                             —–\n<\/p>\n
           The claimant has filed this appeal for<\/p>\n
enhancement of the compensation. Since the question of<\/p>\n
negligence etc. are not in controversy, I need not go into<\/p>\n
those aspects. The aspect of compensation has been decided<\/p>\n
by the learned Tribunal while deciding the issue no. 3.<\/p>\n
           The relevant facts in that regard are, that<\/p>\n
according to the claimant he was 28 years of age at the<\/p>\n
time of accident, and was earning Rs. 3,000\/- per month,<\/p>\n
and his right hand has become useless, due to injury,<\/p>\n
sustained in the accident, which is under treatment even<\/p>\n
till the date, and is not likely to be normal. To this<\/p>\n
effect the claimant has also deposed, and his younger<\/p>\n
brother Ramotar has also deposed that nuts and bolts have<\/p>\n
been fixed in the hand, and the hand has become totally<\/p>\n
useless.\n<\/p>\n<\/p>\n
           The learned Tribunal found, that the claimant<\/p>\n
has claimed to be serving in private employment, and is
\n                                                              2<\/span><\/p>\n
continuing to receive treatment. The learned Tribunal has<\/p>\n
awarded Rs. 15,000\/- for the pain and agony. Then, since<\/p>\n
the claimant has produced the medical bills for Rs.<\/p>\n
11,744\/-, considering that the treatment is likely to<\/p>\n
continue, a sum of Rs. 15,000\/- has been awarded on that<\/p>\n
count, and another sum of Rs. 10,000\/- has been awarded<\/p>\n
for the future loss of income.\n<\/p>\n<\/p>\n
         Learned counsel for the appellant, assailing the<\/p>\n
award contended, that the appellant has suffered 70%<\/p>\n
permanent disablement, and therefore, the compensation<\/p>\n
awarded is grossly inadequate.\n<\/p>\n<\/p>\n
         I have considered the submissions, and perused<\/p>\n
the record, and find, that from the statement of claimant<\/p>\n
himself, which were recorded on 4.7.1996, it is clear,<\/p>\n
that some of the nails and plates have been removed, and<\/p>\n
one more operation was to be undertaken. While there is<\/p>\n
nothing to show as to what has been the consequence after<\/p>\n
second operation, i.e. whether any disability survives? It<\/p>\n
is a different story that from the documents available on<\/p>\n
record, it appears, that immediately after the accident he<\/p>\n
was operated on 13.8.1995, as appears from Ex. 8. Then,<\/p>\n
Ex.-50 is another document, being receipt for the charges<\/p>\n
for administration of anesthesia. Obviously, therefore, at<\/p>\n
that time some operation must have been undertaken.<\/p>\n
Documents in which regard has not been produced, and what<\/p>\n
has been the consequent survival of disability has also<\/p>\n
not been brought on record.\n<\/p>\n<\/p>\n
          Learned counsel for the appellant wanted me to
\n                                                              3<\/span><\/p>\n
go through the certificate dated 1.10.1996, which has been<\/p>\n
produced on record on 11.2.1997. From perusal of order-<\/p>\n
sheets it transpires, that on 11.2.1997 final arguments in<\/p>\n
the claim were heard, and the claim was decided on the<\/p>\n
next date fixed, being 25.2.1997. Thus, this certificate<\/p>\n
has neither been tendered in evidence, nor had been<\/p>\n
proved, nor the certificate is original one. That apart<\/p>\n
this certificate catalogues the list of disabilities, i.e.<\/p>\n
the nature of injuries suffered, and the extent of<\/p>\n
disability sustained, and in this head entries appearing<\/p>\n
at No. “h, i, & j” are shown to be resulting into 70%<\/p>\n
disability, but admittedly in the certificate none of<\/p>\n
these injuries have been mentioned to have been sustained<\/p>\n
by the victim, still the Doctor has purportedly certified<\/p>\n
the appellant to have sustained 70% handicap. Looking to<\/p>\n
the nature of injuries, even if the matter were to be<\/p>\n
considered on the parameters of the list given in<\/p>\n
Schedule-I, appended to the Workmen’s Compensation Act,<\/p>\n
still the disability is not shown to be any permanent<\/p>\n
disablement.\n<\/p>\n<\/p>\n
          In that view of the matter, I do not find any<\/p>\n
ground to accept the contention that has been raised by<\/p>\n
the learned counsel for the appellant.<\/p>\n
          That being the position, the compensation as<\/p>\n
awarded by the learned Tribunal cannot be said to be<\/p>\n
inadequate, requiring any interference by this Court in<\/p>\n
appeal.\n<\/p>\n
                                                             4<\/span><\/p>\n
           The appeal thus has no force, and the same is,<\/p>\n
therefore, dismissed.\n<\/p>\n<\/p>\n
