Justice V.K.MOHANAN\n\n Dated :15\/07\/2010\n\n O R D E R\n                   V.K.MOHANAN, J.\n                   ~~~~~~~~~~~~~\n                Crl.R.P.No.2097 of 2010\n               ~~~~~~~~~~~~~~~~~\n          Dated this the 15th day of July 2010\n\n\n                        O R D E R\n<\/pre>\n<p>    The accused in a prosecution for an offence u\/s.138 of<\/p>\n<p>the Negotiable Instruments Act is the revision petitioner, as<\/p>\n<p>she is aggrieved by the order of conviction and sentence<\/p>\n<p>imposed by the courts below.\n<\/p>\n<p>     2.  The case of the complainant is that the husband of<\/p>\n<p>the accused was a subscriber in the chitty conducted by the<\/p>\n<p>complainant company.      The chitty prize amount was<\/p>\n<p>Rs.75,000\/- and the chitty was prized in favour of him and<\/p>\n<p>towards the discharge of the liability due to the company<\/p>\n<p>out of the chitty transaction, the accused, being the<\/p>\n<p>guarantor in the said transaction, issued a cheque dated<\/p>\n<p>3.1.2008 for an amount of Rs.79,710\/-, which when<\/p>\n<p>presented for encashment dishonoured for want of<\/p>\n<p>Crl.R.P.No.2097 of 2010<\/p>\n<p><span class=\"hidden_text\">                             -: 2 :-<\/span><\/p>\n<p>sufficient fund in the account maintained by the accused<\/p>\n<p>and the cheque amount was not repaid in spite of a formal<\/p>\n<p>demand notice and thus the revision petitioner has<\/p>\n<p>committed the offence punishable u\/s.138 of the Negotiable<\/p>\n<p>Instruments Act. With the said allegation, the complainant<\/p>\n<p>approached the Judicial Magistrate of First Class-II,<\/p>\n<p>Thodupuzha by filing a formal complaint, upon which<\/p>\n<p>cognizance was taken u\/s.138 of the Negotiable Instruments<\/p>\n<p>Act and instituted S.T.No.94\/2008. During the course of the<\/p>\n<p>trial, Pws.1 &amp; 2 were examined and produced Exts.P1 to<\/p>\n<p>P10     documentary     evidences   from the side  of   the<\/p>\n<p>complainant. No evidence either oral or documentary<\/p>\n<p>adduced from the side of the defence. On the basis of the<\/p>\n<p>available materials and evidence on record, the trial court<\/p>\n<p>has found that the cheque in question was issued by the<\/p>\n<p>revision petitioner\/accused for the purpose of discharging<\/p>\n<p>her debt due to the complainant. Thus accordingly the court<\/p>\n<p>held that, the complainant has established the case against<\/p>\n<p>Crl.R.P.No.2097 of 2010<\/p>\n<p><span class=\"hidden_text\">                              -: 3 :-<\/span><\/p>\n<p>the accused\/revision petitioner and consequently found that<\/p>\n<p>the accused is guilty and thus convicted her u\/s.138 of the<\/p>\n<p>Negotiable Instruments Act. On such conviction, the trial<\/p>\n<p>court sentenced the revision petitioner\/accused to undergo<\/p>\n<p>simple imprisonment till the rising of the court and to pay<\/p>\n<p>compensation of Rs.82,000\/- to the complainant under<\/p>\n<p>Sec.357(3) of Cr.P.C. and the default sentence is fixed as 3<\/p>\n<p>months simple imprisonment.\n<\/p>\n<p>      3.    Though      an   appeal   was    filed  by    the<\/p>\n<p>accused\/revision petitioner challenging the above conviction<\/p>\n<p>and     sentence,      by  judgment    dated   27.2.2010   in<\/p>\n<p>Crl.A.No.193\/2009,       the court    of IInd   Addl.Sessions<\/p>\n<p>Judge\/Special Judge for NDPS Act cases, Thodupuzha<\/p>\n<p>allowed the appeal only in part and thus, while confirming<\/p>\n<p>the conviction and sentence ordered by the trial court, the<\/p>\n<p>appellate court modified the compensation and reduced the<\/p>\n<p>amount equal to the cheque amount ie; Rs.79,10\/- and the<\/p>\n<p>default sentence is fixed as 3 months. It is the above orders<\/p>\n<p>Crl.R.P.No.2097 of 2010<\/p>\n<p><span class=\"hidden_text\">                               -: 4 :-<\/span><\/p>\n<p>are challenged in this revision petition.<\/p>\n<p>      4.    I have heard the learned counsel appearing for<\/p>\n<p>the revision petitioner and also perused the judgments of<\/p>\n<p>the courts below.\n<\/p>\n<p>      5.    The learned counsel for the revision petitioner<\/p>\n<p>submitted that a breathing time may be granted to the<\/p>\n<p>revision petitioner to pay the compensation amount and also<\/p>\n<p>allow her to pay the compensation amount directly to the<\/p>\n<p>complainant.\n<\/p>\n<p>      6.    Having regard to the facts and circumstances<\/p>\n<p>involved in the case, I am of the view that the said<\/p>\n<p>submission can be considered favourably<\/p>\n<p>            In the result, this revision petition is disposed of<\/p>\n<p>confirming the conviction as recorded by the courts below<\/p>\n<p>against the revision petitioner under Sec.138 of the N.I.Act<\/p>\n<p>and while confirming the sentence of imprisonment and<\/p>\n<p>order of compensation as ordered by the lower appellate<\/p>\n<p>court, the revision petitioner is granted 3 months time to<\/p>\n<p>Crl.R.P.No.2097 of 2010<\/p>\n<p><span class=\"hidden_text\">                             -: 5 :-<\/span><\/p>\n<p>pay the compensation and she is free to pay the<\/p>\n<p>compensation amount either directly to the complainant or<\/p>\n<p>by remitting the same in the trial court whichever subject to<\/p>\n<p>the satisfaction of the learned Magistrate. Accordingly, the<\/p>\n<p>revision petitioner is directed to appear before the trial<\/p>\n<p>court on 15th October, 2010 to receive the sentence and to<\/p>\n<p>pay the compensation amount.
