(Oral)\n<\/pre>\n<p>           The petitioner was appointed as Assistant Divisional<\/p>\n<p>Manager (Stores) in the office of Divisional Manager, Punjab<\/p>\n<p>Roadways, Jullundur in the pay scale of Rs.825-1580, purely on<\/p>\n<p>temporary basis for a period of six months or till the candidates<\/p>\n<p>recommended by the Punjab      Public Service Commission joins,<\/p>\n<p>whichever is earlier, vide order dated 16.4.1984 (Annexure P-1).<\/p>\n<p>The petitioner continued for   a period of about two years and<\/p>\n<p>thereafter his services were dispensed with w.e.f. 6.7.1986. The<br \/>\n<span class=\"hidden_text\"> CWP NO.3624 OF 1986                               :2:<\/span><\/p>\n<p>present petition came to be filed by the petitioner on 11.7.1987,<\/p>\n<p>seeking setting aside of his termination. It is stated that the name of<\/p>\n<p>the petitioner was sponsored by the Employment Exchange and was<\/p>\n<p>selected on the basis of interview. The petitioner was also eligible<\/p>\n<p>having Mechanical Engineering degree to his credit which was the<\/p>\n<p>prescribed qualification for recruitment to the post of Assistant<\/p>\n<p>Divisional Manager. It is admitted in the writ petition that his<\/p>\n<p>appointment was against direct recruit quota and admittedly, no<\/p>\n<p>advertisement was issued inviting applications from all eligible<\/p>\n<p>candidates.\n<\/p>\n<p>      The claim of the petitioner is, however, resisted by the<\/p>\n<p>respondents, primarily on the ground that               the petitioner&#8217;s<\/p>\n<p>appointment was      on purely temporary basis for a period of six<\/p>\n<p>months or till the candidate recommended by the Punjab Public<\/p>\n<p>Service Commission joins, whichever is earlier which fact is also not<\/p>\n<p>disputed by the petitioner. Even though the termination of the<\/p>\n<p>petitioner was stayed on 15.7.1986 by this Court, but fact remains<\/p>\n<p>that the petitioner was terminated prior to the passing of the<\/p>\n<p>aforesaid order. According to petitioner&#8217;s own admission, his<\/p>\n<p>appointment was against direct recruit quota and admittedly, no<\/p>\n<p>advertisement was issued inviting applications from all eligible<\/p>\n<p>candidates. Thus, the appointment of the petitioner is not in<\/p>\n<p>consonance with Articles 14 and 16 of the Constitution of India.<\/p>\n<p>The issue is squarely covered by a judgment of the Hon&#8217;ble Supreme<\/p>\n<p>Court in the case of J &amp; K Public Service Commission etc., v. Dr.<\/p>\n<p>Narinder Mohan and others etc. AIR 1994 SC 1808 wherein<br \/>\n<span class=\"hidden_text\"> CWP NO.3624 OF 1986                            :3:<\/span><\/p>\n<p>following observations have been made:-<\/p>\n<p>                 &#8220;7&#8230;&#8230;.     The    rule    prescribes       direct<\/p>\n<p>                 recruitment\/promotion by selection as the mode<\/p>\n<p>                 of recruitment which would be done only by PSC<\/p>\n<p>                 or promotion committee duly constituted and by<\/p>\n<p>                 no other body. Therefore, ad hoc employee should<\/p>\n<p>                 be replaced as expeditiously as possible by direct<\/p>\n<p>                 recruits. A little leeway to make ad hoc<\/p>\n<p>                 appointment due to emergent exigencies does not<\/p>\n<p>                 clothe the executive government with power to<\/p>\n<p>                 relax the recruitment or to regularise such<\/p>\n<p>                 appointment nor to claim such appointments to be<\/p>\n<p>                 regular or in accordance with rules. Back door ad<\/p>\n<p>                 hoc appointments at the behest of power source or<\/p>\n<p>                 otherwise and recruitment according to rules are<\/p>\n<p>                 mutually antagonistic and strange bed partners.<\/p>\n<p>                 They cannot co-exist in the same sheath. The<\/p>\n<p>                 former is in negation of fair play. The latter are<\/p>\n<p>                 the products of order and regularity. Every<\/p>\n<p>                 eligible person not necessarily be fit to be<\/p>\n<p>                 appointed to a post or office under the State,<\/p>\n<p>                 selection according to rules by a propertly<\/p>\n<p>                 constituted     commission   and    fitment     for<\/p>\n<p>                 appointment     assures fairness in selection and<\/p>\n<p>                 inhibits arbitrariness in appointments. In view of<\/p>\n<p>                 the Explanation-b to Rule 4, the          ad hoc<br \/>\n<span class=\"hidden_text\"> CWP NO.3624 OF 1986                                 :4:<\/span><\/p>\n<p>                   appointments to any post in any of the three wings<\/p>\n<p>                   of the services under the rules are therefore de<\/p>\n<p>                   hors the rules.
