PRAKASH TATIA,J.\n<\/pre>\n<p>Mr. SP Sharma for the petitioner.\n<\/p>\n<p>      Heard learned counsel for the petitioner.<\/p>\n<p>      The petitioner has been transferred vide order dated<\/p>\n<p>9.2.2010 (Annex.1) and according to the petitioner that<\/p>\n<p>order has not been served upon the petitioner. It is<\/p>\n<p>submitted that relieving order has also been passed and<\/p>\n<p>that has not been served upon the petitioner.              The<\/p>\n<p>petitioner is challenging the order dated 9.2.2010 on the<\/p>\n<p>ground that petitioner expose the respondent no.5 and even<\/p>\n<p>lodged the FIR against the respondent no.5 as back as in<\/p>\n<p>the year 2006. However, in that FIR, police submitted FR<\/p>\n<p>and    then    petitioner   submitted   a   protest   petition.<\/p>\n<p>Thereafter, the petitioner pointed out the misconduct of the<\/p>\n<p>respondent no.5 to the various authorities and also sought<\/p>\n<p>direction from the court to find out the progress in the<\/p>\n<p>criminal case, which is sent for investigation to the police.<\/p>\n<p>The petitioner also pointed out that in spite of the several<\/p>\n<p>representations and in spite of the fact that even the<\/p>\n<p>Commissioner of the Municipal Council itself observed that<\/p>\n<p>the presence of the respondent no.5 in the Municipal<\/p>\n<p>Council, Barmer will certainly influence the propose inquiry<\/p>\n<p>against the respondent no.5. It is also pointed out that in<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>spite of that communication, no action has been taken<\/p>\n<p>against the respondent no.5.       It is also submitted that<\/p>\n<p>respondent no.5 twice transferred from the Municipal<\/p>\n<p>Council, but was not relieved. Now the respondent no.5 is<\/p>\n<p>sought to be given the work on which the petitioner was<\/p>\n<p>working in the Municipal Council, meaning thereby, the<\/p>\n<p>person who has exposed the respondent no.5 will be<\/p>\n<p>removed and at his place the respondent no.5 will be<\/p>\n<p>installed and, therefore, it is clear case of malafides as well<\/p>\n<p>as the transfer has been affected just to favour the<\/p>\n<p>respondent no.5.     The petitioner has placed on record<\/p>\n<p>several documents and drew my attention to all the<\/p>\n<p>documents to show that the respondent no.5 is very<\/p>\n<p>influential person and the Director, Local Bodies is not in<\/p>\n<p>position to take any action against the respondent no.5. It<\/p>\n<p>is also submitted that it is a clear case of victimization of<\/p>\n<p>the petitioner because of the fact that he exposed the<\/p>\n<p>corruption in the Municipal Council, Barmer.<\/p>\n<p>     I considered the submissions of learned counsel for the<\/p>\n<p>petitioner and perused the record of the case.      It may be<\/p>\n<p>true that petitioner might have got some reason to believe<\/p>\n<p>that respondent no.5 is committing some wrong in the<\/p>\n<p>Municipal Council, Barmer and that his belief may be to the<\/p>\n<p>extent that the respondent no.5&#8217;s action are offences under<\/p>\n<p>the penal provisions of law and he lodged FIR and this is<\/p>\n<p>going on since 2006. In the year 2010, the petitioner has<br \/>\n<span class=\"hidden_text\">                                3<\/span><\/p>\n<p>been    transferred   from   Municipal   Council,   Barmer    to<\/p>\n<p>Municipal Council, Pipar City. This court has no reason to<\/p>\n<p>believe that in such facts and circumstances when the<\/p>\n<p>matter is under investigation since 2006 before the police<\/p>\n<p>and in the knowledge of the respondent-authorities then the<\/p>\n<p>petitioner has been transferred just to save the respondent<\/p>\n<p>no.5. At this juncture, it will be appropriate to observe that<\/p>\n<p>mere lodging the complaints against the employer or<\/p>\n<p>superiors or collegues itself is no shield against any transfer<\/p>\n<p>if made in administrative exigency.           The petitioner&#8217;s<\/p>\n<p>contention is that he is being victimized because of<\/p>\n<p>influence of respondent no.5 then, history shows that after<\/p>\n<p>4 years of petitioner&#8217;s lodging FIR, the petitioner has been<\/p>\n<p>transferred.   Therefore, prima facie, it cannot be gathered<\/p>\n<p>that the transfer order has any connection with the alleged<\/p>\n<p>exposure by the petitioner of respondent no.5. Be it as it<\/p>\n<p>may be, I do not find any reason to interfere in the order<\/p>\n<p>Annex.1.\n<\/p>\n<p>       Learned counsel for the petitioner submitted that in<\/p>\n<p>that situation no-one will have courage to expose the<\/p>\n<p>corrupt persons working in the department itself.            The<\/p>\n<p>contention of the petitioner is not well founded. It cannot be<\/p>\n<p>presumed that all authorities above the petitioners are also<\/p>\n<p>weak so that they cannot take any action against the<\/p>\n<p>corrupt persons. However, before doing that, the higher<\/p>\n<p>authorities are required to satisfy about the allegations<br \/>\n<span class=\"hidden_text\">                                              4<\/span><\/p>\n<p>            levelled by one of the employees. However, the petitioner<\/p>\n<p>            is now free to submit his representation alongwith copy of<\/p>\n<p>            this   order    to   the   concerned   authorities   so   that   the<\/p>\n<p>            allegations levelled against the respondent no.5 may be<\/p>\n<p>            examined by the highest authorities. However, it is made<\/p>\n<p>            clear that decision of the higher authorities depends upon<\/p>\n<p>            their satisfaction and not merely because of that there are<\/p>\n<p>            allegations levelled by some of the employees or one of the<\/p>\n<p>            employee against another employee and the authority,<\/p>\n<p>            obviously, will look into the matter after taking into account<\/p>\n<p>            all    the     surrounding     circumstances    to    clean      the<\/p>\n<p>            administration.\n<\/p>\n<p>                   The writ petition of the petitioner is dismissed with<\/p>\n<p>            above observations with liberty to the petitioner to submit<\/p>\n<p>            his representation.\n<\/p>\n<p>                                                     [PRAKASH TATIA], J.\n<\/p>\n<p>cpgoyal\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Rajasthan High Court &#8211; Jodhpur Girish Kumar Paliwal vs State Of Raj. &amp; Ors on 26 March, 2010 1 S.B.
