{"id":4858,"date":"2010-01-28T00:00:00","date_gmt":"2010-01-27T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/mangal-another-vs-state-of-u-p-others-on-28-january-2010"},"modified":"2016-02-03T10:48:49","modified_gmt":"2016-02-03T05:18:49","slug":"mangal-another-vs-state-of-u-p-others-on-28-january-2010","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/mangal-another-vs-state-of-u-p-others-on-28-january-2010","title":{"rendered":"Mangal &amp; Another vs State Of U.P. &amp; Others on 28 January, 2010"},"content":{"rendered":"<div class=\"docsource_main\">Allahabad High Court<\/div>\n<div class=\"doc_title\">Mangal &amp; Another vs State Of U.P. &amp; Others on 28 January, 2010<\/div>\n<pre>Court No. - 5\n\nCase :- WRIT - B No. - 3947 of 2010\n\nPetitioner :- Mangal &amp; Another\nRespondent :- State Of U.P. &amp; Others\nPetitioner Counsel :- Mahendra Nath Pandey\nRespondent Counsel :- C.S.C.\n\nHon'ble Sabhajeet Yadav,J.\n<\/pre>\n<p>Heard learned counsel for the petitioners.\n<\/p>\n<p>Learned counsel for the petitioners is permitted to implead Sri<br \/>\nRam Nath as respondent no.5 and Village Consolidation<br \/>\nCommittee through Gram Pradhan as respondent no.6.\n<\/p>\n<p>The submission of learned counsel for the petitioners is that there<br \/>\nexist manure pits in the plot no.92 and 94 and common pathway<br \/>\nfor ingress and egress of petitioners and other villagers but the<br \/>\naforesaid pathway and manure pits have been allotted in the chak<br \/>\nof the respondent no.5, as a consequence of which their ingress<br \/>\nand egress has been blocked. It is also stated that through the<br \/>\naforesaid plots there was a Nali for passing the rainy water of the<br \/>\nvillage. But on account of allotment of aforesaid plot in the chak of<br \/>\nrespondent no.5 the petitioners and other villagers would face<br \/>\nwater logging. The chak road given by the consolidation<br \/>\nauthorities would not sufficiently meet the requirement of the<br \/>\npetitioners, as the petitioners would not be able to flow their rainy<br \/>\nwater through the aforesaid chak road but the Consolidation<br \/>\nOfficer and Deputy Director of Consolidation have failed to<br \/>\nconsider this aspect of the matter, merely for the reason that the<br \/>\nVillage Consolidation Committee did not submit proper proposal<br \/>\nbefore the consolidation authorities. As such the matter requires<br \/>\nserious consideration by this Court.\n<\/p>\n<p>Notice on behalf of respondents no.1, 2, 3 and 4 has been accepted<br \/>\nby learned standing counsel.\n<\/p>\n<p>Issue notice to the respondents no.5 and 6 returnable at an early<br \/>\ndate.\n<\/p>\n<p>Respondents are directed to file counter affidavit by the next date<br \/>\nof listing.\n<\/p>\n<p>The Deputy Director of Consolidation, Mathura Camp, Mainpuri<br \/>\n is directed to file record and extract of C.H. Form No.2 A prepared<br \/>\nby the consolidation authorities at the time of field to field Partal<br \/>\nin respect of plots no.92 and 94 of Village Bitharua, Pargana-<br \/>\nBarnahal, Tehsil-Karhal, District-Mainpuri which was prepared u\/s<br \/>\n8 of U.P.C.H. Act. He shall also file Bandobasti map and present<br \/>\nrecord of consolidation proceeding after allotment of chak<br \/>\nshowing the aforesaid plots.
