Singh, Public Information Officer &amp; Deputy Director;<br \/>\nThe PIO has provided the information on 11\/05\/2009. The Appellant states, whereas Ms. Madhu<br \/>\nYadav is shown as a junior faculty for computers, her name is not in the time table but the name of Ms.<br \/>\nKavita is there. Therefore the copy of the certificate of Ms. Kavita must be provided to the Appellant.<br \/>\nThe appellant states that there are discrepancies in the result sheet as well which have been pointed out<br \/>\nto the PIO. The Appellant alleges that the records given to him show clear evidence that people who<br \/>\nwere supposed to take the classes have not taken them.\n<\/p>\n<p>The PIO is directed to enquire into this matter and look at the anomalies pointed out by the Appellant<br \/>\nand give a report to the Appellant and the Commission. The PIO is also asked to provide the copies of<br \/>\nthe relevant orders for number of classes to be taken by the Principal. The PIO was asked the reason<br \/>\nfor delay in providing the information. The PIO states that the delay was because the deemed PIO Mr.<br \/>\nJagdish Prasad, Principal, GBSSS, Samalka took 59 days to send the reply.\n<\/p>\n<p>Decision:\n<\/p>\n<p>The Appeal is allowed.\n<\/p>\n<p>The PIO is directed to provide the information and the report as directed above to the Appellant and<br \/>\nthe Commission before 30 November 2009.\n<\/p>\n<p>The issue before the Commission is of not supplying the complete, required information by the<br \/>\nPIO within 30 days as required by the law.\n<\/p>\n<p>From the facts before the Commission it is apparent that the deemed PIO Mr. Jagdish Prasad is guilty<br \/>\nof not furnishing information within the time specified under sub-section (1) of Section 7 by not<br \/>\nreplying within 30 days, as per the requirement of the RTI Act.\n<\/p>\n<p>It appears that the PIO&#8217;s actions attract the penal provisions of Section 20 (1). A showcause notice is<br \/>\nbeing issued to him, and he is directed give his reasons to the Commission to show cause why penalty<br \/>\nshould not be levied on him.\n<\/p>\n<p>He will present himself before the Commission at the above address on 19 November 2009 at 2.30pm<br \/>\nalongwith his written submissions showing cause why penalty should not be imposed on him as<br \/>\nmandated under Section 20 (1).
