Heard. The appeal is admitted and with the\nconsent of learned Counsel appearing for the parties, it\n\nis taken up for final disposal.\n\n3. For the sake of convenience partieS_.ai*e. re_ferrcd'toV 9 \n\nas they are referred to in the Zelairnfpetiitiondibefore\n\nTribunal.\n\n4. Brief facts of t,heV_ ease'  1' l  ~ _ _\n\nThat on  efideeeased Ashok @\nAshok   this motor cycle\nbearing  l33--Q-2337 along with his\nfriend plridjer\ufb01htowardsivzHassan, a lorry bearing\nregisvtiati-on  oame in a rash and negligent\n\nmanner and 'dash,ed\"':against his motor cycle. As a\n\n Apfesultt; lie\u00e9psustained grievous injuries and succumbed\n\n 'V to on the spot. His parents, two unmarried\n\nI\"n_a}o__r sisters and a minor younger brother \ufb01led a claim\n\n .o Vupetition before the MACT. Hassan, seeking\n\nfl\"-v_V\"eoi'npensation of Rs.14,00,000\/-. The Tribunal by\n\n impugned judgment and award has awarded\n\ncompensation of Rs.3,58,000\/\u00ab~ with interest at 6% pa.\n%..\n\n\n\nAggrieved by the quantum of compensation awarded by\nthe Tribunal the claimants are in appeal seeking\n\nenhancement of compensation.\n\n5. As there is no dispute regarding  lthlgpl' \n\ndeceased Ashok @ Ashok   \n\naccident, and liability offthpe insurer of \n\nvehicle, only point remainslyliorl my coiisideration in the\nappeal is:\n\nW.l%iet.her;_'  H V' l   -- . V.  of\ncompensation\"-awarded,_by\"the Tribunal is\njust' and-'1'.ypro.p--er\"~~_  {does it call for\nenha_n'ce\ufb01;nent?\u00ab.y  ._  \n6.  Counsel for the parties\nand perusinglthegaward of the Tribunal, I am of the\n\n thev\"cornpensation awarded by the Tribunal is\n\nV   iu.  :an:cl\"proper, it is on the lower side and therefore\n\ni   to be enhancezd.\n\n\"  he claimants in support of their contention that\n\n  deceased Ashoka was earning Rs.6,000\/-- pm. by\n\n' working as a driver of light motor vehicle have\n\nQ'\n\n\n\nexamined the father of the deceased - first claimant as\n\nP.W. 1, and an eye witness to the incident as P.W.2 and\nproduced licence of the deceased at Ex.P.9.\n\n5\n\n8. Considering age of the deceased as\n\n year 9 '---.\n\nof accident as 2006 and nature  T\n\nlight motor Vehicle, his, income is;.;,\ufb02ssess\u00e9;d\"'l at\n\nRs.4,500\/-- per month as   assessed\nby the Tribunal.   to Vbedapplied on\nthe basis of   deceased who\nis 40    _:0f works out to\nRs.ri_,0_5,lQL\ufb01,V(::):'\/'V\u00a7\u00ab:_;ii: \/2 12 X 15) and it is\nawairded  'Rs'.3,l2,8 16 \/ ~ awarded by the\n\nTribunal,' dd . V\n\n it -- awarded by the Tribunal under\n\n _ \"-difxfereiat hfeards of convention is just and proper, it does\n\nnot require enhancement.\n\n  Thus the claimants are entitled for the following\n\n compensation:\n\n\n\n1. Loss of dependency Rs.4.05,000\/--\n2. Loss of love and affection Rs. 20.000\/--\n\n3. Loss of estate Rs. \n\n4. Loss of expectancy    \n\n5. Funeral and obsequies\ufb02m  p_ \n\n11. Accordingly the appe_ad:1fi\u00bbs__allowed\" and the\njudgment and award V:of.the is modi\ufb01ed to the\n\nextent stated_he_rein'aboVe.  \n\n12.   to a total compensation\nof R.\u00a7.4,5O;ooo\/;3..Vdpagjagganspt i\u00a7s.3,58,oo0\/- awarded by\nthe iI\"rib'L1na1'... it '-\u00abcoinpensation awarded by the\n\nTribunal  by a sum of Rs.92,000\/-- with\n\n  aia__6% p.a. frorrigr the date of claim petition till\n\n1'\n\nA  ._ the.1dat\"e_v.,ofijea1isation.\n\n 13. \" F\u00e9espondent -- Insurance Co. is directed to deposit\n\n  enhanced compensation amount with interest\n\n  ___\u00a7within two months from the date of receipt of a copy of\n\nthis order.\n\n\n\n14.
