MUKHOPADHAYA)<\/p>\n<p>\tHeard<br \/>\nin part.\n<\/p>\n<p>\tIt<br \/>\nis brought to our notice that during the pendency of the case, in<br \/>\nReference Case No.52 of 1994, pending before the Board for Industrial<br \/>\nand Financial Reconstruction (BIFR), BIFR has passed an order dated<br \/>\n31st December 2010<br \/>\nholding that the petitioner &#8211; Kotak Mahindra Bank Limited is<br \/>\nnot holding 75% or more secured debt of the company and therefore<br \/>\ntheir prayer for abatement of the Company&#8217;s Reference has been<br \/>\nrejected and Misc. Application No.67 has been disposed of.\n<\/p>\n<p>\tIn<br \/>\nthe present writ petition as the same issue has been raised as to<br \/>\nwhether Reference Case No.52 of 1994 stands abated in view of the<br \/>\nthird proviso to subsection (1) of Section 15 of the Sick Industrial<br \/>\nCompanies (Special Provisions) Act, 1985 read with Section 41 of the<br \/>\nSecuritisation<br \/>\nand Reconstruction of Financial Assets and Enforcement of Security<br \/>\nInterest Act, 2002  and item No.3<br \/>\nof the Schedule enclosed thereto and such issue, as appears to have<br \/>\nbeen decided by the BIFR in the Misc. Petition, filed in the<br \/>\nReference Case, learned counsel for the petitioner prays for and is<br \/>\nallowed a week&#8217;s time to file amendment petition challenging the<br \/>\naforesaid petition passed in Misc. Application No.67 in Reference<br \/>\nCase No.52 of 1994.\n<\/p>\n<p>\tAs<br \/>\nrequested by the learned counsel appearing on behalf of the appellant<br \/>\nin the second appeal, the appellant of the said appeal is also<br \/>\nallowed to file an application if it intends to move an appeal under<br \/>\nSection 17 of the  Securitisation and Reconstruction of Financial<br \/>\nAssets and Enforcement of Security Interest Act, 2002.
