3. Contextual facts are: a report was received at the
\njurisdictional police station on 17.05.2002 alleging that the<\/p>\n
respondents had indulged in criminal activity with a inairiioldject<\/p>\n
of assaulting one Anthony. The responcients::”shariiig” <\/p>\n
common object. armed themselves “fllll1″‘V~’\u20ac3.DCiHS and tcolniniiitted 0<\/p>\n
rioting in the first instance and then a_ss’aulted_’t.heir <\/p>\n
indiscriminately causing injuries_Vo’f.various 1iature.’*v._””Fhe “report 0<\/p>\n
was registered as FIR in Crime 17.2002 “and inrirestigation
\ncommenced. During inve’stiga.tion\ufb01gthe\u00b0’re’spondents came to be
\narrested and were produced ‘before”tlj1e_J uiis\ufb02dlictional Magistrate,<\/p>\n
who remanded4..therr{r0to custody and fthen they were released.<\/p>\n
4. The’ responiclcents’questioned’ initiation of proceedings
\nagainst them   as also the summons issued in<\/p>\n
Cr1.R.P.No.2.’l?.il.\/002005-__  the learned Sessions Judge,<\/p>\n
 i.l)aksy_l1’il3V1a: iiannadai’ \u00abThepetition came to be disposed of with an<\/p>\n
V”.observatioi’i’tliatl question regarding limitation could be raised<\/p>\n

‘proceedings vvere taken up by the Investigating Officer and the<\/p>\n
 fiinaliirreport was \ufb01led only on 01.06.2005. The office of the<\/p>\n
ggiulifisdictional J.M.F.C noticed that, the final report was \ufb01led<\/p>\n
‘\u00abl..:lbe’latedly and as the maximum punishment prescribed for the<\/p>\n
0 0′ “offence levelled against petitioner is punishment for a period of<\/p>\n
imprisonment of three years. it was beyond time. Accepting the<\/p>\n

objections, the learned Magistrate issued notice to the
\nInvestigating Officer to explain the delay in filing of the final<\/p>\n
report. ln response to which, one Sub~lr1spector of<\/p>\n
Vidyadhar Baikerikar filed affidavit on 29.06.2005 <\/p>\n
the delay in filing the belated charge” sheet’; ‘4salrneg.ivasl’<\/p>\n

Magistrate rejected their objections and  iiegilsteredithej case.” 0<\/p>\n

.4 Anthony, FIR came to be registered on the same day. This<\/p>\n

  ‘haslto be reckoned as prescribed by Section 468 of the Cr.P.C.<\/p>\n
 ” “The investigation continued and final report has been filed only<\/p>\n
on 01.06.2005. The respondents are accused of having<\/p>\n

exceeding oneayear b._ut3,not.exceeding three years. Therefore.<\/p>\n

prescribfedv ‘1inde.i’VV’Section 469 of Cr.P.C. Clause [a] of Sub-<\/p>\n
‘Section “{1} of 4’ Section 469 envisages, the limitation shall be<\/p>\n
 “‘\u00a7i’3.lf:-i\/ll\u00a31\u00a7Z\u20ac(IlV”fI’0II1 the date of offence. Therefore, the \ufb01nal report<\/p>\n
 to\ufb02fbe \ufb01led by 16.05.2008, whereas, the charge sheet has<\/p>\n
‘\ufb01been \ufb01led on 1.6.2005. Undoubtedly it was beyond the period of<\/p>\n
if if three years prescribed. However, the provisions of Section 473<\/p>\n
permits seeking of condonation of delay in filing of the final<\/p>\n
git<\/p>\n

reports and it enables the Court, notwithstanding anything
\ncontained in the provisions of Section 468. Court may take<\/p>\n
cognizance of the offence after expiry of the period of  if<\/p>\n
it is satis\ufb01ed on facts and in the circumstances o–f:the.ca’se’ithat<\/p>\n
the delay has been properly explained; if it is necess.aiy.VVto’.’_d.o so if ‘<\/p>\n
in the interest of justice. The benfiefitdof  <\/p>\n
available to the prosecution, but._[when iirial replortwastt\ufb01ied on V<\/p>\n

\nrequesting the Magistratellto\ufb01\u00abbeyond the period

8.   .’thelearned Jurisdictional
\nMagistrate has\u00bb not prescribed by any
\nof this  lnvestigating Officer to explain<\/p>\n
the delay   goiight. Consequently it is noticed<\/p>\n
that, when. such explanation was called for by the Magistrate,<\/p>\n
 the Officer who investigated the case namely Sub-<\/p>\n
 Sri. Bhopal K, did not file any explanatory<\/p>\n
l  statei–nent_v’r1or:’.v’ did he make any such request. On the other<\/p>\n
 theipresent SHO in the office of the complainant police<\/p>\n
l  gistationlby name Sri. Vidyadhar Baikerikar, filed an affidavit on<\/p>\n
   stating that, a jeep was used in commission of the<\/p>\n
 ~ .:crime and to trace the said jeep time was consumed. Firstly,<\/p>\n
that explanation is not of the investigating Officer, secondly, the<\/p>\n
cause so shown \ufb01nds no support irom any of the material,<\/p>\n
gab<\/p>\n
..7,.\n<\/p>\n
because, the investigation in the case had reached finality within
\na period of three months from the date of registration of E’-IR and<\/p>\n
no further investigation was either undertaken or in tlie:’pr”ocess.<\/p>\n
9. The learned Jurisdictional Magistrate!<\/p>\n
magnanimity in accepting the said cause as’..suf\ufb01_cientVto:?ta3a:ie<\/p>\n
cognizance after the expiry of periodpof<\/p>\n
rightly challenged by the accuse(3\\\\:~p__  ‘dudge’ f<\/p>\n
in the impugned order has  t’o_’certai1’1–..favcts not in
\ndispute and has rightly  if conclusion that
\nindefeasible  charge sheet
\nwas not \ufb01led  period of limitation
\nand such”‘accused prosecution had to
\nfail. The l’earn_ed  has rightly concluded that, in<\/p>\n
the absence ofany gexplanfatjon or request from the Investigating<\/p>\n
.\u00abvv.Qifice__1\u00a7:;;Q giegrplainu”the____delay in filing in the \ufb01nal report, the<\/p>\n
f”\u00abMagistrate__fcou_ld’ not have acted on the report of some other<\/p>\n
0ff1cer–V7Who ‘f–\u00a7Kgfas’oI=nfot a party to the investigation. The learned<\/p>\n
‘Sessions.’  conclusion that the order of the learned<\/p>\n
 “dais\/I,agi’strate’f was unsustainable in law cannot be faulted. The<\/p>\n
..ffcoZn-clfusfion is supported by his suf\ufb01cient reasons tenable in law<\/p>\n
 the State has despite fault of its officers pursued further<\/p>\n
action in this revision.\n<\/p>\n
