On earlier occasion,<br \/>\nwith a view to giving another opportunity to the respondent, the<br \/>\npetitioner was directed to serve the process to the respondent, since<br \/>\non earlier occasion the postal authority had returned the cover<br \/>\nwithout any remarks thereon. She has also submitted that the<br \/>\npetitioner served the process on the Director of the respondent<br \/>\ncompany who accepted the same and affidavit of service has been filed<br \/>\nby the petitioner.\n<\/p>\n<p>2.\tDespite the service<br \/>\nof process, the respondent has not entered appearance. She has<br \/>\nfurther submitted that even the statutory notice was not responded.<br \/>\nThe claim of the petitioner company is for more than five lacs of<br \/>\nrupees and any explanation for not making the payment has not come<br \/>\nforth from the respondent. Under the circumstances, the Court is<br \/>\ninclined to admit the petition. However, with a view to affording<br \/>\nlast chance to the respondent, petition is adjourned to 2nd<br \/>\nAugust 2011 with a clarification that if respondent does not enter<br \/>\nappearance and\/or does not make the payment or offer explanation as<br \/>\nregards the non-payment, the Court may, after hearing the petitioner,<br \/>\nadmit the petition and direct publication of advertisement. In the<br \/>\nmeanwhile, considering the fact that despite service of notice,<br \/>\nappearance has not been entered and statutory notice has not been<br \/>\nresponded by the respondent, it appears appropriate to restrain the<br \/>\nrespondent from alienating any of the properties of the company or<br \/>\ncreating any charge over the properties, until the next date of<br \/>\nhearing. Therefore, relief in terms of para 19(c) is granted which<br \/>\nwill enure until the next date of hearing.
