Reply on behalf of respondent No.4 is<\/p>\n<p>permitted to be taken on record.\n<\/p>\n<p>CWP No.11846 of 2011<\/p>\n<p>            Mr. Mehtani has filed an affidavit on behalf of respondent No.6<\/p>\n<p>in the Court today. The same is permitted to be taken on record.<\/p>\n<p>            Dr. Sidhu, learned counsel representing respondent No.1, has<\/p>\n<p>produced the Government of India (Transaction of Business) Rules issued<\/p>\n<p>on 14.01.1961. Such Rules provide that the appointment and reservation of<\/p>\n<p>Chairman or Members of the UPSC shall be submitted to the Prime Minister<\/p>\n<p>and the President. Dr. Sidhu states that he has not got any information as<\/p>\n<p>sought in the order dated 01.08.2011.\n<\/p>\n<p><span class=\"hidden_text\">              CWP No.11846 of 2011 (O&amp;M)                          -2-<\/span><\/p>\n<p>             Mr. Gurminder Singh, learned counsel representing respondent<\/p>\n<p>No.3, has filed reply on behalf of respondent No.3 by way of short affidavit<\/p>\n<p>of Ms. Amrit Kaur Gill, Secretary, Punjab Public Service Commission,<\/p>\n<p>Punjab in the Court today. The same is permitted to be taken on record.<\/p>\n<p>             Dr. Sidhu, Mr. Swaitch, Mr. Gurminder Singh and Mr. Mehtani<\/p>\n<p>have concluded their arguments.\n<\/p>\n<p>             Mr. Jindal relies upon an affidavit filed on behalf of Shri Som<\/p>\n<p>Singh, Deputy Secretary to Government of Punjab, to contend that the<\/p>\n<p>advice tendered by the Council of Ministers and\/or Chief Minister cannot be<\/p>\n<p>inquired into in terms of Article 163(3) of the Constitution of India.<\/p>\n<p>             We have examined the Rules of Business of the Government of<\/p>\n<p>Punjab issued on 25.02.1992. Rule 28 (1) (xvii) of such Rules contemplates<\/p>\n<p>that the proposals for appointment of Chairman, Members and Secretary of<\/p>\n<p>the State Public Service Commission shall be submitted to the Hon&#8217;ble<\/p>\n<p>Chief Minister through the Chief Secretary before issue of orders.<\/p>\n<p>             In S.R.Bommai Vs. Union of India (1994) 3 SCC 1 and<\/p>\n<p>B.P.Singhal Vs. Union of India and another (2010) 6 SCC 331, the<\/p>\n<p>Hon&#8217;ble Supreme Court has said that there cannot be any inquiry in respect<\/p>\n<p>of advice tendered, but the questions; whether there was any material on the<\/p>\n<p>basis of which such advice was given; whether such material was relevant<\/p>\n<p>for such advice; and whether the material was such that a reasonable man<\/p>\n<p>could have come to the conclusion, which was under challenge, are open to<\/p>\n<p>judicial scrutiny.\n<\/p>\n<p>             Therefore, we call upon the Chief Secretary to Government of<\/p>\n<p>Punjab to appear in Court at 2 o&#8217;clock today itself to produce the record, to<br \/>\n<span class=\"hidden_text\">              CWP No.11846 of 2011 (O&amp;M)                             -3-<\/span><\/p>\n<p>enable this Court to examine the material relating to appointment of<\/p>\n<p>respondent No.4, as Chairman of Punjab Public Service Commission.<\/p>\n<p>             To be taken up at 2.00 pm.<\/p>\n<p>                                          [HEMANT GUPTA]<br \/>\n                                              JUDGE<\/p>\n<p>                                          [PERMOD KOHLI]<br \/>\n                                              JUDGE<\/p>\n<p>08.08.2011                                  [K.
