PUBLIC PROSECUTOR for\nRespondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE AKIL KURESHI\n\t\t\n\t\n\n \n\nDate\n: 03\/02\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tLearned<br \/>\nCounsel for the petitioner submitted that, even, as per the case of<br \/>\nthe prosecution, the petitioner is not directly involved in the<br \/>\noffence of murder, punishable under Section-302 of the Indian Penal<br \/>\nCode.  The petitioner comes into picture after the incident took<br \/>\nplace. He is stated to have helped the main accused in escaping from<br \/>\nthe hospital, after taking the treatment. She, further, pointed out<br \/>\nthat a co-accused, under somewhat similar circumstances, has been<br \/>\nreleased on bail, by an order of this Court, dated 13.01.2011.\n<\/p>\n<p>2.\t\tIn<br \/>\naddition to the submissions made above, I have also perused the<br \/>\nallegations, against the petitioner, made in the complaint and also<br \/>\nconsidering the role attributed to him by the investigating agency<br \/>\nand when a co-accused, with<br \/>\nsomewhat similar allegations, has been released on bail, I see no<br \/>\nreason to deny parity to the present petitioner.<br \/>\nUnder the circumstances, the petitioner is ordered to be released on<br \/>\nbail in connection with C.R.\n<\/p>\n<p>NO. I-231\/2010,<br \/>\nregistered with SALABATPURA<br \/>\nPOLICE STATION, Surat,<br \/>\nfor the offences punishable under Sections-452, 342, 302, 114 and 188<br \/>\nof the Indian Penal Code, on his furnishing bond of<br \/>\nRs.20,000\/-(Rupees Twenty Thousand), with one surety of the like<br \/>\namount to the satisfaction of the lower Court and subject to the<br \/>\nconditions that, he shall:\n<\/p>\n<p>(1).\t\tnot take undue<br \/>\nadvantage of his liberty or abuse his liberty;\n<\/p>\n<p>(2).\t\tnot act in a<br \/>\nmanner injurious to the interest of the prosecution;\n<\/p>\n<p>(3).\t\tmaintain law and<br \/>\norder;\n<\/p>\n<p>(4).\t\tmark his presence<br \/>\nbefore the concerned Police Station on every 1st and 15th<br \/>\nday of English Calendar month between 11:00 a.m. to 2:00 p.m.;\n<\/p>\n<p>(5).\t\tnot leave the<br \/>\nState of Gujarat without prior permission of the Sessions  Judge<br \/>\nconcerned;\n<\/p>\n<p>(6).\t\tfurnish the<br \/>\naddress of his residence at the time of execution of the bond and<br \/>\nshall not change the residence without prior permission of  this<br \/>\nCourt;\n<\/p>\n<p>(7).\t\tsurrender his<br \/>\npassport, if any, to the Lower Court immediately.\n<\/p>\n<p>3.\t\tIf<br \/>\nbreach of any of the above conditions is committed,  the Sessions<br \/>\nJudge concerned will be free  to take appropriate action in the<br \/>\nmatter.\n<\/p>\n<p>4.\t\tBail<br \/>\nbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p>5.\t\tRule<br \/>\nis made absolute.
