No.1931 of 2009 is heard<\/p>\n<p>                    first.\n<\/p>\n<p>                                 This application has been filed by the appellant<\/p>\n<p>                    for recall of the order dated 15.07.2008 passed by this<\/p>\n<p>                    Court.   The learned counsel for the appellant submitted<\/p>\n<p>                    that on that date, the name of the learned counsel, Mr.<\/p>\n<p>                    Vinay Kirti Singh was not appearing in the cause list and,<\/p>\n<p>                    therefore, the same could not be marked.                     In such<\/p>\n<p>                    circumstances, this Court ordered that the appeal has<\/p>\n<p>                    abated as against the respondent no.1.                 Although, the<\/p>\n<p>                    substitution application being I.A. No.1552 of 2007 has<\/p>\n<p>                    already been filed and there was prayer for setting aside<\/p>\n<p>                    abatement also in the said application.               Considering the<\/p>\n<p>                    above facts and circumstances of the case, the order dated<\/p>\n<p>                    15.07.2008 is recalled.\n<\/p>\n<p>                                 So far item no.2 i.e. I.A. No.1552 of 2007 and<\/p>\n<p>                    I.A. No.1930 of 2009 are concerned, those are substitution<\/p>\n<p>                    applications and application for condoning the delay.<\/p>\n<p>                                 Heard the learned counsel for the appellant<\/p>\n<p>                    and the learned counsel appearing on behalf of the<\/p>\n<p>                    respondent     nos.3     and      5    on      these    Interlocutory<br \/>\n<span class=\"hidden_text\">                        2<\/span><\/p>\n<p>Applications.    In spite of service of notice in substitution<\/p>\n<p>matter on the proposed legal representatives of the<\/p>\n<p>deceased respondent no.1, they have not appeared.<\/p>\n<p>According to the learned counsel for the appellant, the<\/p>\n<p>appellant had no knowledge about the death of the<\/p>\n<p>respondent no.1 because the appellant resides at Panipat.<\/p>\n<p>When he came to know about the death, he filed the<\/p>\n<p>application, therefore, there is delay of about 2 years.<\/p>\n<p>              Considering      the        submission           and      the<\/p>\n<p>explanation given in the limitation application, I am<\/p>\n<p>satisfied that the appellant was prevented by sufficient<\/p>\n<p>cause from not filing the substitution application within<\/p>\n<p>time.   Therefore,     the   delay   in     filing    the     substitution<\/p>\n<p>application is condoned, abatement is set aside and the<\/p>\n<p>legal representatives of the deceased respondent no.1 are<\/p>\n<p>substituted in place of the deceased respondent no.1 after<\/p>\n<p>deleting his name.\n<\/p>\n<p>              It is submitted that the respondent no.1 has<\/p>\n<p>already sold the entire property to this appellant and<\/p>\n<p>others and, therefore, it appears that he has got no<\/p>\n<p>interest.    It further appears that in spite of service of<\/p>\n<p>notice in substitution matter, they have not appeared.<\/p>\n<p>Therefore, no notice is required to be sent on them again<\/p>\n<p>in appeal.\n<\/p>\n<p>              So far item no.1 i.e. I.A. No.4006 of 2009 is<\/p>\n<p>concerned,      this   application   has      been         filed   by   the<\/p>\n<p>interveners     mentioned     in   detail    in      the    Interlocutory<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>          Application for being added as party-respondents in this<\/p>\n<p>          appeal on the ground that they have purchased part of the<\/p>\n<p>          suit property from the son of the deceased respondent<\/p>\n<p>          no.1 and, therefore, it is prayed that they may be added as<\/p>\n<p>          party in this appeal.       The learned counsel for the<\/p>\n<p>          interveners submitted that after selling the property, the<\/p>\n<p>          son and other legal representatives of the deceased<\/p>\n<p>          respondent no.1 are not taking interest in defending the<\/p>\n<p>          appeal and, therefore, if the interveners are not added as<\/p>\n<p>          party-respondents, they shall suffer serious loss.<\/p>\n<p>                      Considering the above facts and circumstances<\/p>\n<p>          of the case, the interveners as mentioned in detail in I.A.<\/p>\n<p>          No.4006 of 2009 are added as party-respondents in this<\/p>\n<p>          appeal. Thus, I.A.
