     Leave granted.\n<\/p>\n
2.   All the accused-appellants were charged and tried for<\/p>\n
the offences punishable under Sections 447, 504, 302<\/p>\n
read with Section 34 of the Indian Penal Code (IPC) but<\/p>\n
were acquitted of all the charges by the trial court. On<\/p>\n
appeal preferred by the State of Karnataka, the High<\/p>\n
Court reversed the order of acquittal in relation to all the
\n                                                           2<\/span><\/p>\n
appellants and convicted them under Section 304 (Part-II)<\/p>\n
read with Section 34 of the IPC and sentenced them to<\/p>\n
undergo rigorous imprisonment for a period of two years<\/p>\n
and imposed a fine of Rs.30,000\/- each, in default, to<\/p>\n
suffer simple imprisonment for a period of three years.<\/p>\n
Few Relevant Facts:\n<\/p>\n
3.   On 9th September, 1998 at about 6.00 p.m. one<\/p>\n
Shivalingayya lodged a first information report before the<\/p>\n
Sub-Inspector of Yedrami Police Station inter alia alleging<\/p>\n
that his son Sharanaiah was murdered by four persons<\/p>\n
namely Sangappa(A-1), Sharanappa(A-2), Malappa(A-3)<\/p>\n
and Jagadavappa (A-4). It is alleged in the report that on<\/p>\n
the fateful day Shivalingayya and his wife – Boramma<\/p>\n
(PW-1) joined their son Sharanaiah (deceased) in the<\/p>\n
fields to remove the unwanted weeds from their land.<\/p>\n
During that time all the accused persons were passing by<\/p>\n
the side of the complainant’s land along with their bullocks<\/p>\n
and all of a sudden one bullock strayed into their fields<\/p>\n
and started grazing the crops.    The deceased on finding<\/p>\n
that the bullock so entered into the fields asked the
\n                                                            3<\/span><\/p>\n
appellants to ensure that no damages caused to the<\/p>\n
crops. Enraged by the demand so made by the deceased<\/p>\n
all the accused started abusing the deceased. The matter<\/p>\n
did not end there. It is further alleged that Sharanappa<\/p>\n
(A-2) caught hold of the deceased, floored him to the<\/p>\n
ground and gagged his mouth and Sangappa (A-1)<\/p>\n
attacked the deceased with a knife and the other two<\/p>\n
accused     Mallapa   and   Jagadevappa    (A-3     &    A-4)<\/p>\n
respectively hit the deceased on his back and legs with<\/p>\n
stones.   Shivalingayya and his wife (PW-1)       made an<\/p>\n
attempt     to rescue their son but A-2 and A-3 forcefully<\/p>\n
pushed them aside. In the report, it is alleged that all the<\/p>\n
accused trespassed into the fields with the common<\/p>\n
intention of committing murder of the deceased as the<\/p>\n
deceased interfered in a matter concerning some illicit<\/p>\n
relationship between the sister of the accused and one<\/p>\n
Siddanna.\n<\/p>\n
4.   Having received the first information report       PW-11<\/p>\n
registered a case against all the accused on the file of<\/p>\n
Yadrami Police Station for the offences punishable under<\/p>\n
Sections 447, 504, 302 read with Section 34, IPC. The
\n                                                             4<\/span><\/p>\n
next day i.e. 10th September, 1998, PW-11 commenced<\/p>\n
the investigation and completed the formalities including<\/p>\n
recording of the statement of witnesses and handed over<\/p>\n
the case for further investigation by the Circle Inspector<\/p>\n
(PW-12) who also visited the scene of offence and drawn<\/p>\n
panchanama in the presence of two panch witnesses<\/p>\n
(Ex. P4) and seized the several incriminating articles. The<\/p>\n
accused were arrested on 25th September, 1998.<\/p>\n
5.   The learned 1st Additional Sessions Judge, Gulbarga,<\/p>\n
on the basis of the material available on record framed<\/p>\n
charges   against   all   the   accused   for   the   offences<\/p>\n
punishable under Sections 447 and 302 read with Section<\/p>\n
34, IPC. The accused pleaded not guilty and claimed to be<\/p>\n
tried. The Sessions case was transferred to the Fast Track<\/p>\n
Court, Gulbarga for the trial.   The Fast Track Court vide<\/p>\n
judgment and order dated 4th December, 2003 acquitted<\/p>\n
the accused of all the charges framed against them and<\/p>\n
held that the prosecution miserably failed to establish its<\/p>\n
case beyond reasonable doubt.\n<\/p>\n
6.   On appeal preferred by the State of Karnataka<\/p>\n
against the order of acquittal the High Court by the
\n                                                           5<\/span><\/p>\n
impugned order dated 10th June, 2009 reversed the order<\/p>\n
of acquittal and accordingly sentenced all the accused for<\/p>\n
the offence punishable under Section 304 (Part-II) read<\/p>\n
with Section 34, IPC. Be it noted, the High Court did not<\/p>\n
record any finding whatsoever with regard to the charge<\/p>\n
for the offence punishable under Section 447 IPC.<\/p>\n
7.    We have heard learned counsel for the appellants as<\/p>\n
well as the State.\n<\/p>\n
8.   The trial court after an elaborate consideration of the<\/p>\n
matter refused to place any reliance on the evidence of<\/p>\n
PW-1 (Boramma) who is none other than the mother of<\/p>\n
the deceased. The trial court did not discard the evidence<\/p>\n
of PW-1 on the sole ground that she was the interested<\/p>\n
witness. The trial court carefully scrutinised the evidence<\/p>\n
of PW-4 being an interested witness. We do not propose<\/p>\n
to discuss the evidence of PW-1 in detail for the simple<\/p>\n
reason that the High Court did not assign any reason<\/p>\n
whatsoever as to why it had chosen to rely upon the<\/p>\n
evidence   of   PW-1    without    even   discussing    and<\/p>\n
considering the reasons assigned by the trial court in<\/p>\n
paragraphs 13 and 14 of its judgment.      The High Court
\n                                                           6<\/span><\/p>\n
merely observed that the evidence of PW-1 is very natural<\/p>\n
and credible. The High Court in the impugned Judgment<\/p>\n
did not even notice the details of the injuries found on the<\/p>\n
body of the deceased. There is no reason assigned by the<\/p>\n
High Court to set aside the finding of the trial court that<\/p>\n
the very presence of PW-1 at the scene of offence was<\/p>\n
highly doubtful. There is no mention about any recoveries<\/p>\n
in the impugned judgment.\n<\/p>\n
9.   We must express our reservation for the manner in<\/p>\n
which the High Court disposed of the appeal under Section<\/p>\n
378(1) and (3) of Code of Criminal Procedure. It is true<\/p>\n
that in an appeal   from acquittal the High Court has full<\/p>\n
power to re-appreciate and re-assess the entire evidence<\/p>\n
upon which the order of acquittal was founded and then to<\/p>\n
come to its own conclusion. There is no limitation placed<\/p>\n
on that power of the High Court.      The Code makes no<\/p>\n
difference in the power of the appellate court, between<\/p>\n
appeal filed by the State or by other person but the<\/p>\n
appellate court would not be justified merely because it,<\/p>\n
feels that a different view should be taken for reasons<\/p>\n
which are not so strong. This Court repeatedly held that
\n                                                          7<\/span><\/p>\n
the High Court in exercising the power conferred by the<\/p>\n
Code and before reaching its conclusion upon facts, it<\/p>\n
shall give always proper weight and consideration to such<\/p>\n
matters as (1) the view of the trial Judge as to the<\/p>\n
credibility of the witnesses; (2) the presumption of<\/p>\n
innocence in favour of the accused, a presumption<\/p>\n
certainly not weakened by the fact that they have been<\/p>\n
acquitted at trial; (3) the right of the accused to the<\/p>\n
benefit of any doubt.\n<\/p>\n
10. The High Court in the present case did not discuss<\/p>\n
and re-appreciate the evidence of PW-1 who is stated to<\/p>\n
be the only eye witness to the incident but mainly<\/p>\n
observed that “the contents of IR and the evidence of<\/p>\n
PW-1 are very well corroborated by injuries found on the<\/p>\n
dead body noted in the P.M report.” Surely, this is not re-<\/p>\n
appraisal or re-appreciation of the evidence of PW-1. The<\/p>\n
High Court did not even notice the nature of injuries on<\/p>\n
the body of the deceased.    There is no discussion about<\/p>\n
the medical evidence. There is no discussion as to how all<\/p>\n
the accused could be convicted with the aid of Section 34,<\/p>\n
IPC. There is nothing on record suggesting as to the basis
\n                                                          8<\/span><\/p>\n
on which the High Court arrived at conclusion that the<\/p>\n
accused would be guilty of offence under Section 304<\/p>\n
(Part-II) and not for the offence under Section 302 read<\/p>\n
with Section 34, IPC.   This Court in its judgment dated<\/p>\n
May 14, 2007 (Narendra Bhat & Anr. Vs. State of<\/p>\n
Karnataka) while dealing with similar judgment of the<\/p>\n
same High Court observed: “This Court has in a series of<\/p>\n
judgments held that a court exercising appellate power<\/p>\n
must not only consider questions of law but also questions<\/p>\n
of fact and in doing so it must subject the evidence to a<\/p>\n
critical scrutiny. The judgment of the High Court must<\/p>\n
show that the court really applied its mind to the facts of<\/p>\n
the case as particularly when the offence alleged is of a<\/p>\n
serious nature and may attract a heavy punishment. ……<\/p>\n
…..The judgment of the High Court is in three short<\/p>\n
paragraphs.   It leaves much to be desired. No serious<\/p>\n
attempt appears to have been made by the High Court to<\/p>\n
appreciate the evidence on record.” The observations so<\/p>\n
made are equally applicable to the present case and we<\/p>\n
wish to say no more and leave the matter at there.
\n                                                                       9<\/span><\/p>\n
11. In such view of the matter, we set aside the<\/p>\n
impugned judgment and order and remit the matter to the<\/p>\n
High   Court   for   fresh   consideration       and     disposal     in<\/p>\n
accordance with law. It is however, made clear that we<\/p>\n
have not expressed any opinion whatsoever on the merits<\/p>\n
of the case since it is for the High Court to re-appreciate<\/p>\n
the evidence and arrive at its own conclusions.<\/p>\n
12. The appeal is allowed. We have already released the<\/p>\n
appellants on bail. They shall continue to be on bail. We<\/p>\n
request the High Court to dispose of the appeal as<\/p>\n
expeditiously as possible.\n<\/p>\n<\/p>\n
