Rule. Learned<br \/>\n\tadvocates for the respondents waives service of notice of rule. This<br \/>\n\tapplication is taken up for final disposal with the consent of<br \/>\n\tlearned advocates for the parties.\n<\/p>\n<p>This<br \/>\n\tMisc. Civil Application is taken out by the applicant workman for<br \/>\n\treleasing the amount which was originally ordered to be deposited in<br \/>\n\tthis Court by order dated 14\/10\/1998 (Coram: H.L. Gokhale, J (as he<br \/>\n\tthen was). The averments made in this application have not been<br \/>\n\tcontroverted by the respondents. Shri Joshi for the respondent no.1<br \/>\n\thas submitted that there is no objection if the amount mentioned in<br \/>\n\tprayer para no. 6(B) of the application is  permitted to be<br \/>\n\tdisbursed in absence of any evidence to prove gainful employment of<br \/>\n\tthe applicant.\n<\/p>\n<p>In<br \/>\n\tview of lack of any resistance to the prayer, the application stand<br \/>\n\tallowed in terms of para no. 6(B) of the application.  Application<br \/>\n\tstands disposed of. Rule made absolute. No order as to costs.\n<\/p>\n<p>The<br \/>\n\tpayment be made by way of account payee cheque to the applicant<br \/>\n\tconcerned by proper verification. It would be open to the company to<br \/>\n\tdepute their representative who may also help in verifying the<br \/>\n\tapplicant\/claimant.   The office may prepare and keep the cheque<br \/>\n\tready to handover to the applicant in presence of company employee<br \/>\n\tas both the counsels will put up a joint note to the Registry<br \/>\n\tindicating the date for handing over of the cheque.
