WJC No.1034 of 2010\n                                        SITA DEVI\n                                           Versus\n                                STATE OF BIHAR &amp; ORS\n                                        -----------\n<\/pre>\n<p>03.   04.10.2010            Petitioner in this case is Sita Devi, who has<\/p>\n<p>                   filed this application for issuance of writ of habeas<\/p>\n<p>                   corpus, commanding the respondent authorities to<\/p>\n<p>                   release her from Remand Home, Gai Ghat, Patna,<\/p>\n<p>                   where she has been put by Order of Chief Judicial<\/p>\n<p>                   Magistrate, Saharsa, dated 30.07.2010 in connection<\/p>\n<p>                   with Sour Bazar P. S. Case No. 153 of 2010. The case<\/p>\n<p>                   has been instituted by the father of the petitioner,<\/p>\n<p>                   alleging offence, under section 366A of the Indian Penal<\/p>\n<p>                   Code.\n<\/p>\n<p>                            Petitioner has admitted in the writ application<\/p>\n<p>                   that her father has solemnized her marriage one year<\/p>\n<p>                   prior to the occurrence with another person, namely,<\/p>\n<p>                   Balbir Ray. Since, it was not the marriage of petitioner&#8217;s<\/p>\n<p>                   choice, she never went to live with that person like<\/p>\n<p>                   husband and wife. The petitioner has solemnized her<\/p>\n<p>                   marriage with one Amarendra Kumar @ Ram Narayan<\/p>\n<p>                   Kumar and left her father&#8217;s house in the company of<\/p>\n<p>                   her husband and went to Punjab. For some time they<\/p>\n<p>                   lived there as husband and wife. Subsequently, on<br \/>\n<span class=\"hidden_text\">                       2<\/span><\/p>\n<p>account of institution of Sour Bazar P. S. Case No. 153<\/p>\n<p>of 2010, she came back to Saharsa, where her husband<\/p>\n<p>was taken into custody and she has been sent to the<\/p>\n<p>Remand        Home        by   the    Chief   Judicial    Magistrate,<\/p>\n<p>Saharsa, by his Order dated 30.07.2010.<\/p>\n<p>           Along with the writ application, the statement<\/p>\n<p>of Sita Devi, recorded under section 164 Cr.P.C. and<\/p>\n<p>the medical report, submitted by the Doctor, as per the<\/p>\n<p>direction of this Court, has been annexed. The age of<\/p>\n<p>the petitioner in her statement, recorded under section<\/p>\n<p>164 Cr.P.C., in the medical evidence as well as the<\/p>\n<p>assessment of the Magistrate, indicates that she is a<\/p>\n<p>major. Medical report also indicates that she is carrying<\/p>\n<p>pregnancy.\n<\/p>\n<p>           All    these        circumstances     are     enough   for<\/p>\n<p>passing an order of release in favour of the petitioner<\/p>\n<p>by   the      Chief       Judicial    Magistrate,      Saharsa,   but<\/p>\n<p>surprisingly, he has passed an Order, whereby the<\/p>\n<p>petitioner has been sent to Remand Home. The reason<\/p>\n<p>assigned is that for security reasons, the petitioner is<\/p>\n<p>being sent to Remand Home.\n<\/p>\n<p>           We do not think that there can be any better<\/p>\n<p>place   for      security      than    the    family     environment,<\/p>\n<p>especially when the petitioner is carrying pregnancy<br \/>\n<span class=\"hidden_text\">                          3<\/span><\/p>\n<p>      and she is not accused in any case.\n<\/p>\n<p>                 Considering all these facts, the order passed<\/p>\n<p>      by   the   Chief   Judicial   Magistrate,   Saharsa,   dated<\/p>\n<p>      30.07.2010, is quashed. A direction is issued for<\/p>\n<p>      releasing the petitioner from Remand Home, Gai Ghat,<\/p>\n<p>      Patna, She can go to the place of her choice from the<\/p>\n<p>      Court itself.
