the directions of the<\/p>\n<p>superior authorities to deposit part of the said amount<\/p>\n<p>has deposited the said amount under Nazir Receipt<br \/>\n<span class=\"hidden_text\">                             3<\/span><\/p>\n<p>          No.514405 dated 5.9.2006.\n<\/p>\n<p>                    4. As the deposit has already been made by<\/p>\n<p>          the petitioner such deposit shall remain with the<\/p>\n<p>          authorities and if petitioner is exonerated of the charge<\/p>\n<p>          of defalcation of the aforesaid amount the amount shall<\/p>\n<p>          be refunded to the petitioner with interest @ 18 % per<\/p>\n<p>          annum. So far validity of the certificate case No.15 of<\/p>\n<p>          2002-03, Annexure-10 is concerned, it is observed that<\/p>\n<p>          petitioner may file objection in the said certificate<\/p>\n<p>          proceeding that the same should not proceed until a<\/p>\n<p>          finding is recorded against him either in departmental<\/p>\n<p>          or judicial proceeding that he has misappropriated a<\/p>\n<p>          sum of Rs.40,760\/-, the said amount cannot be<\/p>\n<p>          recovered from him. It may be observed here that audit<\/p>\n<p>          report only contain statement of facts but the facts<\/p>\n<p>          stated therein are required to be proved either in a<\/p>\n<p>          departmental or judicial proceeding initiated against<\/p>\n<p>          the person against whom facts have been stated in the<\/p>\n<p>          report with reference to materials.
