Public Prosecutor waives service of<br \/>\n\tnotice of rule on behalf of the respondent &#8211; State of Gujarat.\n<\/p>\n<p>2.\tHaving<br \/>\n\tregard to the facts of the case, the application is taken up for<br \/>\n\thearing today.\n<\/p>\n<p>3.\tThe<br \/>\n\tapplicant &#8211; convict prisoner, who, by judgment and order dated<br \/>\n\t21.12.2006 rendered in Sessions Case No.77 of 2005 by the learned<br \/>\n\tAdditional Sessions Judge,<br \/>\n\tJunagadh, has been convicted for the offence<br \/>\n\tpunishable under Section 302 of the Indian Penal Code and sentenced<br \/>\n\tto life imprisonment, has filed this application through jail,<br \/>\n\tpraying to enlarge her on temporary bail for a period of 60 days, to<br \/>\n\tenable her to attend the delivery of her daughter, who is on her<br \/>\n\tfamily way and her expected due date of delivery is 22\/23.12.2010.\n<\/p>\n<p>4.\tWe<br \/>\n\thave gone through the application and the supporting documents that<br \/>\n\tform part of the application and have considered the submissions<br \/>\n\tadvanced by Ms. LB Dabhi, learned Public Prosecutor for the<br \/>\n\trespondent &#8211; State of Gujarat.  We have also gone through the<br \/>\n\tjail remarks sheet forwarded by the jail authority.\n<\/p>\n<p>5.\tUpon<br \/>\n\tperusal of the jail remarks sheet, we have noticed that the<br \/>\n\tapplicant has undergone total period of 4 years and 5 days<br \/>\n\timprisonment as against the imprisonment for life awarded to him.<br \/>\n\tDuring that period, she has been enlarged on temporary bail on two<br \/>\n\toccasions and also enjoyed furlough leave on two occasions.  Last<br \/>\n\ttemporary bail was granted in her favour in the month of November,<br \/>\n\t2010.  That apart, on perusal of the certificate issued by the<br \/>\n\tconcerned Hospital, it is seen that the expected due date of<br \/>\n\tdelivery of her daughter is 23.12.2010 and that period is now over.\n<\/p>\n<p>6.\tIn<br \/>\n\tview of this, we are not inclined to grant temporary bail in favour<br \/>\n\tof the applicant.\n<\/p>\n<p>7.\tFor<br \/>\n\tforegoing reasons, the application fails and it is accordingly<br \/>\n\trejected.
