Justice K.T.SANKARAN\n\n Dated :10\/07\/2008\n\n O R D E R\n                             K.T.SANKARAN, J.\n                     --------------------------------------------\n                     W.P.(C) NO. 20727 OF 2008 P\n                     --------------------------------------------\n                      Dated this the 10th July, 2008\n\n                                 JUDGMENT\n<\/pre>\n<p>       The petitioners are working as Upper Primary School Assistants in<\/p>\n<p>Higher Secondary School, Valayamachirangara, Perumbavoor.                The<\/p>\n<p>allegation of the petitioners is that though the petitioners were entitled to<\/p>\n<p>get regular appointment from 4.6.2007 onwards, instead of appointing<\/p>\n<p>them the Manager appointed respondents 4 to 8. It is stated that the<\/p>\n<p>petitioners have preferential claim for appointment as UPSA. Challenging<\/p>\n<p>the appointment of respondents 4 to 8, the first petitioner filed Ext.P4<\/p>\n<p>appeal and the second petitioner filed Ext.P5 appeal before the District<\/p>\n<p>Educational Officer, Kothamangalam.               Exts.P4 and P5 appeals are<\/p>\n<p>pending disposal.\n<\/p>\n<\/p>\n<p>       2. The reliefs prayed for by the petitioners in the Writ Petition are<\/p>\n<p>the following:\n<\/p>\n<\/p>\n<blockquote><p>        &#8220;a)   Issue a Writ of mandamus or other appropriate Writ<br \/>\n              order or direction commanding the 3rd respondent<br \/>\n              Manager to appoint the petitioners as U.P.S.A from<br \/>\n              4.6.2007 onwards or any other regular vacancy arose<br \/>\n              after the date of the appointment of the petitioners<br \/>\n              from 14.6.2006.<\/p><\/blockquote>\n<p>        b)    Issue a Writ of mandamus or other appropriate Writ<br \/>\n              order or direction commanding the 2nd respondent to<br \/>\n              approve the appointment of the petitioners as<\/p>\n<p>W.P.(C) NO.20727 OF 2008<\/p>\n<p>                                        :: 2 ::\n<\/p>\n<p>               U.P.S.As against a regular post from 4.6.2007 or any<br \/>\n               other regular vacancies arose after the date of<br \/>\n               appointment of the petitioners as U.P.S.As and<br \/>\n               disburse salary and allowances forthwith.<\/p>\n<p>      c)       Direct the 2nd respondent to effectively consider and<br \/>\n               pass appropriate orders upon Ext.P4 &amp; P5 after<br \/>\n               affording an opportunity of being heard to the<br \/>\n               petitioner within a time limit.    In the meantime<br \/>\n               approval of appointment of the respondents 4 to 8<br \/>\n               may be kept in abeyance.\n<\/p>\n<p>      d)       Pass such other order or direction which this Hon&#8217;ble<br \/>\n               Court may deem fit and proper to grant in the<br \/>\n               circumstances of the case.&#8221;\n<\/p>\n<\/p>\n<p>      3. Learned counsel for the petitioners submits that the petitioners<\/p>\n<p>would be satisfied if a direction is issued to dispose of Exts.P4 and P5<\/p>\n<p>appeals expeditiously. In view of the submission, I do not think that it is<\/p>\n<p>necessary to issue notice to respondents 3 to 8 in this Writ Petition<\/p>\n<p>before disposing of the same in the manner indicated below.<\/p>\n<p>      Taking into account the facts and circumstances of the case, the<\/p>\n<p>Writ Petition is disposed of in the following manner:<\/p>\n<p>i)    The District Educational Officer, Kothamangalam is directed to<\/p>\n<p>      dispose of Exts.P4 and P5 appeals filed by petitioners 1 and 2<\/p>\n<p>      respectively, as expeditiously as possible and, at any rate, within a<\/p>\n<p>      period of six weeks from the date of receipt of a copy of this<\/p>\n<p>      judgment. The District Educational Officer shall issue notice to the<\/p>\n<p>      petitioners, the Manager of the School and respondents 4 to 8 and<\/p>\n<p>W.P.(C) NO.20727 OF 2008<\/p>\n<p>                                     :: 3 ::\n<\/p>\n<p>      afford an opportunity of being heard to all of them, before disposing<\/p>\n<p>      of the appeals.\n<\/p>\n<\/p>\n<p>ii)   The petitioners shall produce certified copy of the judgment and a<\/p>\n<p>      copy of the Writ Petition before the District Educational Officer,<\/p>\n<p>      Kothamangalam.\n<\/p>\n<\/p>\n<p>iii)  The petitioners shall send a copy of the judgment to respondents 3<\/p>\n<p>      to 8 separately by registered post and shall produce proof of the<\/p>\n<p>      same before the District Educational Officer, Kothamangalam,<\/p>\n<p>      without delay.\n<\/p>\n<\/p>\n<p>                                                        (K.T.SANKARAN)<br \/>\n                                                               Judge<\/p>\n<p>ahz\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Jinitha A.M. vs The State Of Kerala Represented By &#8230; on 10 July, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 20727 of 2008(P) 1.
