Mr. Justice Pritinker Diwaker\n\n\n\n       Dated:12\/03\/2010\n\n\n\n:       Judgment\n\n\n\n\n\nCRIMINAL APPEAL UNDER SECTION 374 (2) OF THE CODE OF            \n                 CRIMINAL PROCEDURE.\n\n                    J U D G M E N T\n<\/pre>\n<p>                                 (12.03.2010)<\/p>\n<p>      This  appeal is directed against the  judgment<br \/>\ndated  5.2.1993 passed by Additional Special  Judge,<br \/>\nRaigarh,  in  Special  Criminal  Case  No.   48\/1992<br \/>\nconvicting  the accused\/appellant for  the  offences<br \/>\npunishable  under  Sections  294  and  323  IPC  and<br \/>\nSection  3  (1)  (10)  of the  Scheduled  Caste  and<br \/>\nScheduled Tribe (Prevention of Atrocities) Act  (for<br \/>\nshort  &#8220;the  Act&#8221;)  and sentencing  him  to  undergo<br \/>\nrigorous imprisonment for two months u\/s 294 and 323<br \/>\nIPC  each  and to undergo rigorous imprisonment  for<br \/>\nsix  months and pay fine of Rs. 500 under Section  3<br \/>\n(1) (10) of the Act.\n<\/p>\n<p>2.    Case  of the prosecution in brief is  that  on<br \/>\n17.10.1992  at  about  2.10 p.m.  FIR  (Ex.P-4)  was<br \/>\nlodged  by  one  Munaibai (since deceased)  alleging<br \/>\nthat on the previous night accused\/appellant came in<br \/>\nfront  of  her  house and abused  her  using  filthy<br \/>\nlanguage. Thereafter, the appellant again came there<br \/>\nand  when  she went to inform the police  about  the<br \/>\nincident  of  previous night, accused\/appellant  met<br \/>\nher, abused her and also subjected her to beating in<br \/>\npresence  of  Suritram (PW-2),  Luturam  (PW-3)  and<br \/>\nGhanshyam (PW-4).\n<\/p>\n<p>3.    So  as  to hold the accused\/appellant  guilty,<br \/>\nprosecution has examined 07 witnesses in support  of<br \/>\nits  case.  Statement  of the accused\/appellant  was<br \/>\nalso  recorded  under section 313  of  the  Code  of<br \/>\nCriminal  Procedure in which he denied  the  charges<br \/>\nlevelled  against him and pleaded his innocence  and<br \/>\nfalse implication in the case.\n<\/p>\n<p>4.    After hearing the parties the trial Court  has<br \/>\nconvicted and sentenced the accused \/ appellant  for<br \/>\nthe offences as mentioned above.\n<\/p>\n<p>5.    Heard counsel for the parties and perused  the<br \/>\nmaterial  available on record including the judgment<br \/>\nimpugned.\n<\/p>\n<p>6.    Counsel  for  the appellant submits  that  the<br \/>\nappellant  has been falsely implicated in  the  case<br \/>\nand as the complainant\/victim who has been allegedly<br \/>\nabused   and   assaulted  by  the  accused\/appellant<br \/>\nherself has not been examined by the Court below  on<br \/>\naccount  of her death during the pendency of  trial,<br \/>\nconviction of the accused\/appellant for the offences<br \/>\nmentioned above cannot be sustained.\n<\/p>\n<p>7.     On   the   other   hand   counsel   for   the<br \/>\nrespondent\/State supports the judgment impugned  and<br \/>\nsubmits  that  though the complainant has  not  been<br \/>\nexamined in this case on account of her death during<br \/>\ntrial,  there  are eyewitnesses to the incident  who<br \/>\nhave  categorically stated that the complainant  was<br \/>\nabused and beaten by the accused\/appellant with  the<br \/>\nhelp  of  belt  and therefore the judgment  impugned<br \/>\nbeing just and proper need not be interfered with.\n<\/p>\n<p>8.    During  the pendency of the trial  complainant<br \/>\nMunai  Bai  died and therefore her statement  before<br \/>\nthe  Court could not be recorded. Suritram (PW-2)  &#8211;<br \/>\none  of  the eyewitnesses to the incident has stated<br \/>\nin his evidence that on 17.10.1992 in between 10 and<br \/>\n11  a.m.  when he was in his shop, accused\/appellant<br \/>\ncame on his bicycle, stopped the complainant on  the<br \/>\nroad,  abused  her  using filthy language  and  also<br \/>\nassaulted  her  by giving two blows with  the  belt.<br \/>\nLuturam  (PW-3) who is also one of the  eyewitnesses<br \/>\nto the incident, has stated in his evidence that the<br \/>\ncomplainant  was  abused by the appellant  and  also<br \/>\nassaulted by him with the help of belt as  a  result<br \/>\nof  which she had started weeping. Ghanshyam  &#8211;  the<br \/>\nKotwar of the village (PW-4) has stated that on  the<br \/>\ndate of incident the complainant had come to him and<br \/>\nnarrated the entire story to him. According to  this<br \/>\nwitness,  while  the complainant was  narrating  the<br \/>\nincident  to him, appellant came there,  abused  her<br \/>\nand beaten her with the help of rubber of tyre.\n<\/p>\n<p>9.     Record   shows   that  there   are   material<br \/>\ncontradictions  and omissions in the  statements  of<br \/>\nthese  witnesses. I.L. Thakur, Naib Tahsildar (PW-5)<br \/>\nis the person who had produced the caste certificate<br \/>\nof  the complainant vide Ex. P-3. S.S. Bhagat (PW-6)\n<\/p>\n<p>&#8211;  the Investigating Officer has supported the  case<br \/>\nof the prosecution. Dr. P.K. Tripathi (PW-1) who had<br \/>\nexamined the complainant has not found any injury on<br \/>\nher body. However, he has stated that the victim was<br \/>\ncomplaining pain.\n<\/p>\n<p>10.   Minute scrutiny of the evidence makes it clear<br \/>\nthat  though  abusive  language  was  used  by   the<br \/>\naccused\/appellant  against the complainant,  it  was<br \/>\nnot in the name of her caste nor it was used with an<br \/>\nintention  to insult or humiliate her on account  of<br \/>\nher belonging to a particular caste. To have a ready<br \/>\nreference Section 3 (1) (x) of the Act is reproduced<br \/>\nas under:\n<\/p>\n<blockquote><p>     &#8220;3 (1)    Whoever, not being a member of a<br \/>\n     Scheduled Caste or a Scheduled Tribe,-\n<\/p><\/blockquote>\n<blockquote><p>           .              .             .\n<\/p><\/blockquote>\n<blockquote><p>     (x)   intentionally insults or intimidates<br \/>\n     with  intent  to humiliate a member  of  a<br \/>\n     Scheduled  Caste or a Scheduled  Tribe  in<br \/>\n     any place within the public view.&#8221;\n<\/p><\/blockquote>\n<p>11.   From  the record it appears that none  of  the<br \/>\nwitnesses has stated that the complainant was abused<br \/>\nby the accused\/appellant with an intention to insult<br \/>\nor  humiliate her in the name of her caste and  thus<br \/>\nthe  basic  legal  requirement  for  convicting  the<br \/>\naccused  under this special provision is missing  in<br \/>\nthis  case.  That  being  so,  the  conviction   and<br \/>\nsentence  of the appellant under Section 3 (1)  (10)<br \/>\nof   the   Act  is  hereby  set  aside.  As  regards<br \/>\nconviction  under section 323 IPC and the  resultant<br \/>\nsentence  imposed on the appellant, even the  doctor<br \/>\nwho  had examined her has stated that no injury  was<br \/>\nfound on her body and in this view of the matter his<br \/>\nconviction  under  this  Section  can  also  not  be<br \/>\nmaintained and it is accordingly set aside.  So  far<br \/>\nas conviction of the appellant under Section 294 IPC<br \/>\nis  concerned, the record shows that the complainant<br \/>\nwas   abused  by  the  accused\/appellant   and   the<br \/>\neyewitnesses to the incident have also supported the<br \/>\ncase of the prosecution. Thus there appears to be no<br \/>\nillegality  in the judgment impugned convicting  and<br \/>\nsentencing  the accused\/appellant under Section  294<br \/>\nIPC  and  accordingly conviction and sentence  under<br \/>\nthis section are maintained.\n<\/p>\n<p>12.   Counsel  for  the appellant submits  that  the<br \/>\nappellant has already remained in jail for  about  4<br \/>\nmonths and 20 days. In this view of the matter,  the<br \/>\nappellant need not surrender before any Court.\n<\/p>\n<p>13.
