By consent, Rule is fixed forthwith.\n<\/p>\n<p>The<br \/>\n\tapplicants &#8211; accused, who have been arrested in I.CR. No. 150<br \/>\n\tof 2009 registered with Mansa Police Station for the offences<br \/>\n\tpunishable under Sections 457, 380, 114, 413 of IPC have moved this<br \/>\n\tCourt under Section 439 of the Code of Criminal Procedure for<br \/>\n\tseeking bail pending trial.\n<\/p>\n<p>The<br \/>\n\taccused moved the application being Criminal Misc. Application No.<br \/>\n\t383 of 2010 before the concerned Sessions Court, which came to be<br \/>\n\trejected on 31.5.2010.\n<\/p>\n<p>This<br \/>\n\tCourt has taken into consideration the documents produced on record<br \/>\n\tand the reasoning assigned by the Sessions Court while rejecting the<br \/>\n\tbail application of the applicant. The applicant deserves to be<br \/>\n\tenlarged on bail for the following reasons:\n<\/p>\n<p>Shri<br \/>\n\tThakore, learned advocate appearing for the applicants submits that<br \/>\n\tthis Court (Coram: A.L. Dave, J.) vide order dated 9.6.2010 in<br \/>\n\tCriminal Misc. Application No. 5887 of 2010 and this Court (Coram:<br \/>\n\tH.B.Antali, J.) vide order dated 5494 of 2010 in Criminal Misc.<br \/>\n\tApplication No. 5494 of 2010 has released the accused in similar<br \/>\n\tcase and on the ground of parity the applicants deserve to be<br \/>\n\tenlarged on bail on appropriate terms and conditions.\n<\/p>\n<p>Looking<br \/>\n\tto the averments and nature of evidence and role of the applicants,<br \/>\n\tthey deserve to be enlarged on bail pending trial.\n<\/p>\n<p>The<br \/>\n\tapplicants have their wherewithal at their ordinary place of<br \/>\n\tresidence and therefore, their presence could be procured by<br \/>\n\timposing appropriate conditions during trial.\n<\/p>\n<p>\tThe<br \/>\n\tprosecution has not voiced any grievance or expressed any<br \/>\n\tapprehension that they are likely to flee from justice, if they are<br \/>\n\treleased on bail.\n<\/p>\n<p>The<br \/>\n\tprosecution has also not expressed any grievance or apprehension<br \/>\n\tthat they are capable of tempering with evidences or influencing the<br \/>\n\twitnesses, if they are released on bail.\n<\/p>\n<p>The<br \/>\n\tSessions Court has not appreciated these aspect and therefore, the<br \/>\n\tsaid order deserves to be quashed and set aside and accordingly, it<br \/>\n\tis quashed and set aside.\n<\/p>\n<p>The aforesaid observations are<br \/>\n\tmade only for the purpose of examining the prayer for bail pending<br \/>\n\ttrial. These observations are prima-facie and shall have no bearing<br \/>\n\twhatsoever upon the trial and the trial Court shall not be<br \/>\n\tinfluenced by it in any way and come to its own conclusion after<br \/>\n\tanalyzing the evidence that may be led during the trial.\n<\/p>\n<p>Considering the submissions made<br \/>\n\ton behalf of the parties and having regard to the circumstances and<br \/>\n\tfacts of the case, the application is allowed and the applicant is<br \/>\n\tordered to be released on bail in connection I.CR. No. 150 of 2009<br \/>\n\tregistered with Mansa Police Station on his executing a bond of<br \/>\n\tRs.5,000=00\/- (Rupees Five Thousand only) each with one surety of<br \/>\n\tthe like amount to the satisfaction of the lower Court and subject<br \/>\n\tto the conditions that they shall :\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of their liberty or misuse their liberty:\n<\/p>\n<p>(b)\tnot<br \/>\nact in a manner injurious to the interest of the prosecution:\n<\/p>\n<p>(c)\tmaintain<br \/>\nlaw and order;\n<\/p>\n<p>(d)\tnot<br \/>\nleave the State of Gujarat without the prior permission of the<br \/>\nSessions Court concerned;\n<\/p>\n<p>(e)\tfurnish<br \/>\nthe address of their residence at the time of execution of the bond<br \/>\nand shall not change the residence without prior permission of this<br \/>\nCourt;\n<\/p>\n<p>(f)<br \/>\nmark their presence before concerned Police Station on every 15th<br \/>\nday of each  English Calendar month initially for a period of 6<br \/>\nmonths between 9.00 a.m. to 2.00 p.m.<\/p>\n<p>(g)\tsurrender<br \/>\ntheir passport, if any, to the lower Court within a week.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the Sessions<br \/>\n\tJudge concerned will be free to issue warrant or to take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbefore the lower Court having jurisdiction to try the case.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute.
