Surat.\n<\/p>\n<p>B)\tDuring the<br \/>\npendency and disposal of this petition Your Lordships may be pleased<br \/>\nto direct the Respondents to maintain status-quo in respect of old<br \/>\ntenure land having Block No.452, bearing Survey No.470 and account<br \/>\nno. 285, admeasuring Hectare 1-44-68 Sq. Mtr. Situated at Village<br \/>\nPal, Tal &amp; Dist. : Surat<\/p>\n<p>C)\tYOUR LORDSHIPS<br \/>\nbe pleased to pass any other and further order as may be deemed fit<br \/>\nin favour of the petitioners.??\n<\/p>\n<p>2.\t\tIt<br \/>\nis the case of the petitioners that they were holding agricultural<br \/>\nlands in Village Pal, District Surat. Such lands were old tenure<br \/>\nlands. While preparing Town Planning Scheme No.16(Pal), the said<br \/>\nlands have been given original plot No.29 and ultimately, final plot<br \/>\nNos. 58, 34, 60 have been given to such lands along with other<br \/>\nadjoining owners without demarcating the lands internally. It is also<br \/>\nthe case of the petitioners that the other land owners, owned the new<br \/>\ntenure lands, whereas, the land of the petitioners was an old tenure<br \/>\nland. Petitioners are, therefore, making grievance also about the<br \/>\ndirections for payment of premium.\n<\/p>\n<p>3.\t\tIn<br \/>\nresponse to the notice issued by this Court, learned AGP, Shri<br \/>\nJ.K.Shah, appearing for the Government, drew my attention to a<br \/>\ncommunication dated 13th August, 2007. It is stated<br \/>\ninter-alia that the land is alloted in proportion of the holding of<br \/>\nthe individual owners. He submitted that if the petitioners have any<br \/>\ngrievance about the same, they should point out before the Government<br \/>\ntheir grievances along with necessary material in support of their<br \/>\ncontentions.\n<\/p>\n<p>4.\t\tIf<br \/>\nthe petitioners are justified in contending that they were holding<br \/>\nold tenure lands whereas in the town planning scheme, they have been<br \/>\nalloted land along with other land owners, who are holding new tenure<br \/>\nlands, the request for permitting demarcation, etc. would be<br \/>\njustified. However, without concluding this issue petitioners are<br \/>\npermitted to point out all these aspects by making a representation,<br \/>\nwhich may be made within two weeks from today. If such a<br \/>\nrepresentation is made within the time permitted, the competent<br \/>\nauthority in the Government shall consider and  decide the same in<br \/>\naccordance with law and suitably reply to the petitioner and take<br \/>\nappropriate consequential steps as may be found necessary at the time<br \/>\nof approving the town planning scheme.\n<\/p>\n<p>5.\t\tPetition<br \/>\nis disposed of at this stage.
