Mr. Patel has<br \/>\nsubmitted that in connection with the similar incident, which is the<br \/>\nsubject matter of present petition, other two employees, who were<br \/>\nfound to be involved in the same incident, similar action of<br \/>\ntermination was taken against them and in case of one of the said<br \/>\nthree employees, the Labour Court passed a similar order, which was<br \/>\nchallenged by the company by way of Special Civil Application<br \/>\nNo.21519 of 2007. He has relied on the order passed by the Court in<br \/>\nthe said matter and submitted that since the incident involved in<br \/>\nboth the cases is same; the employer is also the same; the penalty is<br \/>\nthe same; and similar award is under challenge in present petition<br \/>\nalso, similar order, as is passed in case of Special Civil<br \/>\nApplication No.21519 of 2007 may be passed.\n<\/p>\n<p>\tIn<br \/>\nthe said case, this Court (Coram: Hon&#8217;ble Mr. Justice H.K.Rathod) on<br \/>\n4.10.2007 has passed the following order :-\n<\/p>\n<p>Heard<br \/>\n\tlearned Advocate Mr. KC Raval for the petitioner and Mr. HS Mulia,<br \/>\n\tlearned Advocate for the respondent.\n<\/p>\n<p>Through<br \/>\n\tthis petition, the petitioner has challenged the award made by the<br \/>\n\tlabour court, Baroda in Reference No. 912 of 2000 dated 18th<br \/>\n\tJune, 2007 wherein the labour court has granted reinstatement with<br \/>\n\tcontinuity of service with 20% back wages for interim period.\n<\/p>\n<p>On<br \/>\n\t22nd August, 2007, this Court has, while issuing notice<br \/>\n\tto the respondent returnable on 24th September, 2007,<br \/>\n\tgranted ad interim relief in terms of Para 13-ii subject to<br \/>\n\tcompliance of section 17B of the ID Act, 1947.\n<\/p>\n<p>Rule.\n<\/p>\n<p>\tHeard the learned Advocates for parties on interim relief.\n<\/p>\n<p>Today,<br \/>\n\tlearned Advocate Mr. HS Mulia for the respondent has placed on<br \/>\n\trecord affidavit of respondent regarding unemployment. Copy thereof<br \/>\n\thas been served on learned Advocate Mr. KC Raval by the learned<br \/>\n\tAdvocate Mr. Mulia.\n<\/p>\n<p>Considering<br \/>\n\tthe averments of unemployment made in para 3 by the respondent,<br \/>\n\tlearned Advocate Mr. Raval submitted that the petitioner will pay<br \/>\n\tto the respondent last drawn wages.\n<\/p>\n<p>In<br \/>\n\tview of the aforesaid back ground, no counter is filed against the<br \/>\n\taffidavit of unemployment by the petitioner and considering the<br \/>\n\tfact, the respondent is entitled for full wages last drawn by him<br \/>\n\twith effect from 18th June, 2007 till 30th<br \/>\n\tSeptember, 2007 within the period of one month from the date of<br \/>\n\treceipt of copy of this order and thereafter it is directed to the<br \/>\n\tpetitioner to regularly pay such full wages last drawn by the<br \/>\n\trespondent regularly every month till the matter is finally decided<br \/>\n\tby this Court. However, it is open for the petitioner to move this<br \/>\n\tcourt by filing an application for modification of this order if the<br \/>\n\tpetitioner is having any material to satisfy this court that the<br \/>\n\trespondent has been gainfully employed in any establishment and has<br \/>\n\tbeen earning and receiving adequate remuneration from the<br \/>\n\testablishment.\n<\/p>\n<p>In<br \/>\n\tview of the aforesaid observations and directions, ad interim relief<br \/>\n\tgranted by this court on 22nd August, 2007 is hereby<br \/>\n\tconfirmed as interim relief till the matter is finally decided by<br \/>\n\tthis Court.\n<\/p>\n<p>\tHaving<br \/>\nregard to the said submission, RULE. Ad-interim relief in terms of<br \/>\npara 5(b) subject to compliance with the requirement under Section<br \/>\n17(B) of the Act.
