Learned Assistant Government Pleader<br \/>\nMr.A.J.Desai waives service of notice of Rule on behalf of respondent<br \/>\nno. 2.\n<\/p>\n<p>2.\t\tThe<br \/>\napplicant is the original land owner whose land is acquired by<br \/>\nrespondent no. 1. The appellant i.e. respondent no.1 has deposited<br \/>\nthe awarded amount alongwith interest, costs and solatium with the<br \/>\ntrial court and the land owner seeks permission to withdraw the<br \/>\nawarded amount deposited by respondent no.1 herein in respect of LAR<br \/>\nNo. 230 of 2002 decided by the Principal Senior Civil Judge,<br \/>\nGandhinagar.\n<\/p>\n<p>2.\t\tHeard<br \/>\nlearned advocates for the respective parties. In the facts and<br \/>\ncircumstances, the Reference Court is directed to pay 50% of the<br \/>\namount deposited by the respondent no.1 ONGC to the applicant<br \/>\nSadvichar Parivar Trust by crossed account payee cheque. Rest of the<br \/>\namount shall be invested in a fixed term deposit with a nationalised<br \/>\nbank by the Reference Court initially for a period of three years to<br \/>\nbe renewed thereafter for one year till further order. With the above<br \/>\ndirection, the application stands disposed of.
