\n   the respondent initiated
\nprosecu’t’io_n’ of the Apfet\u00bbiti’o:ri’er”‘for offence under Section 138<\/p>\n
of the rggxctuonathe’ gr-ouznd that in relation to debt\/legal<\/p>\n
. 9′”*Iiabii!ity”-“i’n asum of”‘ii’s.14,10,000\/–, he issued cheques for<\/p>\n
9%’h.sgsi9,oo,ooo\/- and 3,5o,ooo\/~ which were<\/p>\n
diAsh._0novured~~;A9 Then the parties entered into Memorandum<\/p>\n
ofVggMu.tu.a:| Understanding (hereinafter for short referred to<\/p>\n
  dated 15.7.1999. In terms of M00, the accused<\/p>\n
 ….i.ssued cheques covering Rs.14,10,000\/– out of which one<\/p>\n
cheque dated 15.1.1999 and the other cheque dated<\/p>\n
1.8.1999 were presented to the Bank, but were<\/p>\n

dishonoured for want of funds. On dishonour of the<\/p>\n
cheques, statutory notice issued was aiso not <\/p>\n
The accused denied liability and was put <\/p>\n
trial, the complainant examined hirnself and’p”rod\u00bbuced_A.thrreV 99’<\/p>\n
impugned cheque, bank endorse1meint,*~’Viega|_”<\/p>\n
acknowiedgrnent. He also produced copy ofythe dated <\/p>\n
15.7.1999. Placing reliance on.—-th,ev–MO_l}, ‘elaiirnsi that the
\naccused had issued   for Rs.50,000\/–,
\nwhich was one_:of__   to discharge

x\u00e9’~..VRs..9l,0O,0OO\/~ and Rs.3,S0,000\/~ was an issue for<\/p>\n
 V. …consideration. By a detailed order, the said revision has<\/p>\n
been allowed, wherein it ls held that En terms of the MOU<\/p>\n
No.15.7.1999, the liability cast on the accused under the<\/p>\n

cheque was postponed in terms of the agreement and<\/p>\n
