HARI RANI,JJ\n\n            ==============================\n\n                      W.P.(C)NO. 8928 OF 2008\n\n             ============================\n\n             DATED THIS THE 27TH DAY OF MAY 2008\n\n                                JUDGMENT\n<\/pre>\n<p>Balakrishnan Nair,J.\n<\/p>\n<p>      The petitioner is a practising lawyer of this Court. He submits<\/p>\n<p>that he was the Special Public Prosecutor in several sensitive cases<\/p>\n<p>involving   notorious criminals who are engaged in           smuggling of<\/p>\n<p>narcotic drugs. So a police constable was appointed to give protection<\/p>\n<p>to his life. Later when the petitioner became the State Attorney, the<\/p>\n<p>said arrangement continued. Even now the petitioner is the Special<\/p>\n<p>Prosecutor in many sensitive cases and he is facing threat from the<\/p>\n<p>accused in those cases. So the protection granted to him continued<\/p>\n<p>even after he ceased to be the         State Attorney. But suddenly the<\/p>\n<p>protection granted to him         is terminated and the       Constable is<\/p>\n<p>withdrawn without any reason or justification. So the petitioner filed<\/p>\n<p>Ext.P9 representation before the Director General of Police requesting<\/p>\n<p>to continue to provide      him the protection of the police constable.<\/p>\n<p>Thereafter, this writ petition is filed seeking the following relief:<\/p>\n<p>  i)issue a writ in the nature of mandamus or such other<br \/>\n  appropriate    writ  order     or    direction commanding       the<br \/>\n  respondents to continue to provide sufficient police protection<br \/>\n  to the life and property of the petitioner and his family<\/p>\n<p><span class=\"hidden_text\">wpc 8928\/2008                         -2-<\/span><\/p>\n<p>   members.\n<\/p>\n<\/p>\n<p>       2. A statement has been filed by the third respondent as directed<\/p>\n<p>by this Court. In the statement among other things, it is stated as<\/p>\n<p>follows:\n<\/p>\n<p>   It is to be further submitted that the claim of the petitioner<br \/>\n   that there is threat to his life was not reported to the SHO.<br \/>\n   The police personnel provided to him was also an unarmed<br \/>\n   person. The situation has now totally changed and according<br \/>\n   to the threat assessment done by us, there is no threat to the<br \/>\n   life of the petitioner. The petitioner herein is residing very<br \/>\n   close to Central Police Station and we can rush to the spot in<br \/>\n   no time, if the need arises.       In fact, service of the police<br \/>\n   personnel was allowed by the SHO for the time being and the<br \/>\n   petitioner was the State Attorney for long time and the service<br \/>\n   was continued without interruption. Now there is no situation<br \/>\n   warranting special protection to the petitioner. If at all there<br \/>\n   is any threat to the petitioner, he can very well approach the<br \/>\n   SHO and we will extend necessary protection to the petitioner,<br \/>\n   if it is found necessary. As per the report obtained there is no<br \/>\n   specific threat to the life of the petitioner.<\/p>\n<p>        3. The petitioner has filed a reply affidavit denying the<\/p>\n<p>contentions stated in the statement of the third respondent.<\/p>\n<p>        4. We heard learned counsel for the petitioner and the<\/p>\n<p>respondents.\n<\/p>\n<p>        5. Going by the statement of the police, as per their perception<\/p>\n<p>at present, there is no threat to the life of the petitioner. The police<\/p>\n<p>also undertakes      that if there is any threat, the petitioner    can<\/p>\n<p><span class=\"hidden_text\">wpc 8928\/2008                     -3-<\/span><\/p>\n<p>immediately approach the Station House Officer and the said officer<\/p>\n<p>will immediately    extend necessary protection. It is further stated<\/p>\n<p>that at this stage, a constable need not be posted for giving protection<\/p>\n<p>to the petitioner and there is no circumstance warranting such an<\/p>\n<p>action. We find no reason to discard the above submission. Providing<\/p>\n<p>protection to individuals is a  pure executive function with which we<\/p>\n<p>cannot interfere and substitute our decision for that of the competent<\/p>\n<p>authority under Article 226 of the Constitution of India. So recording<\/p>\n<p>the submission of the third respondent that as and when the petitioner<\/p>\n<p>moves showing that there is a threat to his life, the S.H.O., Central<\/p>\n<p>Police Station, Ernkaulam will extend necessary protection, the writ<\/p>\n<p>petition is disposed of.\n<\/p>\n<p>                                                    Sd\/-\n<\/p>\n<p>                                         K.BALAKRISHNAN NAIR,<br \/>\n                                              JUDGE<\/p>\n<p>                                                    Sd\/-\n<\/p>\n<p>                                            M.C.
