JUSTICE SABINA\n\n\nPresent:   Mr. R.K.Kakkar, Advocate,\n           for the appellant.\n\n                 ****\n\nSABINA, J.\n<\/pre>\n<p>           Plaintiff Jasbir Singh filed a suit for permanent injunction,<\/p>\n<p>which was dismissed by the Civil Judge (Jr.Divn.) Ferozepur vide<\/p>\n<p>judgment and decree dated 10.3.2007. In appeal, the said judgment<\/p>\n<p>and decree were upheld by the Additional District Judge, Ferozepur<\/p>\n<p>vide judgment and decree dated 16.4.2008.         Hence, the present<\/p>\n<p>appeal.\n<\/p>\n<p>           Brief facts of the case, as noticed by the lower appellate<\/p>\n<p>Court in para Nos. 2 and 3 of its judgment, are as under:-<br \/>\n<span class=\"hidden_text\"> R.S.A.No. 3049 of 2008 (O&amp;M)                                   2<\/span><\/p>\n<blockquote><p>          &#8220;2.        The bone of contention in this case is land<\/p>\n<p>          measuring 90 kanals 17 marlas, fully detailed and<\/p>\n<p>          described in the head note of the plaint. The said land is<\/p>\n<p>          the ownership of Provincial Government and is stated to<\/p>\n<p>          be in possession of the appellant\/plaintiff.         Khasra<\/p>\n<p>          Girdawari has also been corrected in his name by AC-II,<\/p>\n<p>          Ferozepur in the year 2002. His possession over the suit<\/p>\n<p>          land is continuous, peaceful and uninterrupted and he<\/p>\n<p>          had   deposited   Rs.11,550\/-    as   Lagan\/Rent     in   the<\/p>\n<p>          Government Treasury vide receipt dated 19.7.2004.<\/p>\n<p>          According to the appellant\/plaintiff, defendant No.1 has<\/p>\n<p>          got no right or interest in the suit land, but he threatened<\/p>\n<p>          to dispossess him from the suit land, hence, the<\/p>\n<p>          appellant\/plaintiff filed this suit for permanent injunction<\/p>\n<p>          for restraining the defendant from interfering in his<\/p>\n<p>          possession over the suit land.\n<\/p><\/blockquote>\n<blockquote><p>          3. Upon notice, the respondents\/defendants appeared<\/p>\n<p>            and filed written statement wherein they denied<\/p>\n<p>            possession of the appellant\/plaintiff over the disputed<\/p>\n<p>            land and have alleged that rather BSF has been in<\/p>\n<p>            possession over 193.5 acres of land including the suit<\/p>\n<p>            land since the year 1967 as lessee and they have paid lease<\/p>\n<p>            money to the Provincial Government. Further objections<\/p>\n<p>            taken against the suit were that the plaintiff has<br \/>\n<span class=\"hidden_text\"> R.S.A.No. 3049 of 2008 (O&amp;M)                                         3<\/span><\/p>\n<p>                 no cause of action to file the suit; the suit is bad for non<\/p>\n<p>                 joining of necessary parties and non service of notice<\/p>\n<p>                 under Section 80 CPC.&#8221;<\/p><\/blockquote>\n<p>           On the pleadings of the parties, following issues were<\/p>\n<p>framed by the trial Court:-\n<\/p>\n<\/p>\n<blockquote><p>            &#8220;1.           Whether the plaintiff is entitled to injunction as<\/p>\n<p>            prayed for? OPP<\/p>\n<\/blockquote>\n<blockquote><p>            2.            Whether the plaintiff is in actual physical and<\/p>\n<p>            legal possession of the suit land? OPP<\/p>\n<\/blockquote>\n<blockquote><p>            3.            If issue No.2 is proved, then whether the<\/p>\n<p>            defendants are interfering into the possession of the<\/p>\n<p>            plaintiff? OPP<\/p>\n<\/blockquote>\n<blockquote><p>            4.            Whether Rapat dated 22.10.2000 made by the<\/p>\n<p>            Assistant Collector Grade II vide which the khasra<\/p>\n<p>            girdawari were corrected in the name of the plaintiff is<\/p>\n<p>            legal and valid? OPP<\/p>\n<\/blockquote>\n<blockquote><p>            5.            Whether the suit filed by the plaintiff is bad<\/p>\n<p>            due to not impleading of necessary parties? OPD<\/p>\n<\/blockquote>\n<blockquote><p>            6.            Whether suit filed by the plaintiff is bad for<\/p>\n<p>            non serving of the notice under Section 80 CPC ? OPD<\/p>\n<\/blockquote>\n<blockquote><p>           7.             Relief. &#8220;<\/p><\/blockquote>\n<p>\n<span class=\"hidden_text\"> R.S.A.No. 3049 of 2008 (O&amp;M)                                    4<\/span><\/p>\n<p>           After hearing learned counsel for the appellant, I am of<\/p>\n<p>the opinion that the present appeal deserves to be dismissed.<\/p>\n<p>           Admittedly, Provincial Government is the owner of the suit<\/p>\n<p>land. Plaintiff as well as defendants claim possession over the suit<\/p>\n<p>land. As per the revenue record i.e. copy of the jamabandi for the<\/p>\n<p>year 1999-2000 (shown during the course of arguments by learned<\/p>\n<p>counsel for the appellant), Border Security Force is reflected to be in<\/p>\n<p>possession of the suit land. A perusal of the khasra girdawari Ex.P-2<\/p>\n<p>(shown during the course of arguments by learned counsel for the<\/p>\n<p>appellant) reveals that possession of the plaintiff is reflected on the<\/p>\n<p>basis of order dated 22.10.2000. However, the said order was not<\/p>\n<p>placed on record.\n<\/p>\n<p>           Learned Additional District Judge in the impugned<\/p>\n<p>judgment has observed that the respondents had placed on record<\/p>\n<p>Rapat No.267 dated 4.3.2005 as per which, the entry in the khasra<\/p>\n<p>girdawari had been changed in the name of the plaintiff. Thus, the<\/p>\n<p>alleged correction was made during the pendency of the suit and the<\/p>\n<p>same could not be taken in consideration. The entry in the jamabandi<\/p>\n<p>regarding possession is in favour of the Border Security Force. The<\/p>\n<p>plaintiff, in these circumstances, was required to establish as to how<\/p>\n<p>he came in possession of the suit land and in what capacity. In the<\/p>\n<p>absence of the said evidence the Courts below had rightly held that<\/p>\n<p>the plaintiff had failed   to establish his possession over the suit<br \/>\n<span class=\"hidden_text\"> R.S.A.No. 3049 of 2008 (O&amp;M)                                    5<\/span><\/p>\n<p>property in dispute. The finding of the fact arrived at by the both the<\/p>\n<p>Courts below in this regard calls for no interference by this Court in<\/p>\n<p>appeal.\n<\/p>\n<p>           No substantial question of law arises in this regular<\/p>\n<p>second appeal.
