Justice V.GIRI\n\n Dated :08\/07\/2008\n\n O R D E R\n                            V.GIRI,J.\n                     -------------------------\n                W.P ( C) No. 20487 of 2008\n                     --------------------------\n               Dated this the 8th July, 2008\n\n                       J U D G M E N T\n<\/pre>\n<p>     Petitioner is aggrieved by Exhibit P1 order of<\/p>\n<p>suspension issued by the District Superintendent of Police<\/p>\n<p>(Rural) Kozhikode. According to the petitioner , the order<\/p>\n<p>of suspension has been passed on incorrect factual<\/p>\n<p>premises. Apparently, the petitioner has been suspended<\/p>\n<p>on the ground that petitioner had refused to accept the<\/p>\n<p>transfer order and misbehaved towards the Duty Officer.<\/p>\n<p>According to the learned counsel for the petitioner, this is<\/p>\n<p>not correct. Petitioner had made a representation to the<\/p>\n<p>Reserve Inspector AR Camp for allowing him 10 days<\/p>\n<p>medical leave with effect from 4.6.2008.<\/p>\n<p>     2.    In my view, petitioner has an efficacious<\/p>\n<p>remedy by way of an appeal against Exhibit P1. He also<\/p>\n<p>has a remedy by way of an application for revocation. But<\/p>\n<p>in the facts and circumstances of the case, it would be<\/p>\n<p>W.P ( C) No. 20487 of 2008<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>appropriate that petitioner files an appeal against Exhibit<\/p>\n<p>P1.\n<\/p>\n<p>     In the result, the writ petition is disposed of<\/p>\n<p>permitting the petitioner to file an appeal against Exhibit<\/p>\n<p>P1 before the competent appellate authority in terms of<\/p>\n<p>Rule 22 of the Kerala Civil Services (classification, control<\/p>\n<p>and appeal) Rules, 1960.
