2. This appeal V   jiidgment and
\naward dated   8676\/ 2005
\non the _   awarding a\n<\/p>\n
-. Feeling aggrieved by
\nthe   “e:toin4pensation, the appeilant has<\/p>\n
pfefefred this-‘a,pp__eai seeking enhancement.<\/p>\n
    ,i’ea*rned counsel for the appellant submitted<\/p>\n
that,,.__”asiA\u00ab:l”per the wound Certificate issued by the St.<\/p>\n
 t. ;JHohIi”s Medical College Hospital, the appeilant has<\/p>\n
i  ‘sustained the following injuries:<\/p>\n
 i) lacerated wound over the right side of the fore<\/p>\n
head above the rigid eye brow.\n<\/p>\n
Tribunal has taken Rs. 100\/— per day. Hence, it is
\nsubmitted that for the job of a mason, RS.200\/- per day
\ncould have been taken as the income. In respect of the
\nmultiplier, the Tribunal has adopted 16 and <\/p>\n
multiplier according to Sarla Verma’s  i-:’I’_he<\/p>\n
learned counsel also submitted,’ that ‘.iti”‘respleetv”0i’<\/p>\n
future medical expenses the aAppe’lla:1t requ_i’res iariother<\/p>\n
Rs.15,000\/- Whereas the__v”‘iTrib1inval hasavllstay-cmiea (mtg<\/p>\n
Rs.8,000\/-.   _\n<\/p>\n
5. The learned ‘c_oi’;.nsel  Rni2″‘Ensurance Company
\nsubmitted that the jdlsmissed since it<\/p>\n
does’ not  1n_e’rit__. lie also submitted that, in the
\nabsenceof any  ‘income, the income taken by the<\/p>\n
‘I’r;ibi1nal is’  and proper and in respect of other<\/p>\n
  has been awarded by the Tribunal is<\/p>\n
 ~. __c’a,.lci1lated. He further submitted that, in the<\/p>\n
 Elarla Verma’s case, only the higher multiplier is<\/p>\n
A’ regtiired to be taken.\n<\/p>\n
  After hearing the learned counsel for both sides as<\/p>\n
H above, it is clear that the injury Nos.1, 4 and 5<\/p>\n
K<\/p>\n
‘s<\/p>\n
sustained by the appellant are serious injuries and he
\nwas working as a mason. Under the circumstances, E
\nfeel that in respect of the following heads, enhancement<\/p>\n
is required.\n<\/p>\n
7. Under the head of loss of ,a1n_enit_ies’  a_’nothe’r <\/p>\n
Rs. 10,000\/- is awarded. For :’eoni_r’ey’an’ce.”1″1o:.1risii.@\u00a7nt,<\/p>\n

\nappellant  an than 51 days and
\nthe ‘i’rib1in\u00e9;i._ in respect of<\/p>\n
atte;nda_nt’dsif::ha_rges*…:_l”‘-Under the head of loss of earning
\ndurinlg-.1:a.id   the amount is required to be<\/p>\n
er_-\u00a7hla.nced i”3y._l_Vl2V1notl1er Rs.10,000\/-. The Tribunal has<\/p>\n
  loss of earning by taking Rs.3,000\/–<\/p>\n
H ~. Viper Vfnionthgkvhich is on the lower side for a mason.<\/p>\n
 “R”s.4,000\/- per month has to be taken. If we<\/p>\n
 A’ ‘caicnlate at this rate, the compensation will come to<\/p>\n
f”r\u00a7lRsl.1,3s,240\/M (4000 x 1.2 x 1*? x 18\/100). The<\/p>\n
H difference comes to Rs.34,560\/–. In respect of future<\/p>\n
medical expenses, asy\ufb01per the doctors evidence, it<\/p>\n
requires another Rs.15,000\/-, whereas only Rs.8,000\/–
\nhasbeen granted. Hence, it is required to be enhanced<\/p>\n
by another RS.7,000\/-.\n<\/p>\n
8. Hence, the appeliant will be entitled<\/p>\n
compensation of Rs.81,560\/\u00ab which s\ufb01eiii i’n.teres’1:\u00bb <\/p>\n
