SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 26\/08\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\tRULE.\n<\/p>\n<p> Shri Pranav Dave, learned AGP<br \/>\nwaives service of notice of rule on behalf of respondents nos. 1 and\n<\/p>\n<p>2.<\/p>\n<p>2.\tIt<br \/>\nis an admitted position that though required, seven days notice has<br \/>\nnot been given to the petitioners before demolishing some portion of<br \/>\nthe construction.  It appears from the impugned notice dated<br \/>\n10\/08\/2010 that seven days time was granted\/seven days notice was<br \/>\nissued, however, seven  is corrected to three.  The aforesaid is not<br \/>\nsatisfactorily explained.  Be that as it may.  It cannot be disputed<br \/>\nthat before any action is taken under Section 202 of the Bombay Land<br \/>\nRevenue Code, seven days notice is required to given.  Under the<br \/>\ncircumstances, the impugned notice\/communication dated 10\/08\/2010 is<br \/>\nhereby quashed and set aside.  It will be open for the Mamlatdar,<br \/>\nVadodara to initiate appropriate proceedings under Section 202 of the<br \/>\nBombay Land Revenue Code in accordance with law on its own merits<br \/>\nafter giving reasonable time to the petitioners to respond to the<br \/>\nsame.  Till then, parties  are directed to maintain status-quo as on<br \/>\ntoday.
