SETHI, J.\n\n\n\n\nJUDGMENT:\n<\/pre>\n<p>THOMAS,\t J.\n<\/p>\n<p>Leave granted.\n<\/p>\n<p>L&#8230;I&#8230;T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T..J<\/p>\n<p>    By\tthe  impugned  judgment a single judge of  the\tHigh<br \/>\nCourt  ordered\ta redo of the whole laborious exercise\tonce<br \/>\ncompleted  in full measure at great cost of time and energy,<br \/>\nsolely on a technical ground.\n<\/p>\n<p>    Respondent\twas  charge-sheeted for the  offences  under<br \/>\nSection\t 376  of the Indian Penal Code and Section 3 of\t the<br \/>\nSchedules  Castes  and\tScheduled   Tribes  (Prevention\t  of<br \/>\nAtrocities) Act 1989 (for short the Act).\n<\/p>\n<p>    A  Magistrate  committed the case to the Sessions  Court<br \/>\nwho  was  specified as a Special Court to try  the  offences<br \/>\nunder  the  Act.  A charge was framed by the  said  sessions<br \/>\ncourt  against\tthe  respondent only for the  offence  under<br \/>\nSection\t 376  IPC.   After  trial the  said  Sessions  Judge<br \/>\nconvicted  the respondent for the offence under Section\t 376<br \/>\nand  sentenced him to undergo imprisonment for seven  years.<br \/>\nRespondent filed an appeal before the High Court challenging<br \/>\nthe  conviction and sentence.  A learned single judge of the<br \/>\nHigh Court set aside the said conviction and sentence on one<br \/>\ntechnical  ground i.e.\tthe trial judge had no\tjurisdiction<br \/>\nas  he\twas only the Special Court specified under the\tAct.<br \/>\nThe  case  was committed to that court and resultantly\tthat<br \/>\ncourt  has  no jurisdiction to try an offence under  Section<br \/>\n376 of the IPC separately, according to the High Court.\t The<br \/>\noperative portion of the High Court judgment reads thus:\n<\/p>\n<p>    Consequently,  the\tappeal is allowed.  Conviction\tand<br \/>\nsentence  is  set aside.  Since the very commitment  of\t the<br \/>\ncase  to  the Special Court by the learned  Magistrate\tvide<br \/>\norder dated 24.3.1998 was illegal as he could not have taken<br \/>\ncognizance of the offence under the Act of 1989, the learned<br \/>\ntrial  court  shall  return the record of the  case  to\t the<br \/>\nlearned Magistrate for being returned to the prosecution for<br \/>\nbeing presented to the competent court.\n<\/p>\n<p>    This  Court\t has  considered the  question\twhether\t the<br \/>\nSessions  Court\t specified  as\ta Special  Court  under\t the<br \/>\nprovisions  of the Act will cease to be a Sessions Court, or<br \/>\nwhether\t he would continue to be the Sessions judge.   <a href=\"\/doc\/43757\/\">(Vide<br \/>\nGangula\t Ashok\tvs.  State of Andhra Pradesh<\/a> [2000  (2)\t SCC<br \/>\n504].\tThis Court found that even after such  specification<br \/>\nthe  Sessions Court would continue to be the Sessions  Court<br \/>\nand a trial before that court can be held only in accordance<br \/>\nwith the provisions contained in Chapter XVII of the Code of<br \/>\nCriminal  Procedure.  The following is the dictum laid\tdown<br \/>\nby this Court:\n<\/p>\n<p>    It\tis  clear from Sections 14 and 2(1)(d) of  the\tAct<br \/>\nthat  it  is for trial of the offences under the Act that  a<br \/>\nparticular  Court of Sessions in each district is sought  to<br \/>\nbe specified as a Special Court.  Though the word trial is<br \/>\nnot  defined either in the Code or in the Act it is  clearly<br \/>\ndistinguishable\t from  inquiry.\t  Inquiry must always  be  a<br \/>\nforerunner  to\tthe  trial.  Thus the Court  of\t Session  is<br \/>\nspecified  to conduct a trial and no other court can conduct<br \/>\nthe  trial  of\toffences  under\t  the  Act.   Evidently\t the<br \/>\nlegislature  wanted  the  Special  Court to be\ta  Court  of<br \/>\nSession.   Hence the particular Court of Session, even after<br \/>\nbeing  specified  as a Special Court, would continue  to  be<br \/>\nessentially  a\tCourt of Session and designation of it as  a<br \/>\nSpecial\t Court would not denude it of its character or\teven<br \/>\npowers as a Court of Session.  The trial in such a Court can<br \/>\nbe conducted only in the manner provided in Chapter XVIII of<br \/>\nthe  Code  which  contains a fasciculus\t of  provisions\t for<br \/>\ntrial before a Court of Session.\n<\/p>\n<p>    We\tare distressed to note that learned single judge was<br \/>\nnot  told by the government advocate of the fall out of such<br \/>\na  view, if taken by the single judge, that it means all the<br \/>\nwitnesses once examined in full should be called back again,<br \/>\nand   the  whole   chief-examination,  cross-\texamination,<br \/>\nreexamination  and questioning of the accused under  Section<br \/>\n313  of\t the  Code, hearing arguments, then  examination  of<br \/>\ndefence\t witnesses further again final arguments to be heard<br \/>\nand  preparation  of judgment once again.  The\tvery  object<br \/>\nunderlined  in\tSection\t 465 of the Code is that if  on\t any<br \/>\ntechnical  ground  any party to the criminal proceedings  is<br \/>\naggrieved  he  must  raise  the\t objection  thereof  at\t the<br \/>\nearliest  stage.   If  he did not raise it at  the  earliest<br \/>\nstage  he  cannot  be heard on that aspect after  the  whole<br \/>\ntrial is over.\n<\/p>\n<p>    The\t premise adopted by the learned single judge of\t the<br \/>\nHigh  Court is patently erroneous.  The Sessions Court which<br \/>\ntried  the  case  for  the offence under  Section  376,\t IPC<br \/>\ncontinued  to  have  jurisdiction to try the same,  and\t the<br \/>\norder  of  committal  was legally valid.  The  appeal  filed<br \/>\nbefore\tthe  High Court could only be disposed of on  merits<br \/>\nand  not  on  the premise erroneously taken by\tthe  learned<br \/>\nSingle\tJudge.\tHe has not considered the appeal on  merits.<br \/>\nWe,  therefore,\t set aside the impugned judgment.
