              The challenge in the present writ petition is to the<\/p>\n
communication dated 1.4.2005 (Annexure P.6), whereby, the<\/p>\n
representation    of   the    petitioner    for   adjustment     in   the<\/p>\n
alternative    post    with    the     respondent-Corporation         was<\/p>\n
declined.\n<\/p>\n
              The petitioner while working with the Panipat<\/p>\n
Woolen Mills, respondent No.3, was promoted as Supervisor<\/p>\n
on 11.12.1987. On 21.11.2003, a circular was issued and the<\/p>\n
employees, such as the petitioners were given option to seek<\/p>\n
voluntary retirement. The offer of the petitioner to seek<\/p>\n
voluntary retirement was received on 20.12.2003 and in<\/p>\n
pursuance of such communication, the petitioner was ordered<\/p>\n
to be retired voluntarily vide order dated 19.2.2004 (Annexure<\/p>\n
P.2) with effect from 21.2.2004 (afternoon). In the request for
\n CWP No. 14623 of 2005                              (2)<\/p>\n
voluntary retirement (Annexure P.1), the petitioner has sought<\/p>\n
voluntary retirement and also undertaken not to withdraw the<\/p>\n
resignation tendered by him. However, he also requested to<\/p>\n
adjust him in any other unit of the respondent-Corporation.<\/p>\n
             The petitioner was retired in terms of his offer, but<\/p>\n
was not adjusted against the alternative post, therefore, the<\/p>\n
petitioner filed Civil Writ Petition No.1975 of 2005. The said<\/p>\n
writ petition was dismissed vide order dated 4.2.2005, but a<\/p>\n
direction was issued to the Corporation to decide the<\/p>\n
representation of the petitioner for adjustment. In pursuance<\/p>\n
of such direction, order Annexure P.6 dated 1.4.2005, has<\/p>\n
been passed to the effect that there is no suitable vacancy in<\/p>\n
any of the units of the Corporation, against which the<\/p>\n
petitioner’s request for adjustment could be considered.<\/p>\n
Thereafter, the petitioner submitted a detailed representation<\/p>\n
(Annexure P.7), pointing out that a number of employees have<\/p>\n
been adjusted in the other units of the Corporation. Therefore,<\/p>\n
it was alleged that the non-adjustment of the petitioner is<\/p>\n
arbitrary and illegal. Aggrieved against his non-adjustment<\/p>\n
against the alternative vacancies alleged to be available with<\/p>\n
the Corporation, the petitioner has now invoked the writ<\/p>\n
jurisdiction of this Court.\n<\/p>\n
             In reply, it has been pointed out that the<\/p>\n
petitioner retired on the basis of modified retirement scheme<\/p>\n
from the service of Panipat Woolen Mills Ltd. It is pointed out<\/p>\n
that the Panipat Woolen Mills, where the petitioner was<\/p>\n
employed, has been permanently closed as per the scheme<\/p>\n
sanctioned    by   the   Board   of   Industrial   and   Financial<\/p>\n
Reconstruction. It was pointed out that on 21.11.2003 a<\/p>\n
circular was issued to the effect that the respondent-Mills was
\n CWP No. 14623 of 2005                                (3)<\/p>\n
going to be closed and accordingly, applications were invited<\/p>\n
from the employees for seeking voluntary retirement. It is<\/p>\n
pointed out that since the petitioner sought voluntarily<\/p>\n
retirement under the modified Voluntary Retirement Scheme,<\/p>\n
therefore, the request of the petitioner for transfer to the other<\/p>\n
units is without any substance and that there is no suitable<\/p>\n
vacancy for the petitioner in any of the Units of the<\/p>\n
respondent-Corporation against which he could be adjusted. It<\/p>\n
is also pointed out that the petitioner was relieved from the<\/p>\n
respondent-Mills on 21.2.2004, but the petitioner has not<\/p>\n
come to the Mills to collect the relieving order. It was also<\/p>\n
pointed out that some persons have been adjusted against the<\/p>\n
alternative posts, but no suitable post is available for<\/p>\n
adjustment of the petitioner in any of the units of the<\/p>\n
respondent-Corporation.\n<\/p>\n
              The challenge to the voluntary retirement of the<\/p>\n
petitioner has attained finality with the dismissal of Civil Writ<\/p>\n
Petition No. 1975 of 2005, vide order dated 4.2.2005. This<\/p>\n
Court   has     directed   the   Corporation    to     decide   his<\/p>\n
representation for adjustment in some other unit. It is the<\/p>\n
categorical stand of the respondent-Corporation that there is<\/p>\n
no suitable vacancy against which the petitioner could be<\/p>\n
adjusted. In fact, Shri Mehtani, learned counsel appearing for<\/p>\n
the respondent-Corporation, during the course of arguments<\/p>\n
has stated that in Delhi, Punjab and Rajasthan Regions of<\/p>\n
National Textile Corporation Ltd. (i.e. Respondent No.1), only<\/p>\n
one unit is working and all other units have since been closed.<\/p>\n
Therefore, there is no post against which the petitioner can be<\/p>\n
adjusted.\n<\/p>\n
              The direction to consider adjustment against the
\n CWP No. 14623 of 2005                            (4)<\/p>\n
available post is only a concession. Once, the request of the<\/p>\n
petitioner for voluntary retirement has been accepted, the<\/p>\n
petitioner has no right to seek adjustment in other units of the<\/p>\n
Corporation. Merely because some other employees have been<\/p>\n
adjusted, does not confer any cause of action on the petitioner<\/p>\n
for adjustment as the adjustment has to be made keeping in<\/p>\n
view the suitability of a candidate and availability of the<\/p>\n
vacancy. There is nothing on record, wherefrom it could be<\/p>\n
inferred that the decision of the respondents that no suitable<\/p>\n
post is available, is illegal or arbitrary, which may warrant<\/p>\n
interference by this Court.\n<\/p>\n
             In view of the above, no case for interference is<\/p>\n
made out. Hence, the present writ petition is dismissed.<\/p>\n
