On 4.11.2007, a<\/p>\n<p>notice, inviting tenders for the work of road from Pookoyikkal<\/p>\n<p>Colony Junction to Kodiyil Kayalvaram coming under the Kollam<\/p>\n<p>Division of Harbour Engineering Department, was published.<\/p>\n<p>When the said notice was published, petitioner submitted an<\/p>\n<p>application for the issuance of tender documents.                 To that<\/p>\n<p>application he was issued Ext.P2 reply informing that the Chief<\/p>\n<p>Engineer has vide his letter dated 26.11.2010, directed that since<\/p>\n<p>the petitioner is an accused in a criminal case involving offences<\/p>\n<p>under the Prevention of Corruption Act, petitioner shall be<\/p>\n<p>excluded from issuing of tender documents. It is stated that<\/p>\n<p>therefore the petitioner cannot be issued tender documents.<\/p>\n<p>According to the petitioner, to his knowledge, he is not an<\/p>\n<p>accused in any crime and that Ext.P2 amounts to blacklisting. It is<\/p>\n<p>with this allegation that this writ petition is filed.<\/p>\n<p>      2. Taking note of the averments in the writ petition that the<\/p>\n<p>petitioner was unaware of any proceedings as mentioned in<\/p>\n<p>WPC.No.38083 \/2010<br \/>\n<span class=\"hidden_text\">                                 :2 :<\/span><\/p>\n<p>Ext.P2, this court had directed the Government Pleader to obtain<\/p>\n<p>instructions from the Chief Engineer. Accordingly, Government<\/p>\n<p>Pleader has obtained instructions and submits that in relation to<\/p>\n<p>the work executed by the petitioner for Fisheries Harbour at<\/p>\n<p>Chiravathur, the Vigilance and Anti Corruption Bureau has<\/p>\n<p>registered a case C.C.No.5\/2007 and that the petitioner is the 5th<\/p>\n<p>accused in that case. It is submitted that accused No.1 to 4 are<\/p>\n<p>departmental officers. It is further submitted that in view of the<\/p>\n<p>above Government have issued a direction to the Chief Engineer<\/p>\n<p>to exclude the petitioner from issuing tender documents till the<\/p>\n<p>disposal of the case and that it was in pursuance to the said<\/p>\n<p>direction, the Chief Engineer has issued the letter dated<\/p>\n<p>26.11.2010, mentioned in Ext.P2.\n<\/p>\n<p>      3.  Now that    from the facts    disclosed by the Learned<\/p>\n<p>Government Pleader,      it is evident that the petitioner is an<\/p>\n<p>accused in a criminal case, I think that during the pendency of<\/p>\n<p>the criminal case, Government is       at liberty to exclude the<\/p>\n<p>petitioner from awarding contracts. Such a decision taken by the<\/p>\n<p>Government cannot be said to be arbitrary or mala fide<\/p>\n<p>warranting interference of this court. If that be so, the refusal of<\/p>\n<p>WPC.No.38083 \/2010<br \/>\n<span class=\"hidden_text\">                                  :3 :<\/span><\/p>\n<p>the respondents to issue tender documents      to the petitioner<\/p>\n<p>cannot be faulted.\n<\/p>\n<p>     Writ petition fails and is dismissed.\n<\/p>\n<\/p>\n<p>                                          (ANTONY DOMINIC)<br \/>\n                                              JUDGE<br \/>\nvi\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court D.
