2. This appeal is by the plaintiffs befoire\/iithi\u00e9<\/p>\n
aggrieved by dismissal of the iiniiscellaneous .\u00a7.1ii[3}C’)lli(?;aEi1il:il’L’;’a’1’1ii:fllCCli”i<\/p>\n
under Order 9 Rules 4 and 9 rt\/w ilgection 151′ of the Code of
\nCivil Procedure following”    the suit of the
\nappellants for non;*proseoutior;::by_thetrial  The suit was
\nfiled for r6C0\\rf-,r\u00a7i\u00bbvoKf the  herein.\n<\/p>\n
3. Learned appellants submits that the case<\/p>\n
was posted for eVidenc’eiAio\u00bbnl3llO’7.2O00 and as there was strike<\/p>\n
 in Dharwad in connection with the establishment of Circuit<\/p>\n
 Bierieh, thie:appe.l\u00bblants were under the impression that the case<\/p>\n
will ‘r’lot.ig”o “on account of this reason on finding that the<\/p>\n
V _appellantv-._’was”i”iabsent, the trial court dismissed the suit for<\/p>\n
“iv.ii*~non–Vpr0seeuti0n. On the very next day, appellants made an<\/p>\n
 ._appli’cation seeking setting aside of the order passed but the<\/p>\n
 application was rejected and the appellants were therefore<\/p>\n
}<\/p>\n
