Justice S.S.SATHEESACHANDRAN\n\n Dated :08\/02\/2010\n\n O R D E R\n               S.S.SATHEESACHANDRAN, J.\n                   -------------------------------\n                  C.R.P.NO.65 OF 2007 ()\n                 -----------------------------------\n         Dated this the 8th day of February, 2010\n\n                           O R D E R\n<\/pre>\n<p>     The revision is directed against the order dated<\/p>\n<p>28.6.2006 in O.P.(Ele.)No.182 of 2004 passed by the District<\/p>\n<p>Judge, Thodupuzha.        The above O.P. was filed by the<\/p>\n<p>respondent, hereinafter referred to as the &#8216;claimant&#8217; seeking<\/p>\n<p>enhanced compensation for the trees cut and removed and<\/p>\n<p>also damages caused to his property by the drawing of<\/p>\n<p>overhead lines by the Kerala State Electricity Board,<\/p>\n<p>hereinafter referred as the &#8216;Board&#8217;. The claimant had raised a<\/p>\n<p>claim for a sum of Rs.4,25,000\/- as enhanced compensation.<\/p>\n<p>The Board resisted that application contending that adequate<\/p>\n<p>and reasonable compensation had been paid to the claimant.<\/p>\n<p>In the enquiry over the claim, Exts.A1 to A7 were exhibited by<\/p>\n<p>the claimant.   For the respondent Board Ext.B1 valuation<\/p>\n<p>statement was marked. On the materials placed and after<\/p>\n<p>hearing the counsel on both sides, the court below awarded a<\/p>\n<p><span class=\"hidden_text\">CRP.65\/07                       2<\/span><\/p>\n<p>sum of Rs.13,455\/- with interest at the rate of 7.5% per annum<\/p>\n<p>from 5.7.2002, the date of cutting and removing of the trees<\/p>\n<p>till the date of realisation. So far as the sum of Rs.8,188\/-<\/p>\n<p>which had been paid earlier by the Board, interest was<\/p>\n<p>directed to be paid at the rate of 9% per annum from the date<\/p>\n<p>of cutting 5.7.2002 till the date of such payment 12.4.2004.<\/p>\n<p>Enhanced compensation as above with direction to pay<\/p>\n<p>interest as indicated above, is challenged in the revision.<\/p>\n<p>      3. I heard the counsel on both sides. The grievance<\/p>\n<p>canvassed by the learned counsel for the Board is that though<\/p>\n<p>no evidence was let in by the claimant to substantiate any of<\/p>\n<p>the claims canvassed for enhanced compensation over and<\/p>\n<p>above the sum fixed by the Board, the court has arbitrarily<\/p>\n<p>reassessed    the  compensation,     that  too,   reducing  the<\/p>\n<p>percentage of the maintenance cost which had been assessed<\/p>\n<p>by the Board in assessing the compensation. In the case of<\/p>\n<p>assessment of compensation due for the cutting and removal<\/p>\n<p>of jack tree, the Board had taken into account 50% of the<\/p>\n<p>maintenance cost with respect to the yield from that tree for<\/p>\n<p><span class=\"hidden_text\">CRP.65\/07                     3<\/span><\/p>\n<p>fixing the compensation payable. A sum of Rs.1,012\/- was<\/p>\n<p>fixed towards compensation for the tree with reference to the<\/p>\n<p>yield assessed by the Board. Reducing the maintenance cost<\/p>\n<p>fixed by the Board, the court has fixed a sum of Rs.1,500\/- as<\/p>\n<p>the compensation payable. Maintenance cost assessed by the<\/p>\n<p>Board at 50% was deducted by the court at 30% without any<\/p>\n<p>data is the ground urged by the counsel to contend that the<\/p>\n<p>interference with the assessment made by the court is not<\/p>\n<p>proper. I do not find any merit in the submission. So far as a<\/p>\n<p>jack tree is concerned, normally, no expenditure towards<\/p>\n<p>maintaining that tree is required.       At the most, some<\/p>\n<p>deductions can be made with reference to the dropping and<\/p>\n<p>nothing else. Further more, the deduction made with respect<\/p>\n<p>to the maintenance cost, where it was prima facie satisfied<\/p>\n<p>that the deduction made at 50% by the Board was not correct,<\/p>\n<p>cannot at all be found fault with. Similarly in the case of<\/p>\n<p>pepper vines also, the maintenance cost assessed by the Board<\/p>\n<p>was modified by the court. There is no data as to the extent of<\/p>\n<p>the land nor any case for the Board that the claimant had to<\/p>\n<p>engage some other person to maintain his pepper vines, which<\/p>\n<p><span class=\"hidden_text\">CRP.65\/07                       4<\/span><\/p>\n<p>had been cut and removed for drawing the overhead lines. It<\/p>\n<p>is also noticed that 18 pepper vines had been cut and removed<\/p>\n<p>for drawing such lines. The deduction made by the court with<\/p>\n<p>respect to the maintenance cost fixed by the Board in the case<\/p>\n<p>of pepper vines was not proper.       The Board had assessed<\/p>\n<p>annuity return at 5% to fix the compensation payable. The<\/p>\n<p>court, following the guidelines and principles in <a href=\"\/doc\/452127\/\">Kumba<\/p>\n<p>Amma v. K.S.E.B.<\/a> (2000 (1) KLT 542 (FB)) has reassessed<\/p>\n<p>the compensation at 5% annuity return. True, the guidelines<\/p>\n<p>enunciated by this Court in the above decision have been<\/p>\n<p>found to be inapplicable in all types of cases. But in respect of<\/p>\n<p>a small tract of land, and that too in assessing compensation<\/p>\n<p>with respect to 18 pepper vines and one jack tree, the<\/p>\n<p>principles laid down in K.S.E.B. v. Livisha ((2007) 6 SCC<\/p>\n<p>792) by the apex court regarding the factors like situs of the<\/p>\n<p>land, how far and what extent the injury had been caused by<\/p>\n<p>the drawing of the overhead lines to such land etc. are not<\/p>\n<p>relevant. Further more, in the present case, it is also noticed<\/p>\n<p>that the claim for the diminution of land value on account of<\/p>\n<p>the drawing of the overhead lines canvassed by the claimant<\/p>\n<p><span class=\"hidden_text\">CRP.65\/07                       5<\/span><\/p>\n<p>was found against and there is no challenge against the<\/p>\n<p>rejection of that claim. Taking that also into account, with<\/p>\n<p>reference to the meagre sum awarded as compensation, that<\/p>\n<p>too, a sum of Rs.13,455\/-, I find that the challenges canvassed<\/p>\n<p>in the revision contending that it is excessive and<\/p>\n<p>unreasonable cannot be appreciated.         I do not find any<\/p>\n<p>impropriety in the assessment and awarding of the enhanced<\/p>\n<p>compensation ordered by the court below.
