DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 29\/11\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tLearned<br \/>\nadvocate for the applicants do not press this application qua<br \/>\napplicant No.2 [Manojsang Doltusang Darbar (Zala)].  Rule is<br \/>\ndischarged qua applicant No.2.\n<\/p>\n<p>2.\tRule.\n<\/p>\n<p>Learned APP waives service of notice of Rule for respondent &#8211; State.\n<\/p>\n<p>3.\tThis<br \/>\napplication is filed under Section 438 of the Code of Criminal<br \/>\nProcedure in connection with first information report registered at<br \/>\nCR No.I-50\/2010 with Santhal Police Station, District: Mehsana, for<br \/>\nthe offences punishable under Sections 326, 325, 323, 504 &amp; 114<br \/>\netc. of the Indian Penal Code.\n<\/p>\n<p>4.\tLearned<br \/>\ncounsel for the applicants submit that allegations against the<br \/>\napplicants are false and in a cross complaint one of the applicants<br \/>\nalso received injuries.  Usage of stick and injuries on the bodies of<br \/>\nthe injured as per certificate are perused, no case is made out to<br \/>\nattract Section 326 of the Code and, therefore, considering the<br \/>\ncredentials of the applicants and their background in the society,<br \/>\nthey may be granted anticipatory bail.\n<\/p>\n<p>5.\tHeard<br \/>\nlearned APP for the respondent &#8211; State.\n<\/p>\n<p>6.\tHaving<br \/>\nheard learned counsel for the parties and perusing the record of the<br \/>\ncase and considering the facts and circumstances of the case, I am<br \/>\ninclined to grant anticipatory bail to the applicant.\n<\/p>\n<p>7.\tLearned<br \/>\ncounsel for the parties do not press for further reasoned order.\n<\/p>\n<p>8.\tIn<br \/>\nthe result, this application is allowed by directing that in the<br \/>\nevent of the applicants herein being arrested pursuant to FIR being<br \/>\nCR No.I-50\/2010 with Santhal Police Station,  the applicants shall be<br \/>\nreleased on bail on furnishing a bond of Rs.5,000\/- (Rupees Five<br \/>\nThousand only) each with one surety of like amount on following<br \/>\nconditions :-\n<\/p>\n<p>shall<br \/>\n\tcooperate with the investigation and make available for whenever<br \/>\n\trequired;\n<\/p>\n<p>shall<br \/>\n\tremain present at the concerned Police Station on 2nd<br \/>\n\tDecember, 2010 at 11.00 a.m.;\n<\/p>\n<p>shall<br \/>\n\tnot hamper the investigation in any manner nor shall directly or<br \/>\n\tindirectly make any inducement, threat or promise to any witness so<br \/>\n\tas to dissuade them for disclosing such facts to the Court or to any<br \/>\n\tPolice Officer;\n<\/p>\n<p>at<br \/>\n\tthe time of execution of bond, furnish the address to  the<br \/>\n\tInvestigating Officer and the court concerned and shall not change<br \/>\n\tthe residence till the final disposal of the case of till further<br \/>\n\torders;\n<\/p>\n<p>will<br \/>\n\t not  leave India without the permission of the Court and, if is<br \/>\n\tholding a passport, shall surrender the same before the trial Court<br \/>\n\twithin a week;\n<\/p>\n<p>it<br \/>\n\twould be open to the Investigating Officer to file application\/s for<br \/>\n\tremand, if he considers it just and proper and the concerned<br \/>\n\tMagistrate would decide it on merits;\n<\/p>\n<p>this<br \/>\n\torder will be operative if the applicants are arrested at any time<br \/>\n\twithin a period of 90 days;\n<\/p>\n<p>within<br \/>\n\ta period of ten days from the date of arrest, the applicants shall<br \/>\n\tapply for regular bail which application shall be decided by the<br \/>\n\tcompetent Court in accordance with law without being influenced by<br \/>\n\tthe fact that anticipatory bail was granted.\n<\/p>\n<p>9.\tWith<br \/>\nthese directions, this Criminal Misc.
