Justice P.R.RAMACHANDRA MENON\n\n Dated :18\/02\/2010\n\n O R D E R\n              P.R RAMACHANDRA MENON, J.\n                      -------------------------\n                   W.P (C) No.4052 of 2010\n                      --------------------------\n             Dated this the 18th February, 2010\n\n                        J U D G M E N T\n<\/pre>\n<p>      The case of the petitioner is that he had availed a<\/p>\n<p>loan from the respondent Bank; but because of some<\/p>\n<p>unforeseen circumstances, he could not make            the<\/p>\n<p>repayments on time.     When the petitioner turned to be a<\/p>\n<p>defaulter, the respondent declared the account of the<\/p>\n<p>petitioner as NPA and proceeded under the SARFEASI<\/p>\n<p>Act, which forms the subject matter of challenge in this<\/p>\n<p>writ petition.\n<\/p>\n<p>      2.   The learned counsel for the petitioner submits<\/p>\n<p>that the petitioner might be permitted to clear the<\/p>\n<p>&#8216;overdue amount&#8217;, providing some breathing time and to<\/p>\n<p>have the loan account regularised\/rescheduled.<\/p>\n<p>      3.   The learned counsel appearing on behalf of the<\/p>\n<p>respondents Bank, on instructions, submits that the<\/p>\n<p>averments in the writ petition are not fully correct, in so<\/p>\n<p>far as the petitioner was provided with the CC facility to<\/p>\n<p>the tune of Rs.3 lakhs and when he became a chronic<\/p>\n<p>W.P (C) No.4052 of 2010<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>defaulter necessitating payment of Rs.1.5 lakhs towards the<\/p>\n<p>&#8216;overdue amount&#8217; itself, considering his request, the Bank<\/p>\n<p>rescheduled the loan by extending a &#8216;term loan&#8217; to the<\/p>\n<p>extent of Rs.1.5 lakhs.      Despite the steps as above, the<\/p>\n<p>petitioner did not choose to repay the due amount on time<\/p>\n<p>and he continued to be a defaulter, under both the loans.<\/p>\n<p>      4. It is stated that the total outstanding liability of<\/p>\n<p>the petitioner will come around Rs.5.24 lakhs and that the<\/p>\n<p>&#8216;overdue amount&#8217;       itself will come nearly Rs.2.5 lakhs.<\/p>\n<p>Unless and until the entire &#8216;overdue amount&#8217; is cleared<\/p>\n<p>forthwith, the question of rescheduling      the loan is not<\/p>\n<p>liable to be entertained, submits the learned counsel.<\/p>\n<p>`     5.    After hearing both the sides, this Court finds<\/p>\n<p>that one more opportunity can be given to the petitioner to<\/p>\n<p>have his loan account regularised; particularly in the light<\/p>\n<p>of the submissions made by the learned counsel for the<\/p>\n<p>Bank, providing a helping hand from the part of the Bank.<\/p>\n<p>      6.    In the above circumstances, the petitioner is<\/p>\n<p>directed to clear the entire &#8216;overdue amount&#8217; by way of<\/p>\n<p>&#8216;two&#8217; equal monthly instalments, the first of which shall be<\/p>\n<p>W.P (C) No.4052 of 2010<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>effected on or before 27.02.2010 and the remaining one<\/p>\n<p>on or before 31.03.2010. Subject to the above,           CC<\/p>\n<p>account of the petitioner will stand regularised .
