Justice M.SASIDHARAN NAMBIAR\n\n Dated :28\/01\/2009\n\n O R D E R\n                 M.SASIDHARAN NAMBIAR,J.\n\n          ---------------------------------------------------------\n            CRL.R.P.NOS.219\/09, 220\/09,221\/09,\n                    222\/09,223\/09 &amp; 224\/09\n          ---------------------------------------------------------\n\n                   Dated 28th January 2009\n\n\n                              O R D E R\n<\/pre>\n<p>           Revision petitioner is the                        third accused<\/p>\n<p>and first respondent the complainant                      in C.C.23\/2001,<\/p>\n<p>24\/2001, 25\/2001, 5\/2003, 6\/2003 and 7\/2003 on the<\/p>\n<p>file   of     Judicial          First         Class         Magistrate-IV,<\/p>\n<p>Thiruvananthapuram. First respondent is a Government<\/p>\n<p>company and first accused a private limited company.<\/p>\n<p>Third accused and second accused are respectively the<\/p>\n<p>Director and Managing Director of the Company. Company<\/p>\n<p>availed a loan of Rs.One crore from first respondent<\/p>\n<p>agreeing to repay the same with interest. Towards<\/p>\n<p>repayment of the amount Exts.P1, P8, P15,P22, P29 and<\/p>\n<p>P36  cheques            respectively             for       Rs.25,00,000\/-,<\/p>\n<p>25,00,000\/-, 25,00,000\/-, 25,00,000\/-, 15,00,000\/- and<\/p>\n<p>25,00,000\/- were issued drawn in the account of the<\/p>\n<p>company and maintained in Panavila Branch of Federal<\/p>\n<p>Bank. All the cheques were dishonoured. In spite of<\/p>\n<p>the notice issued to the accused as provided under<\/p>\n<p>CRL.R.P.NOS.219\/09, 220\/09,221\/09,<br \/>\n222\/09,223\/09 &amp; 224\/09<br \/>\n<span class=\"hidden_text\">                                        2<\/span><\/p>\n<p>Section 138(b) of Negotiable Instruments Act              they did<\/p>\n<p>not pay.        Alleging        that the three   accused committed<\/p>\n<p>offence under Section 138 of Negotiable Instruments Act ,<\/p>\n<p>complaints were filed which were taken cognizance by the<\/p>\n<p>Magistrate. All the accused pleaded not guilty. All the<\/p>\n<p>accused together defended the case. All of them were<\/p>\n<p>convicted.       They together challenged the conviction and<\/p>\n<p>sentence          before          Additional    Sessions     court,<\/p>\n<p>Thiruvananthapuram              in     Crl.A.Nos.539\/2003,540\/2003,<\/p>\n<p>541\/2003,       542\/2003,        543\/2003  and  544\/2003.  Learned<\/p>\n<p>Additional Sessions Judge             confirmed the conviction and<\/p>\n<p>modified      the     sentence.      Accused  1   and  2  together<\/p>\n<p>challenged the conviction and sentence before this court<\/p>\n<p>in    Crl.R.P.2875\/2008, 2876\/2008,           2881\/2008, 2886\/2008<\/p>\n<p>2887\/2008 and 2890\/2008.              Revision petitioner did not<\/p>\n<p>join the other accused while challenging the conviction<\/p>\n<p>in       those     revision       petitions. As  per  order   dated<\/p>\n<p>18\/11\/2008       revision petitions were disposed confirming<\/p>\n<p>the conviction but modifying the              sentence as against<\/p>\n<p>second accused to a fine of Rs.10,000\/- each and in<\/p>\n<p>default simple imprisonment             for two months in each in<\/p>\n<p>all     the cases.         Third accused now filed the revision<\/p>\n<p>petitions challenging conviction and sentence.<\/p>\n<p>CRL.R.P.NOS.219\/09, 220\/09,221\/09,<br \/>\n222\/09,223\/09 &amp; 224\/09<br \/>\n<span class=\"hidden_text\">                                       3<\/span><\/p>\n<p>       2.     Learned        counsel    appearing   for   revision<\/p>\n<p>petitioner and first respondent were heard.<\/p>\n<p>       3.     Learned       counsel    submitted   that   revision<\/p>\n<p>petitioner was kicked out of the company by the           Managing<\/p>\n<p>Director and proceedings were initiated for realisation<\/p>\n<p>of the amount due from the company against the properties<\/p>\n<p>of the revision petitioner and in such circumstances<\/p>\n<p>sentence may be modified as has been done in the revision<\/p>\n<p>petitions       filed      by    other  accused.  Learned  counsel<\/p>\n<p>appearing       for      first     respondent  pointed  out   that<\/p>\n<p>conviction was already confirmed by this             court in the<\/p>\n<p>revision petitions filed by the            other accused and there<\/p>\n<p>is no reason to interfere with the conviction.<\/p>\n<p>       4.     In view of the confirmation of the conviction<\/p>\n<p>and    modification        of    the  sentence as  against  second<\/p>\n<p>accused      Managing       Director   of   the  company,    while<\/p>\n<p>confirming the conviction revision petitioner is entitled<\/p>\n<p>to get the modification of the sentence as has been done<\/p>\n<p>in the other revisions filed by second accused.<\/p>\n<p>       5.     In such circumstances, all revisions are to be<\/p>\n<p>allowed in part. Conviction of revision petitioner for<\/p>\n<p>the offence under Section 138 of Negotiable Instruments<\/p>\n<p>Act is confirmed.               Sentence as against the revision<\/p>\n<p>CRL.R.P.NOS.219\/09, 220\/09,221\/09,<br \/>\n222\/09,223\/09 &amp; 224\/09<br \/>\n<span class=\"hidden_text\">                                      4<\/span><\/p>\n<p>petitioner in all the cases is modified to a fine of<\/p>\n<p>Rs.10,000\/- each and in default simple imprisonment for<\/p>\n<p>two months in each. On realisation of fine, it is to be<\/p>\n<p>paid to first respondent as compensation           under Section<\/p>\n<p>357(1)(b)       of    Code      of Criminal Procedure.
