DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 08\/04\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>Rule.\n<\/p>\n<p>\tLearned APP, waives service of notice of Rule for respondent &#8211;<br \/>\n\tState.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the applicant submits that the applicant is a widow aged<br \/>\n\tabout 82 years and she is falsely implicated in the crime.  It is<br \/>\n\tfurther submitted that the applicant has roots in the society, will<br \/>\n\tnot flee from justice and will cooperate with the investigation as<br \/>\n\tand when called for. It is further submitted that by imposing<br \/>\n\tsuitable conditions, the applicant may be granted anticipatory bail.\n<\/p>\n<p>Heard<br \/>\n\tLearned APP for the respondent &#8211; State.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel for the parties and perusing the record of the<br \/>\n\tcase and taking into consideration the facts of the case, nature of<br \/>\n\tallegations, role attributed to the accused, without treating<br \/>\n\tthis order as a precedent for any other co-accused and the<br \/>\n\tapplicant being a widow aged 82 years, I am inclined to grant<br \/>\n\tanticipatory bail to the applicant.    This Court has also taken<br \/>\n\tinto consideration the law laid down by the Apex Court in the case<br \/>\n\tof <a href=\"\/doc\/1108032\/\">Siddharam Satlingappa Mhetre v. State of Maharashtra &amp;<br \/>\n\tOrs. Reported<\/a> in [2011]1 SCC 694, wherein the Apex Court<br \/>\n\treiterated the law laid down by the Constitutional Bench in the case<br \/>\n\tof Shri Gurubaksh Singh Sibbia &amp; Ors. Reported in [1980]2<br \/>\n\tSCC 565.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the parties do not press for further reasoned order.\n<\/p>\n<p>In<br \/>\n\tthe result, this application is allowed by directing that in the<br \/>\n\tevent of the applicant herein being arrested pursuant to Vav M Case<br \/>\n\tNo.08 of 2009 with Vav Police Station for the offences punishable<br \/>\n\tunder sections 120B, 465, 466, 467, 468, 471, 474 of the Indian<br \/>\n\tPenal Code,  the applicant shall be released on bail on furnishing a<br \/>\n\tbond of Rs.10,000\/- (Rupees Ten Thousand only) with one surety of<br \/>\n\tlike amount on following conditions :-\n<\/p>\n<p>[a]\tshall<br \/>\ncooperate with the investigation and make himself \tavailable for<br \/>\ninterrogation whenever required.\n<\/p>\n<p>[b]\tshall<br \/>\nremain present at concerned Police Station on  13.04.2011 between<br \/>\n11:00 am to 2:00 pm:\n<\/p>\n<p>[c]\tshall not<br \/>\nhamper the investigation in any manner nor shall directly or<br \/>\nindirectly make any inducement, threat or promise to any witness so<br \/>\nas to dissuade them from disclosing such facts to the Court or to any<br \/>\nPolice Officer;\n<\/p>\n<p>[d]\tshall at<br \/>\nthe time of execution of bond, furnish the address to the<br \/>\nInvestigating Officer and the Court concerned and shall not change<br \/>\nthe residence till the final disposal of the case or till further<br \/>\norders;\n<\/p>\n<p>[e] \twill not<br \/>\nleave India without the permission of the Court and, if is holding a<br \/>\nPassport, shall surrender the same before the trial Court immediately<\/p>\n<p>[f]\tIt would be<br \/>\nopen to the Investigating Officer to file an application for remand,<br \/>\nif he considers it just and proper and the concerned Magistrate would<br \/>\ndecide it on merits.\n<\/p>\n<p>[g]\tdespite<br \/>\nthis order, it would be open for the Investigating Agency to apply to<br \/>\nthe competent Magistrate, for police remand of the applicant. The<br \/>\napplicant shall remain present before the learned Magistrate on the<br \/>\nfirst date of hearing of such application and on all subsequent<br \/>\noccasions, as may be directed by the learned Magistrate. This would<br \/>\nbe sufficient to treat the accused in the judicial custody for the<br \/>\npurpose of entertaining application of the prosecution for police<br \/>\nremand. This is, however, without prejudice to the right of the<br \/>\naccused to seek stay against an order of remand, if ultimately<br \/>\ngranted, and the power of the learned Magistrate to consider such a<br \/>\nrequest in accordance with law. It is clarified that the applicant,<br \/>\neven if, remanded to the police custody, upon completion of such<br \/>\nperiod of police remand, shall be set free immediately, subject to<br \/>\nother conditions of this anticipatory bail order.\n<\/p>\n<p>\tRule<br \/>\nmade absolute.
