      The writ petition is filed seeking the following reliefs:<\/p>\n
          i)   Call for Ext.P4 official memorandum
\n          issued by the Additional Chief Judicial
\n          Magistrate Court, Thiruvananthapuram,
\n          and quash the same as illegal.\n<\/p><\/blockquote>\n
          ii)   Give direction to the Honourable
\n          Additional Chief Judicial Magistrate Court
\n          to pass orders on Exts.P3 and P5 as
\n          expeditiously as possible.\n<\/p><\/blockquote>\n
          iii)  Pass such other orders which are
\n          incidental and proper in the interest of
\n          justice.\n<\/p><\/blockquote>\n
Petitioner is the official receiver of the District Court,<\/p>\n
Thiruvananthapuram. In an insolvency proceedings (O.P.(IP).<\/p>\n
No.2\/2008), he has been appointed as a receiver by the Sub<\/p>\n
Court, Thiruvananthapuram         and    such   proceedings are<\/p>\n

initiated to declare the 4th respondent as insolvent. Fourth<\/p>\n
respondent is the prime accused in a crime registered with<\/p>\n
allegations of cheating and defrauding a lot of people, and<\/p>\n
investigation over that crime is pending.          The movable<\/p>\n
properties of the above accused, a number of vehicles seized<\/p>\n
by the investigating agency,      after production before the<\/p>\n
Magistrate Court, are ordered to be sold by the Additional<\/p>\n
Chief Judicial Magistrate, Thiruvananthapuram, passing<\/p>\n
Ext.P4 order without giving notice and hearing the petitioner,<\/p>\n
the Receiver appointed by the Sub Court, is the grievance<\/p>\n
raised for quashing Ext.P4 order.        Petitioner had moved<\/p>\n
Exts.P3 and P5 petitions before the Additional Chief Judicial<\/p>\n
Magistrate, Thiruvananthapurma, and both of them remain to<\/p>\n
be taken up and considered by the Magistrate, is the further<\/p>\n
grievance seeking for a direction to the Magistrate to pass<\/p>\n
orders on such petitions as expeditiously as possible.<\/p>\n
       2. I heard the learned counsel for the petitioner and also<\/p>\n
the Public Prosecutor. It appears that Ext.P4 order has been<\/p>\n
passed by the learned Additional Chief Judicial Magistrate,<\/p>\n

exercising supervisory jurisdiction of the court over the<\/p>\n
investigation of the crime, after perusing the case diary and<\/p>\n
taking note of the steps so far taken in the investigation over<\/p>\n
the crime. The directions issued by the Magistrate militate<\/p>\n
against the order passed by the Sub Court, in the insolvency<\/p>\n
proceedings, wherein the Sub Judge has appointed a receiver,<\/p>\n
the petitioner, directing him to take over the possession of the<\/p>\n
assets of the 4th respondent, who is sought to be declared as<\/p>\n
‘insolvent’. Ext.P2 is the further order moved by the learned<\/p>\n
Sub Judge on the application of the aforesaid receiver,<\/p>\n
wherein he sought orders from the court to enable him to<\/p>\n
seize custody of the properties of the respondents proceeded<\/p>\n
in the insolvency petition.    The learned Sub Judge, after<\/p>\n
considering the petition, has directed the Receiver to bring to<\/p>\n
the notice of the Criminal Courts, wherein some of the<\/p>\n
movable properties belonging to the respondent, after seizure,<\/p>\n
as involved in the crime registered, had been produced, to<\/p>\n
hand over the custody of the movables to him to enable the<\/p>\n
court     to pass   appropriate   orders   in  the   insolvency<\/p>\n
proceedings. Despite bringing to the notice of the Additional<\/p>\n

Chief Judicial Magistrate, after his passing of Ext.P4 order, the<\/p>\n
pendency of the insolvency proceedings and the appointment<\/p>\n
of the receiver directing him to take possession of the movable<\/p>\n
and immovable properties of the persons proceeded against<\/p>\n
and sought to be declared as ‘insolvent’, by filing Exts.P3 and<\/p>\n
P5 petitions, those petitions are not considered and the<\/p>\n
petitioner is not afforded an opportunity to present his case<\/p>\n
before the Magistrate, is the submission of his counsel. It is<\/p>\n
also submitted that Ext.P4 order had been passed by the<\/p>\n
Additional Chief Judicial Magistrate, when he was in charge of<\/p>\n
the Chief Judicial Magistrate for a day, over the crime case<\/p>\n
pending investigation on the file of the Chief Judicial<\/p>\n
Magistrate. Public Prosecutor submits that the directions 3<\/p>\n
and 4 issued in Ext.P4 order by the Additional Chief Judicial<\/p>\n
Magistrate, directing the investigating officer to sell all the<\/p>\n
cars and also the snake boat seized in the case cannot be<\/p>\n
proceeded with inview of the conflicting order given by the<\/p>\n
learned Sub Judge directing the receiver to take over such<\/p>\n
properties belonging to the accused, who are proceeded in the<\/p>\n
insolvency proceedings.     Having regard to the submissions<\/p>\n

made by the counsel on both sides and also taking note of the<\/p>\n
facts and circumstances involved, I find that the following<\/p>\n
directions would suffice the ends of justice. The directions 3<\/p>\n
and 4 issued by the learned        Additional Chief Judicial<\/p>\n
Magistrate under Ext.P4 order,    directing the investigating<\/p>\n
officer to sell the cars and snake boat of the accused, is<\/p>\n
ordered to be kept in abeyance for a period of six weeks from<\/p>\n
the date of this judgment, and the learned Additional Chief<\/p>\n
Judicial Magistrate or the Chief Judicial Magistrate, as the<\/p>\n
case may be, who is having supervision of the crime,<\/p>\n
CBCID.No.169\/2008, pending investigation, shall consider and<\/p>\n
dispose of Exts.P3 and P5 petitions moved by the petitioner,<\/p>\n
receiver appointed by the Sub Court in (O.P.(IP)No.2\/2008,<\/p>\n
within one month from the date of this judgment. Opportunity<\/p>\n
to be extended to the above receiver for making submission on<\/p>\n
his petitions, which shall be disposed after hearing the<\/p>\n
accused, the Asst. Public Prosecutor, and if necessary, the<\/p>\n
investigating officer also.  The concerned Magistrate, after<\/p>\n
giving opportunity of hearing to the parties, shall dispose the<\/p>\n
petitions in accordance with law within the time stipulated.<\/p>\n
