Rule, by consent of the learned counsel made returnable<\/p>\n<p>    forthwith.    Counsel appearing for the Respondent waives service.\n<\/p>\n<p>    With the consent of the learned counsel and at their request, the<\/p>\n<p>    matter is taken up for hearing and final disposal.\n<\/p>\n<p>    2.           The Petitioner before the Court is a co-operative society<\/p>\n<p>    registered under the Maharashtra Co-operative Societies Act, 1960.\n<\/p>\n<p>    The First Respondent is in the employment of the Petitioner and holds<\/p>\n<p>    the post of Secretary since 7th June, 1995. The First Respondent<\/p>\n<p>    instituted proceedings under Section 33-C(2) of the Industrial<\/p>\n<p><span class=\"hidden_text\">                                                         ::: Downloaded on &#8211; 09\/06\/2013 14:06:14 :::<\/span><br \/>\n<span class=\"hidden_text\">                                       2<\/span><\/p>\n<p>    Disputes Act, 1947 claiming the benefit of a difference in wages<\/p>\n<p>    between September 1999 and June 2005 on the basis that he was<\/p>\n<p>    entitled to the benefit of the recommendations of the 5th Pay<\/p>\n<p>    Commission. The Labour Court allowed the application and directed<\/p>\n<p>    the Petitioner to pay a sum of Rs.1,57,175\/- before 31st October, 2008<\/p>\n<p>    failing which the amount was to carry interest at the rate of 6% per<\/p>\n<p>    annum.\n<\/p>\n<p>    2A.\n<\/p>\n<p>              Counsel appearing for the Petitioner submitted that in<\/p>\n<p>    allowing the claim of the First Respondent which admittedly was<\/p>\n<p>    founded on an assertion that the First Respondent was entitled to the<\/p>\n<p>    benefit of the 5th Pay Commission recommendations &#8211; an assertion<\/p>\n<p>    which was disputed by the Petitioner &#8211; the Labour Court has acted in<\/p>\n<p>    excess of its jurisdiction under Section 33-C(2). It was urged that<\/p>\n<p>    Section 33-C(2) is in the nature of an execution proceeding where all<\/p>\n<p>    that remains is a quantification on the basis of an established right<\/p>\n<p>    whereas in the present case the entitlement of the First Respondent<\/p>\n<p>    was in dispute, and the Labour Court could not have adjudicated<\/p>\n<p>    thereon in proceedings under Section 33-C(2).\n<\/p>\n<p><span class=\"hidden_text\">                                                    ::: Downloaded on &#8211; 09\/06\/2013 14:06:14 :::<\/span><br \/>\n<span class=\"hidden_text\">                                        3<\/span><\/p>\n<p>    3.        On the other hand, it was urged on behalf of the First<\/p>\n<p>    Respondent that the entitlement of the First Respondent stands<\/p>\n<p>    concluded in terms of an order passed by the Industrial Court in a<\/p>\n<p>    judgment dated 9th September, 2004 passed in Complaint (ULP) 17 of<\/p>\n<p>    2004. Hence, it was urged that all that has been done by the Labour<\/p>\n<p>    Court in proceedings under Section 33-C(2) is to quantify the amounts<\/p>\n<p>    due and payable to the First Respondent in terms of an entitlement<\/p>\n<p>    that flows out of the previous judgment dated 9th September, 2004 in<\/p>\n<p>    a complaint of unfair labour practices.\n<\/p>\n<p>    3A.       In order to appreciate the rival submissions, it would be<\/p>\n<p>    necessary at the outset to note that the First Respondent had<\/p>\n<p>    instituted a complaint of unfair labour practices, Complaint (ULP) 596<\/p>\n<p>    of 1998, under the Maharashtra Recognition of Trade Unions and<\/p>\n<p>    Prevention of Unfair Labour Practices Act, 1971.               During the<\/p>\n<p>    pendency of the complaint, a resolution was passed by the managing<\/p>\n<p>    committee of the Petitioner on 16th September, 1998 and in<\/p>\n<p>    pursuance thereof agreed terms came to be filed before the Labour<\/p>\n<p>    Court. Clause 2 of the Consent Terms records that the First<\/p>\n<p><span class=\"hidden_text\">                                                    ::: Downloaded on &#8211; 09\/06\/2013 14:06:14 :::<\/span><br \/>\n<span class=\"hidden_text\">                                        4<\/span><\/p>\n<p>    Respondent    was being granted a scale of Rs.950\/- on which he<\/p>\n<p>    would be entitled to Dearness Allowance to the extent of 100% until<\/p>\n<p>    1st September, 1999 and that thereafter he would be entitled to<\/p>\n<p>    Dearness Allowance in accordance with the rules. The complaint was<\/p>\n<p>    disposed of by the Industrial Court as settled out of Court by an order<\/p>\n<p>    dated 27th November, 1998. In 2004 the First Respondent instituted a<\/p>\n<p>    fresh complaint of unfair labour practices       contending that the<\/p>\n<p>    Petitioner had failed to comply with the agreement that was arrived at<\/p>\n<p>    between the parties in the earlier proceedings. The second complaint<\/p>\n<p>    was allowed in the following terms :\n<\/p>\n<blockquote><p>                        &#8220;It is hereby declared that the respondent has<br \/>\n              engaged in and continued to engage in unfair labour<\/p>\n<p>              practices under Item-9 of Sch-IV of the MRTU &amp; PULP Act,<br \/>\n              1971.\n<\/p><\/blockquote>\n<blockquote><p>                        The respondents are directed to cease and desist<br \/>\n              from continuing to engage in unfair labour practices by<br \/>\n              granting the relief as per the Resolution passed on 16-09-\n<\/p><\/blockquote>\n<blockquote><p>              1998 under Subject No. 8 and Resolution No. 8 in the<br \/>\n              meeting No. 5 of the Respondent No. 1 society.&#8221;\n<\/p><\/blockquote>\n<p>    4.        The First Respondent instituted proceedings under Section<\/p>\n<p>    33-C(2) in August 2005 seeking the benefit of wages in accordance<\/p>\n<p>    with the recommendations of the 5th Pay Commission. The contention<\/p>\n<p>    of the First Respondent is that as a Secretary of the Petitioner, his<\/p>\n<p><span class=\"hidden_text\">                                                    ::: Downloaded on &#8211; 09\/06\/2013 14:06:14 :::<\/span><br \/>\n<span class=\"hidden_text\">                                        5<\/span><\/p>\n<p>    appointment has been approved by the Registrar of Co-operative<\/p>\n<p>    Societies and that he is therefore entitled to the benefit of the 5th Pay<\/p>\n<p>    Commission wages. It may be noted at this stage that in the reply<\/p>\n<p>    which was filed by the Assistant Registrar, the position that was taken<\/p>\n<p>    was that though the          State Government has adopted the<\/p>\n<p>    recommendations of the 5th Pay Commission, these were applicable<\/p>\n<p>    to only government employees or to holders of civil posts and that the<\/p>\n<p>    benefit of the aforesaid recommendations had not been granted to<\/p>\n<p>    employees of co-operative societies.         The Labour Court while<\/p>\n<p>    disposing of the application under Section 33-C(2) observed that the<\/p>\n<p>    resolution that was passed by the Petitioner on 16th September, 2008<\/p>\n<p>    only stipulated that the First Respondent would be paid Dearness<\/p>\n<p>    Allowance in accordance with the rules, but this did not clarify as to<\/p>\n<p>    whether the reference to rules related to the rules of the government<\/p>\n<p>    or of the Petitioner. The Labour Court was, however, of the view that<\/p>\n<p>    the subsequent conduct of the Petitioner evinced an intent to allow<\/p>\n<p>    the benefit of the 5th Pay Commission to the First Respondent and it<\/p>\n<p>    was on that ground that the application came to be allowed. The<\/p>\n<p>    conduct of the Petitioner which was relied upon by the Labour Court<\/p>\n<p><span class=\"hidden_text\">                                                      ::: Downloaded on &#8211; 09\/06\/2013 14:06:14 :::<\/span><br \/>\n<span class=\"hidden_text\">                                        6<\/span><\/p>\n<p>    consisted of certain letters which were addressed to the First<\/p>\n<p>    Respondent by the chairmen of the Petitioner accepting his request<\/p>\n<p>    for the grant of 5th Pay Commission scales. Before the Labour Court,<\/p>\n<p>    the contention of the Petitioner was that these letters were fabricated.\n<\/p>\n<p>    The Labour Court, however, rejected the contention holding that the<\/p>\n<p>    Petitioner had not examined its     chairmen in evidence in order to<\/p>\n<p>    substantiate its case that the letters upon which reliance is placed by<\/p>\n<p>    the First Respondent were fabricated.\n<\/p>\n<p>    5.        Counsel appearing for the Petitioner submitted that the<\/p>\n<p>    question as to whether the First Respondent was entitled to the<\/p>\n<p>    benefit of the 5th Pay Commission scales could not have been<\/p>\n<p>    adjudicated upon in     proceedings under Section 33-C(2) and the<\/p>\n<p>    defence that the letters upon which the First Respondent placed<\/p>\n<p>    reliance were fabricated was one that would require adjudication in<\/p>\n<p>    appropriate proceedings. On the other hand, as already noted earlier,<\/p>\n<p>    it has been urged on behalf of the First Respondent that the<\/p>\n<p>    entitlement of the First Respondent stands concluded by the prior<\/p>\n<p>    judgment dated 9th September, 2004 in complaint (ULP) 17 of 2004.\n<\/p>\n<p><span class=\"hidden_text\">                                                     ::: Downloaded on &#8211; 09\/06\/2013 14:06:14 :::<\/span><br \/>\n<span class=\"hidden_text\">                                        7<\/span><\/p>\n<p>    6.        Proceedings under Section 33-C(2) are in the nature of<\/p>\n<p>    execution when the right on the basis of which the claim has been<\/p>\n<p>    preferred is an established right.     In the present case, the First<\/p>\n<p>    Respondent sought the benefit of wages payable in accordance with<\/p>\n<p>    the recommendations of the 5th Pay Commission.              The terms of<\/p>\n<p>    agreement that were arrived at between the parties in complaint<\/p>\n<p>    Rs.950\/- and<\/p>\n<p>    (ULP) 596 of 1998 allowed the First Respondent            a pay scale of<\/p>\n<p>                    Dearness Allowance after 1st September, 1999 in<\/p>\n<p>    accordance with rules. The entitlement of the First Respondent to the<\/p>\n<p>    benefit of the 5th Pay Commission wages was therefore not accepted<\/p>\n<p>    in the terms of settlement which were arrived at between the parties<\/p>\n<p>    or in the underlying resolution of the       management dated 16th<\/p>\n<p>    September, 1998. Similarly, in the subsequent complaint of unfair<\/p>\n<p>    labour practices the Industrial Court by its judgment of 9th September,<\/p>\n<p>    2004 directed the management to grant relief in terms of its resolution<\/p>\n<p>    dated 16th September, 1998. That resolution again did not accept the<\/p>\n<p>    entitlement of the First Respondent to the 5th Pay Commission wages.\n<\/p>\n<p>    The First Respondent purported to rely upon certain letters executed<\/p>\n<p><span class=\"hidden_text\">                                                     ::: Downloaded on &#8211; 09\/06\/2013 14:06:14 :::<\/span><br \/>\n<span class=\"hidden_text\">                                         8<\/span><\/p>\n<p>    by the chairmen of the Petitioner as recognizing his right to receive<\/p>\n<p>    the 5th Pay Commission emoluments. The contention of the Petitioner<\/p>\n<p>    was that the letters were fabricated and that in any event without a<\/p>\n<p>    resolution of the co-operative society, it was not within the authority of<\/p>\n<p>    the chairpersons to grant the benefit of a wage revision. The Labour<\/p>\n<p>    Court manifestly acted in excess of its jurisdiction by adjudicating<\/p>\n<p>    upon this dispute in proceedings under Section 33-C(2). The First<\/p>\n<p>    Respondent has no pre-existing right on the basis of which recourse<\/p>\n<p>    could have been taken to proceedings under Section 33-C(2).                      In<\/p>\n<p>    these circumstances, it was for the First Respondent to seek an<\/p>\n<p>    adjudication   into   his   claim   to   receive   the    benefit       of     the<\/p>\n<p>    recommendations of the 5th Pay Commission. That the First<\/p>\n<p><span class=\"hidden_text\">                                                       ::: Downloaded on &#8211; 09\/06\/2013 14:06:14 :::<\/span><br \/>\n<span class=\"hidden_text\">                                      9<\/span><\/p>\n<p>    Respondent did not have a pre-existing right was also evident from<\/p>\n<p>    the reply filed by the Assistant Registrar, Co-operative Societies<\/p>\n<p>    before the Labour Court.\n<\/p>\n<p>    7.       In these circumstances, the impugned order of the Labour<\/p>\n<p>    Court passed in proceedings under Section 33-C(2) of the Industrial<\/p>\n<p>    Disputes Act, 1947 is in excess of jurisdiction and is unsustainable.\n<\/p>\n<p>    The Petition will have to be allowed and is accordingly allowed. Rule<\/p>\n<p>    is made absolute in terms of prayer clause (A). The judgment of the<\/p>\n<p>    Labour Court dated 29th July, 2008 is set aside. Application (IDA) 13<\/p>\n<p>    of 2005 shall stand dismissed.
