DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 20\/03\/2009 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>Heard<br \/>\n\tlearned counsels appearing for the parties.\n<\/p>\n<p>This<br \/>\n\tpetition is directed against the order of detention dated 09.11.2008<br \/>\n\tpassed by respondent No.2,<br \/>\n\tin exercise of powers conferred under Section 3(1) \/ 3(2) of the<br \/>\n\tGujarat Prevention of Anti Social Activities Act, 1985 (in short<br \/>\n\tthe Act) by detaining the detenue as a  bootlegger  as defined<br \/>\n\tunder Section 2(b) of the Act.\n<\/p>\n<p>Learned<br \/>\n\tadvocate for the detenue restricted his arguments to the extent of<br \/>\n\torder of detention and submits that registration of FIR\/s itself<br \/>\n\tcannot lead to disturbance of even tempo of public life and<br \/>\n\ttherefore the public order. The order of detention is<br \/>\n\tassailed by the detenue on various grounds mentioned in the memo of<br \/>\n\tthe petition. However, learned counsel for the detenue has focused<br \/>\n\this arguments mainly on the ground that except solitary FIR<br \/>\n\tregistered under the Bombay Prohibition Act, there was no other<br \/>\n\tmaterial before the detaining authority whereby it could be inferred<br \/>\n\treasonably that the detenu is a &#8216;bootlegger&#8217; within the meaning of<br \/>\n\tSection 2(b) of the Act and required to be detained as the detenue&#8217;s<br \/>\n\tactivities are prejudicial to the maintenance of  public health and<br \/>\n\tpublic order. In support of the  above submission, learned counsel<br \/>\n\tfor the detenue has placed reliance on relevant observations made by<br \/>\n\tthe Apex Court in the case of <a href=\"\/doc\/1239835\/\">Piyush<br \/>\n\tKantilal Mehta vs. Commissioner of<\/a> police, AIR 1989 Supreme Court<br \/>\n\t491 and the Judgment and order<br \/>\n\tdated 22.8.2000 of the Division Bench of this Court (Coram: M.R.<br \/>\n\tCalla &amp; R.R. Tripathi, JJ.), in Letters Patent Appeal<br \/>\n\tNo.223 of 2000 in Special Civil Application No.554 of 2000 (Ashok<br \/>\n\tBalabhai Makwana vs. State of Gujarat) which would<br \/>\n\tsquarely help the detenue. Learned advocate for the detenue further<br \/>\n\tsubmits that no affidavit-in-reply is filed by the State Government.<br \/>\n\t In view of the above, subjective satisfaction of the detaining<br \/>\n\tauthority that antisocial activities carried out by the detenue are<br \/>\n\tdetrimental to public order stands vitiated and order of detention<br \/>\n\tbased on such satisfaction deserves to be quashed and set aside.\n<\/p>\n<p>Learned<br \/>\n\tAssistant Government Pleader submitted that registration of solitary<br \/>\n\tcomplaint would go to show that the detenue had, in fact, indulged<br \/>\n\tinto such activities, which can be said to be disturbing the public<br \/>\n\thealth and public order.  Learned Assistant Government Pleader<br \/>\n\tfurther submitted that there was sufficient material before the<br \/>\n\tdetaining authority to pass the order of detention and no<br \/>\n\tinterference is called for by this Court in exercise of its power<br \/>\n\tunder Article 226 of the Constitution of India.\n<\/p>\n<p>Having<br \/>\n\theard the rival submissions of the parties and perused the record of<br \/>\n\tthe case, I am of the view that solitary complaint registered under<br \/>\n\tthe Bombay Prohibition Act alone cannot be said to be sufficient<br \/>\n\tenough to arrive at subjective satisfaction to the effect that the<br \/>\n\tactivities, as alleged, are prejudicial to the public order. The<br \/>\n\tregistration of FIR\/s under Bombay Prohibition Act ipso facto does<br \/>\n\tnot lead to disturbance of public order. There has to be nexus and<br \/>\n\tlink for such activities with disturbance of the public order. The<br \/>\n\tactivities of the detenue must, in the backdrop of the facts,<br \/>\n\treflect that such activities disturbed or likelihood of disturbing<br \/>\n\tthe tempo of normal life of society or general peace and<br \/>\n\ttranquility or create a sense of alarm and insecurity in the<br \/>\n\tlocality.\n<\/p>\n<p>On<br \/>\n\tcareful perusal of the material available on record and the ratio<br \/>\n\tlaid down by the Apex Court in the case of Piyush Kantilal Mehta<br \/>\n\t(supra) and the Judgment and order<br \/>\n\tdated 22.8.2000 of the Division Bench of this Court (Coram: M.R.<br \/>\n\tCalla &amp; R.R. Tripathi, JJ.), in Letters Patent Appeal No.223 of<br \/>\n\t2000 in Special Civil Application No.554 of 2000 (Ashok Balabhai<br \/>\n\tMakwana vs. State of Gujarat), I am of the view that the<br \/>\n\tactivities of the detenue cannot be said to be in any manner<br \/>\n\tprejudicial to the public order and therefore, the order of<br \/>\n\tdetention  passed by the detaining authority cannot be sustained and<br \/>\n\tis required to be quashed and set aside.\n<\/p>\n<p>In<br \/>\n\tthe result, the petition is allowed. The order of detention dated<br \/>\n\t09.11.2008 passed by the respondent<br \/>\n\tNo.2 is quashed and set aside. The detenue, is ordered to be<br \/>\n\tset at liberty forthwith if he is not  required in connection with<br \/>\n\tany other case. Rule is made absolute accordingly.
