3       05.8.2011                Heard     learned        counsel         for     the<\/p>\n
                     petitioner.\n<\/p>\n
                                 The     prayer        for       bail      of     the<\/p>\n
                     petitioner was in fact allowed by order dated<\/p>\n
                     26.3.2009     in    Cr.     Misc.    No.     50257    of     2008<\/p>\n
                     subject to the condition that the petitioner<\/p>\n
                     must have not more than two criminal cases<\/p>\n
                     pending against him. It, however, transpires<\/p>\n
                     that    the       petitioner      has      more      than     two<\/p>\n
                     criminal cases against him and as such, when<\/p>\n
                     the    application          was     filed     by     him      for<\/p>\n
                     modification of the aforementioned order, the<\/p>\n
                     same was rejected by an order dated 1.4.2010<\/p>\n
                     in    Cr.   Misc.     No.    41014      of    2009     with    a<\/p>\n
                     direction to the court below that the trial<\/p>\n
                     of the petitioner, keeping in view that he<\/p>\n
                     was    in   custody       since     13.3.2008,        must     be<\/p>\n
                     expedited and concluded preferably within a<\/p>\n
                     period of six months.\n<\/p>\n
                                 When this bail application was filed<\/p>\n
                     on 1.3.2011, a report was called for from the<\/p>\n
                     trial court as to the present stage of trial
\n                   2<\/span><\/p>\n
and the report, which has been received at<\/p>\n
Flag-C dated 18.5.2011, would go to show that<\/p>\n
the case itself was committed to the court of<\/p>\n
sessions on 5.5.2011.\n<\/p>\n
           That being so, when the end of the<\/p>\n
trial of the petitioner is nowhere in sight,<\/p>\n
this Court considering also the fact that the<\/p>\n
petitioner was found entitled for grant of<\/p>\n
bail by this Court earlier, would direct for<\/p>\n
release of the petitioner, namely, Pashupati<\/p>\n
Nath @ Pinkal on bail on furnishing bail bond<\/p>\n
of   Rs.    10,000\/-              (ten       thousand)    with    two<\/p>\n
sureties     of       the        like     amount    each    to    the<\/p>\n
satisfaction                of         Mr.      Ranjeet      Kumar,<\/p>\n
Magistrate,           1st    Class,          Danapur,     Patna    in<\/p>\n
connection with Rupaspur P.S. Case No. 34 of<\/p>\n
2008, subject to the following conditions:-<\/p>\n
           (i)    The            two     bail    bonds     will    be<\/p>\n
furnished, one by the Government servant and<\/p>\n
the other by a close family relative.<\/p>\n
            (ii)        The        petitioner       will     remain<\/p>\n
present in course of trial on each and every<\/p>\n
day and his absence even for a single day<\/p>\n
would automatically entail the consequences<\/p>\n
of cancellation of his bail.\n<\/p>\n
           (iii) The petitioner in case is now<\/p>\n
made accused in any other criminal case, that
\n                     3<\/span><\/p>\n
      would   itself     lead    to    cancellation   of   his<\/p>\n
      bail.\n<\/p>\n
               Subject          to     the     aforementioned<\/p>\n
      conditions,       the   prayer     for   bail   of   the<\/p>\n
      petitioner is allowed.\n<\/p>\n<\/p>\n
