Ext.P5 is an order enhancing the maintenance to<\/p>\n<p>Rs.3000\/= per month, in an application filed by the wife under<\/p>\n<p>Section 127 of Code of Criminal Procedure, after declaring the<\/p>\n<p>petitioner ex parte.     Subsequently, the petitioner preferred an<\/p>\n<p>application to set aside the ex-parte order. But then also, neither<\/p>\n<p>the petitioner nor his counsel appeared, and, therefore, that<\/p>\n<p>petition was also dismissed for default, as evidenced by Ext.P6<\/p>\n<p>order. The petitioner thereafter did not seek to review or to set<\/p>\n<p>aside that order, and thus Exts.P5 and P6 orders have become<\/p>\n<p>final.\n<\/p>\n<\/p>\n<p>              2.   Sri.T.Rajasekharan Nair, the learned counsel<\/p>\n<p>appearing on behalf of the petitioner, contended that non-<\/p>\n<p>W.P.(C) No.2450 of 2009<\/p>\n<p><span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>appearance of the counsel on the appointed day, when Ext.P6<\/p>\n<p>order was passed, might be due to the fact that he would have<\/p>\n<p>been appearing in some other court. We cannot set aside an<\/p>\n<p>order on presumptions.         Good grounds must be shown as<\/p>\n<p>explanation for non-appearance.          Nothing prevented the<\/p>\n<p>petitioner or his counsel from filing a petition seeking a review or<\/p>\n<p>to restore the order, and no steps were taken before the court<\/p>\n<p>below in this regard. Even before this Court also, no affidavit or<\/p>\n<p>no reasons are stated to warrant an interference in Ext.P6 order.<\/p>\n<p>We are not in a position to go on to the merits of Ext.P5 order,<\/p>\n<p>because the only evidence was that of the petitioner, the<\/p>\n<p>respondent herein, seeking enhancement of maintenance. The<\/p>\n<p>petitioner also remained absent. In such circumstances, we<\/p>\n<p>cannot find fault with the court below in granting enhanced<\/p>\n<p>maintenance.\n<\/p>\n<\/p>\n<p>                3.     According to the petitioner, the wife got<\/p>\n<p>remarried and hence she is not entitled to receive any<\/p>\n<p>maintenance. If the remarriage is subsequent to Ext.P5 order,<\/p>\n<p>W.P.(C) No.2450 of 2009<\/p>\n<p><span class=\"hidden_text\">                                3<\/span><\/p>\n<p>necessarily, based on the change of circumstances, the petitioner<\/p>\n<p>can still apply to the Family Court for necessary modifications. In<\/p>\n<p>such circumstances, we dismiss the writ petition.
