Tolia for the applicant referred to the FIR<br \/>\nand submitted that the chargesheet has been filed considering the<br \/>\nrole attributed with regard to the offence and that only Rs.50,000\/-<br \/>\nwas given out of the amounted looted to take care of other persons.\n<\/p>\n<p>4.\tHe<br \/>\nsubmitted that other persons have been released as per the order<br \/>\npassed in Criminal Miscellaneous Application No.8464 of 2010 and<br \/>\ntherefore the present application requires to be allowed.\n<\/p>\n<p>5.\tLearned<br \/>\nAdditional Public Prosecutor Ms. Manisha Lavkumar Shah resisted the<br \/>\napplication and submitted that he has also been attributed with<br \/>\nspecific role.\n<\/p>\n<p>6.\tHaving<br \/>\nheard learned counsel appearing for the applicant-accused and learned<br \/>\nA.P.P. and having considered the nature of offences, role attributed<br \/>\nand also the fact that the chargesheet has now been filed as also<br \/>\nconsidering the fact that other co-accused has been released, the<br \/>\npresent application deserves to be allowed.\n<\/p>\n<p>7.\tAccordingly,<br \/>\npresent application stands allowed. The applicant<br \/>\nis ordered to be released on regular bail, in connection with<br \/>\nC.R.No-I-97 of 2010 has been registered with Bhavnagar &#8216;B&#8217; Division<br \/>\nPolice Station, on his executing a bond of Rs.5,000\/- (Rupees Five<br \/>\nThousand Only) with one solvent surety of the like amount to the<br \/>\nsatisfaction of the lower Court and subject to the conditions that he<br \/>\nshall:\n<\/p>\n<p>(a)\tnot take<br \/>\nundue advantage of his liberty or abuse his liberty.\n<\/p>\n<p>(b)\tnot to try<br \/>\nto tamper or pressurize the prosecution witnesses or complainant in<br \/>\nany manner.\n<\/p>\n<p>(c)\tnot act in<br \/>\nany manner injurious to the interest of the prosecution.\n<\/p>\n<p>(d)\tmaintain<br \/>\nlaw and order and should cooperate with the investigating officers.\n<\/p>\n<p>(e)\tfurnish the<br \/>\naddress of his residence to the Investigating Officer and also to the<br \/>\nCourt at the time of execution of the bond and shall not change his<br \/>\nresidence without prior permission of the Court.\n<\/p>\n<p>(f)\tsurrender<br \/>\nhis passport, if any, to the lower Court, within a week.\n<\/p>\n<p>(g)\tmark his<br \/>\npresence before concerned Police Station 1st day of every<br \/>\ncalender month between 11:00 AM and 2:00 PM till the trial commences.\n<\/p>\n<p>8.\tIf breach of<br \/>\nany of the above conditions is committed, the concerned Sessions<br \/>\nJudge will be free to issue warrant or take appropriate action in the<br \/>\nmatter.\n<\/p>\n<p>9.\tBail before<br \/>\nthe lower Court having jurisdiction to try the case. It would be open<br \/>\nto the trial Court concerned to give time to furnish the solvency<br \/>\ncertificate if prayed for.\n<\/p>\n<p>10.\tRule is<br \/>\nmade absolute to the aforesaid extent.
