\nK. Venkataswami,
\n     This Court\t in a  judgment dated  15.12.1995 in Welfare
\nAssociation of\tAbsorbed  Central  Government  Employees  in
\nPublic Enterprises  & Ors. Vs. Union of India & Anr. [(1996)
\n2 SCC 187], inter alia, held as follows:-\n<\/p>\n
     “From the\tabove extracts,\t it will
\n     be\t  seen\t  that\t  a    clear-cut
\n     distinction is  made in  Rule  37-A
\n     itself between one-third portion of
\n     pension to\t be commuted without any
\n     condition\tattached  and  two-third
\n     portion of\t pension to  be received
\n     as terminal benefits with condition
\n     attached and  two-third portion  of
\n     pension to\t be received as terminal
\n     benefits  with  condition\tattached
\n     with it.  It follows that so far as
\n     commutation  of  one-third\t of  the
\n     pension\tis     concerned,    the
\n     petitioners  herein   as  well   as
\n     petitioners in “common Cause” stand
\n     on\t  similar    footing   with   no
\n     difference. So  far as  the balance
\n     of two-third  pension is concerned,
\n     the   petitioners\t  herein    have
\n     received\tthe    commuted\t   value
\n     (terminal benefits\t ) on  condition
\n     of\t their\t surrendering  of  their
\n     right  of\t drawing  two-thirds  of
\n     their pension.  This  was\tnot  the
\n     case  with\t  the\tpetitioners   in
\n     “Common Cause” case. That being the
\n     position  the   denial  of\t benefit
\n     given to “common Cause” petitioners
\n     to the present petitioners violates
\n     Articles\t14   and   16\tof   the
\n     Constitution.  The\t  reasoning  for
\n     restoring\t  one-third\tcommuted
\n     pension  in  the  case  of\t “Common
\n     Cause” petitioners\t equally applies
\n     to\t the  restoration  of  one-third
\n     commuted pension  in  the\tcase  of
\n     these petitioners as well.
\n     ……………………………..

     ……………………………..

\n     For the  foregoing reasons, we hold
\n     that the  petitioners are\tentitled
\n     to the  benefits as  given by  this
\n     Court in “Common Cause” case so far
\n     as it  related  to\t restoration  of
\n     one-third of  the commuted pension.
\n     consequently, the\timpugned para  4
\n     of Office Memorandum dated 5.3.1987
\n     is quashed.  The writ petitions are
\n     accordingly allowed  to the  extent
\n     indicated above, No costs.”<\/p><\/blockquote>\n
     As the respondents did not give effect to the judgment,
\nthe petitioners, on an earlier occasion, moved this Court in
\nContempt petition  No. 310  of 1996, which was disposed o by
\nthis Court on 7.10.1996 by passing the following order:-\n<\/p>\n
     ”\tThe   counter  has   been  filed
\n     wherein it has been stated that the
\n     directions of this Court are in the
\n     process of being complied with.
\n     The contempt  Petition is\tdisposed
\n     of.”<\/p><\/blockquote>\n
     Thereafter, it  appears that the respondents construing
\nthe judgment  of this  Court literally restored one-third of
\nthe commuted pension and denied all other attendant benefits
\nas  made   available  to   the\tother\tCentral\t  Government
\npensioners. Aggrieved  by that,\t the petitioners  have moved
\nthis Court once again by filing this Contempt Petition.\n<\/p>\n
     Shri Altaf Ahmad, learned Additional Solicitor General,
\nonce  again   attempted\t to   re-open  the  issue  that\t the
\npetitioners cannot  be\ttreated\t at  par  with\tthe  Central
\nGovernment pensioners  even though  such  a  contention\t was
\nraised and negatived by this Court in the said judgment. For
\nthe reasons already stated in the judgment, we hold that the
\npetitioners have  to be\t treated at  par  with\tthe  Central
\nGovernment pensioners.\tWhen we\t directed the respondents to
\nrestore the  one-third portion\tof the\tcommuted pension, it
\nwas intended  to be  given effect  to in  letter and spirit,
\nwhich means  that the  restoration of  pension must  be with
\nattendant  benefits  as\t given\tto  the\t Central  Government
\npensioners. The learned Additional Solicitor General brought
\nto  our\t  notice  the  statement  in  paragraph\t 15  of\t the
\nAdditional Affidavit  on behalf\t of Respondent\tNos. 1 to 3,
\nwhich reads as follows:-\n<\/p>\n
     “In the case of PSU absorbees, they
\n     have  drawn  lump\tsum  capitalized
\n     value  for\t the  2\/3rd  portion  of
\n     pension  as  one  time  settlement.
\n     This portion is therefore no longer
\n     available to the absorbed employees
\n     in\t the   nature  of   pension  and
\n     according to  the Supreme\tJudgment
\n     dated  15.12.1995\tthe  petitioners
\n     have received  the\t commuted  value
\n     (terminal benefits) on condition of
\n     their surrendering\t their right  of
\n     drawing 2\/3rds of their pension. In
\n     view   of\t  this,\t  the\tabsorbed
\n     employees are  not entitled  to the
\n     grant of  dearness relief\ton  this
\n     2\/3rd commuted  portion of\t pension
\n     (terminal benefits).”<\/p><\/blockquote>\n
     It\t will\tbe  noticed   that  the\t Central  Government
\npensioners are\tgiven revision in the pension, which was not
\ngiven to  the petitioners  on the ground that this Court had
\nordered only restoration of pension.\n<\/p>\n
     After hearing  counsel on\tboth sides, we make it clear
\nthat the  respondents are  liable to  restore not  only\t the
\npension as  ordered by\tthis Court in the said judgment, but
\nalso  all   attendant  benefits\t as  given  to\tthe  Central
\nGovernment pensioners.\tWe hold\t that there was some genuine
\ndoubt on  they part  of the  respondents in  construing\t and
\ngiving effect  to the judgment of this Court and, therefore,
\nthere is  no contempt.\tWe now\tdirect\tthe  respondents  to
\ncomply\twith   the  judgment  of  this\tCourt  as  explained
\nhereinbefore within three months from this date.\n<\/p>\n
     The  contempt   petition\twill   stand   disposed\t  of
