{"id":48456,"date":"2010-09-22T00:00:00","date_gmt":"2010-09-21T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/commissioner-vs-siyaram-on-22-september-2010"},"modified":"2015-04-12T11:02:56","modified_gmt":"2015-04-12T05:32:56","slug":"commissioner-vs-siyaram-on-22-september-2010","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/commissioner-vs-siyaram-on-22-september-2010","title":{"rendered":"Commissioner vs Siyaram on 22 September, 2010"},"content":{"rendered":"<div class=\"docsource_main\">Gujarat High Court<\/div>\n<div class=\"doc_title\">Commissioner vs Siyaram on 22 September, 2010<\/div>\n<div class=\"doc_author\">Author: K.A.Puj,&amp;Nbsp;Honourable Ms.Justice H.N.Devani,&amp;Nbsp;<\/div>\n<pre>   Gujarat High Court Case Information System \n\n  \n  \n    \n\n \n \n    \t      \n         \n\t    \n\t\t   Print\n\t\t\t\t          \n\n  \n\n\n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t\n\n\n \n\n\n\t \n\nTAXAP\/1780\/2009\t 4\/ 4\tORDER \n \n \n\n\t\n\n \n\nIN\nTHE HIGH COURT OF GUJARAT AT AHMEDABAD\n \n\n \n\n\n \n\nTAX\nAPPEAL No. 1780 of 2009\n \n\n======================================\n \n\nCOMMISSIONER\nOF CUSTOM - Appellant\n \n\nVersus\n \n\nSIYARAM\nMETALS PVT LTD - Opponent\n \n\n====================================== \nAppearance\n: \nMS\nAMEE YAJNIK for Appellant. \nNone for\nOpponent. \n======================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE K.A.PUJ\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMS.JUSTICE H.N.DEVANI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 22\/09\/2010 \nORAL ORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MS.JUSTICE H.N.DEVANI)<\/p>\n<p>\tIn<br \/>\n\tthis appeal under Section 130 of the Customs Act, 1962 (the Act),<br \/>\n\tthe Commissioner of Customs, Kandla has challenged the order dated<br \/>\n\t29.04.2008 made by the Customs, Excise and Service Tax Appellate<br \/>\n\tTribunal (the Tribunal), proposing the following four questions<br \/>\n\tstated to be substantial questions of law for the determination by<br \/>\n\tthis Court :-\n<\/p>\n<p>\t Whether,<br \/>\n\tin the facts and circumstances of the present case, the Hon&#8217;ble<br \/>\n\tTribunal was justified in holding that confiscation of the goods<br \/>\n\tunder Section 111 (m) and imposition of penalty under Section 112\n<\/p>\n<p>\t(a) of the Customs Act, 1962 upon the respondent   importer was<br \/>\n\tneither justified nor warranted despite there being undisputed<br \/>\n\tmisdeclaration and violation of the provisions of the Customs Act,<br \/>\n\t1962 ?\n<\/p>\n<p>\tWhether,<br \/>\n\tin the facts and circumstances of the case, when there was<br \/>\n\tundisputed misdeclaration and misdescription of the imported goods<br \/>\n\tin the Bill of Entry filed by the respondent   importer, is the<br \/>\n\tHon&#8217;ble Tribunal justified in setting aside the confiscation of the<br \/>\n\tgoods and imposition of penalty rendered on account of violation of<br \/>\n\tprovisions of the Customs Act, 1962 ?\n<\/p>\n<p>\tWhether,<br \/>\n\tin the facts and circumstances of the case, the Hon&#8217;ble Tribunal is<br \/>\n\tjustified in passing the impugned judgment and order, without<br \/>\n\tassigning proper reasons and by coming to a conclusion that the<br \/>\n\texpert&#8217;s opinion, in the facts of the case, was otherwise though the<br \/>\n\texpert&#8217;s opinion was in favour of the appellant   Department ?\n<\/p>\n<p>\tWhether,<br \/>\n\tin the facts and circumstances of the case, the Hon&#8217;ble Tribunal is<br \/>\n\tjustified in passing the impugned judgment and order, without<br \/>\n\tassigning proper reasons and without coming to specific finding as<br \/>\n\tto how the order in original passed by the Commissioner of Customs,<br \/>\n\tKandla dated 04.02.2004 deserves to be interfered with in the<br \/>\n\tappeal, by substituting the findings of adjudicating authority<br \/>\n\tarrived at in the order in original ?\n<\/p>\n<p>\tThe<br \/>\n\trespondent is a 100% export oriented unit registered with<br \/>\n\tmanufacture and export of Recycled<br \/>\n\tMetal Scrap Ingots and Metal Alloys etc. The respondent filed two<br \/>\n\tbills of entries for import of goods declared as  Transformer<br \/>\n\tScrap  at the rate of US $ 150 PMT. According to the Revenue, the<br \/>\n\tdeclared goods were not transformer scrap but were old used<br \/>\n\ttransformers.  Proceedings were initiated against the respondent for<br \/>\n\tenhancement of value and confiscation of the goods.\n<\/p>\n<p>\tVide<br \/>\n\torder dated 23.01.2004, the Commissioner of Customs, Kandla ordered<br \/>\n\tconfiscation of the goods imported by the respondent under the Bills<br \/>\n\tof Entry along with penalty and fine.  Being aggrieved, the<br \/>\n\trespondent preferred appeal before the Tribunal which came to be<br \/>\n\tallowed by the impugned order.  The Tribunal held that the<br \/>\n\trespondent was permitted to import used old and damaged<br \/>\n\ttransformers, which was nothing but transformer scrap, that it was<br \/>\n\tnot the case of the Revenue that new transformers or transformers in<br \/>\n\tusable condition were imported by the respondent.  That no demand of<br \/>\n\tduty was confirmed against the respondent as they were eligible to<br \/>\n\timport old \/ used \/ damaged transformers.\n<\/p>\n<p>Heard<br \/>\n\tMs. Amee<br \/>\n\tYajnik, learned Senior Standing Counsel for the appellant-revenue.<br \/>\n\tLearned Counsel Ms. Yajnik has assailed the impugned order of the<br \/>\n\tTribunal by reiterating the reasoning adopted by the Adjudicating<br \/>\n\tAuthority.  It is an accepted position<br \/>\n\tthat in the<br \/>\n\tcase of Commissioner of Customs V\/s. Royal Recycling Industries,<br \/>\n\twhich involved similar facts, the Revenue had challenged the order<br \/>\n\tof the Tribunal before this Court in Tax Appeal No.450 of 2009 and<br \/>\n\tvide judgment and order dated 31.03.2010, this Court dismissed the<br \/>\n\tappeal holding that the appeal does not give rise to any question of<br \/>\n\tlaw.\n<\/p>\n<p>In<br \/>\n\tthe circumstances, for the reasons stated in the order dated<br \/>\n\t31.03.2010 passed by this Court in the case of Commissioner<br \/>\n\tof Customs V\/s.
