In separate petitions<br \/>\n\the has challenged  similar order passed by the trial Court refusing<br \/>\n\tto discharge for offences punishable under Sections 409, 467, 468,<br \/>\n\t471, 201 read with Section 114 of the IPC.\n<\/p>\n<p>Facts<br \/>\n\temerging from Special Criminal Application No. 481\/2004 may be<br \/>\n\tnoticed. Petitioner was at the relevant time working as Office<br \/>\n\tSuperintendent in NL General Hospital, Patan. In the said<br \/>\n\torganisation, it was noticed that with respect to some six staff<br \/>\n\tmembers, some of the co-employees had played mischief and six<br \/>\n\tdifferent bills were prepared withdrawing amounts from the Provident<br \/>\n\tFund accounts of such employees. Such amounts were misappropriated<br \/>\n\tfor which the petitioner and other co-employees were charge-sheeted.<br \/>\n\tIt is the case of the petitioner that he had no direct role to play<br \/>\n\tin the entire scandal. The notes and office submissions were<br \/>\n\tprepared by lower staff, verified by account staff and only finally<br \/>\n\tafter due verification at several levels, it was approved by his<br \/>\n\tsuperior officer i.e. Civil Surgeon of the Hospital. He had no<br \/>\n\tdirect role to play. He has not committed any offence. There is no<br \/>\n\tevidence to link him with the said offence.\n<\/p>\n<p>Before<br \/>\n\tthe trial Court, when he filed discharge application, same came to<br \/>\n\tbe dismissed by impugned order dated 6.10.1997 observing inter-alia<br \/>\n\tthat whenever such allegations are made, ordinarily head of the<br \/>\n\toffice has to bear full responsibility. The petitioner has<br \/>\n\tindirectly helped in destroying or concealing the record. Learned<br \/>\n\tJudge therefore, found that no case for discharge is made out.<br \/>\n\tConsequently, he proceeded to frame the charges on 10.10.2003 in<br \/>\n\twhich  it is alleged that all the accused while discharging duties<br \/>\n\tat the Government hospital, Patan had by creating false signatures<br \/>\n\tof other employees and withdrawing Rs. 5400\/- from the account, had<br \/>\n\tmisappropriated said sum, thereby committed offences punishable<br \/>\n\tunder Sections 409, 467, 468, 471, 201 read with Section 114 of the<br \/>\n\tIPC.\n<\/p>\n<p>Upon<br \/>\n\thearing the learned advocate for the petitioner and learned APP for<br \/>\n\tthe State and having perused the documents on record, I find that<br \/>\n\tnone of the witnesses have made any direct reference to the role of<br \/>\n\tthe petitioner. In such cases, eyewitness accounts are unlikely to<br \/>\n\tbe available. Nevertheless, there has to be some evidence to proceed<br \/>\n\tfurther against the petitioner. Petitioner was only office<br \/>\n\tsuperintendent. He was  neither in accounts section nor was<br \/>\n\tsanctioning authority. Additionally, learned APP has taken me<br \/>\n\tthrough the report of the FSL in which also involvement of the<br \/>\n\tpetitioner in fabricating the signatures is not forthcoming. I am<br \/>\n\ttherefore, of the opinion that even if the trial is permitted<br \/>\n\tagainst the petitioner, there is no possibility of conviction in<br \/>\n\tabsence of sufficient evidence. He is required to be and is hereby<br \/>\n\tdischarged. All orders are quashed.\n<\/p>\n<p>Revision<br \/>\n\tapplications are disposed of accordingly.
